AN ORDINANCE DECLARING AN EMERGENCY FOR
THE CITY OF SOUTHLAKE WATER SUPPLY AND
MUNICIPAL WATER SYSTEM, ESTABLISHING A
WATER USE PROGRAM, PROVIDING FOR
SCHEDULING OF WATER USE BY NECESSITY OF
USE AND LOCATION OF USER, PROVIDING FOR A
PENALTY FOR VIOLATION OF THIS ORDINANCE,
PROVIDING A SAVINGS CLAUSE, PROVIDING AN
EFFECTIVE DATE AND PROVIDING FOR
PUBLICATION.
Whereas; the City Council of the City of Southlake, Texas,
finds that an emergency currently exists in supplies of water
available for use by its citizens who are being supplied by the City
of Southlake Municipal Water System; and,
Whereas; there exists an emergency in availability of water
for fire control and fire fighting purposes, for human and animal
~sumption and for other necessities of human and animal life; and,
Whereas; the City Council of the City of Southlake, Texas,
finds that unless emergency water rationing and use controls are
implemented immediately it is probable that the City of Southlake
Municipal Water System will not have water available during July
Through October, 1985, at various undefinable times of high quantity
water usage for fire prevention, control and fire fighting or for use
for consumption and other necessities for human and animal life:
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
Section One: This Ordinance shall not apply to nor in any manner
effect or curtail in any way the use of water by the public,
including any customer or subscriber for water service from the
Municipal Water System of the City of Southlake, for drinking
purposes by humans or animals or for any indoor uses including, but
not limited to, bathing and washing.
(a) Ail customers and subscribers whose water
service is furnished to an even numbered address
shall be permitted to use water for outdoor purposes
on uses on Mondays, Wednesdays and Fridays only.
(b) Ail customers and subscribers whose water
service is furnished to an odd numbered address shall
be permitted to use water for outdoor purposes on
uses Tuesdays, Thurdays and Saturdays only.

Section Four: Except as to Section five which shall be'effective
only after publication, this ordinance shall be effective immediately
upon its passage and shall remain in effect until October 31, 1985,
unless extended or repealed by subsequent ordinance passed by the
City Council of the City of Southlake prior thereto. If this
ordinance is not extended on or before October 31, 1985, it shall
expire without further action by the City Council for the City of
Southlake.
Section Five: Any person, firm or corporation, or employee,
representative or agent thereof who violates any of the provisions of
this ordinance and who is convicted of same, shall be fined in a sum
not to exceed One Thousand Dollars ($1,000.00) for each and every
violation which occurs. Each day that a use occurs which is a
violation of any provision of this ordinance shall be a separate and
distinct offense hereunder.
Section Six: If any provision, section or portion of this
ordinance shall be held invalid or unconstitutional, the particular
provision, section, or portion held invalid or unconstitutional shall
not be deemed to effect the validity of any other section, provision
portion of this ordinance.
Section Seven: The operation of any ordinance, part of an ordinance,
of any rule or regulation or part thereof in conflict with the
provisions of this ordinance are hereby suspended during the period
of time in which this ordinance is in effect.
Section Eight: This Ordinance shall, due to the emergency which
presently exists, take effect immediately from and after its passage
and publication in accordance with the provision of the general Laws
of the State of Texas, except that no fine or other penalty shall be
enforced under this ordinance until publication of this Ordinance or
a caption thereof in the official newspaper of the City of Southlake
as required by law, and it is accordingly so ordained.
PRESENTED and PASSED on the 24th day of July, 1985, at a
regular meeting of the City Council of the City of Southlake, Texas,
by a vote of 4 ayes, and 0 nays, and 0 abstain, and 1
absent.
