An Ordinance amending the Zoning Ordinance of
the City of Southlake, Texas, being Ordinance
No. 261-A, to provide for the requirement of
submissio~ and approval of a site plan prior
to the issuance of a building permit and
certificate of occupancy in certain zoning
use districts in Southlake; requiring the
submission and approval of a conceptual or
final site plan prior to obtaining certain
zoning classifications of real property,
establishing the requirements and criteria
for such site plans, containing a savings
clause; and providing for an effective date.
ORDAINED BY T}IE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
Section 1. Purpose. This ordinance and the site plan required
for Multi-Family Residential, Mobile/Modular Home Park, Neighorhood
Service Community Com/~lercial, Light Commercial, Heavy Commercial, and
Light Industrial zoning districts pursuant to this ordinance is
intended to permit the orderly development of such districts and uses
of land therein while allowirlg the City to insure that all uses and
construction of improvements within such districts better serve the
needs of the public, reduce the demands on community facilities and
provide a harmony of growth within the City of Southlake and within

the various zoning districts.
Section 2. Site Plan Requirement. A site plan approved by the
City Council shall be a prerequisite to the issuance of building
permits and ceItificates of Occupancy for any property located in.
zoning districts designated as: Multi-Family Residential (A-10);
Mobile/Modular Home Park (M/MH); Neighborhood Service ConLmunity
Conm~ercial (NSCC); Light Con'~ercial (LC); Heavy Commercial (HC); or
Light Industrial (LI). A site plan approval request may be heard
concurrent with or subsequent to a zoning change request, but not
prior thereto.
Section 3. Conceptual Site Plan. Prior to consideration of
anf site plan of a part of a larger tract under the same ownership
which has previously been designated Multi-Family Residential,
Mobile/Modular Home Park, Neighborhood Service Community Commercial,
Light Commercial, Heavy Commercial or Light industrial, a conceptual
slte drawing for the entire tract shall be presented for approval as
in other rezoning cases. A conceptual site drawing shall also
accompany any request for Multi-Family Residential, Mobile/Modular
Home Park, Neighborhood Service Community Commercial, Light
Commercial, Heavy Commercial or Light Industrial zoning not
accompanied by a final site plan. The conceptual site drawing or any
final site plan, as may be amended and approved by the City Council
shall become a part of such zone change and subsequent si~e plans
shall conform thereto. Such conceptual site drawing shall contain at
least the following:
(a) A scaled drawing in which not less than one (1)
inch is one hundred (100) feet, showing dimen-
sioned boundaries of the property, the location
and width of streets and highways adjacent to
and on the property, and any other easements
thereon or adjacent thereto.
(b) Elevation contours at at least ten (10) foot
intervals.

General location and description of existing
utility services, including size of water mains,
types of sewage and other waste disposal and
proposed location of liquid and solid sewage
and waste disposal systems to be installed on
the premises.
Existing improvements proposed to be retained
when the property is developed.
Undimensioned location and approximate size of
proposed buildings.
Undimensioned drawings showing proposed access
points, general location of parking and points
of access.

(j) Proposed landscaped areas.

Section 4. Site Plan Approval. A request for a site plan
approval shall be processed in accordance with the same review and
hearing procedure as a proposal for a zoning district change.
Section 5. Modification of Site Plan. The commission may
recomn~end and the council may require such modification of a
conceptual site plan or a site plan as will permit the proposed
project to exist harmoniously with existing and anticipated
development of surrounding areas.
Section 6. 7unendments. Ail site plans approved hereunder may
be amended pursuant to the same procedure and subject to the same
limitations and requirements as any other site plan would require for
original approval.
Section 7. Site Plan Information. Every application for
approval of a site plan for real property located in Multi-Family
Residential; Mobile/Modular Home Park; Neighborhood Service Community
Commercial; Light Commercial; Heavy Commercial; or Light Industrial
zoning dJstlicts shall contain sufficient information delineating the
characteristics of the site, changes in those characteristics as may
be proposed by the development, how the development will relate to
public services and facilities, and what protection features are
included to insure that the development will be compatible with
existing and allowable development on adjacent property. The site
plan shall show at least the following items of information:
The land area included with the site, the land
area of all abutting sites and the zoning classification
thereof, all public and private rights-of-way and easements
bounding and intersecting the site and the abutting sites
which are proposed to be continued, created, relocated
and/or abandoned.
(b) The proposed finished grade of the site, shown to
contour intervals of not to exceed two (2.0) feet.
(c) A description of the proposed site and the boundaries
thereof.
(d) The location of each existing and each proposed struc-
ture on the site, the general category of use or uses
to be contained therein, the number of stories, gross
floor area, and the location of entrances and exits to
buildings.
(e) The location of all on-site facilities for liquid and
solid waste disposal.
(f) The location and width of all curb cuts and driving
lanes.
(g) The dimensions and capacities of parking areas and
loading areas, and the character and location of illumi-
nation facilities for same.
(h) All pedestrian walks, malls and open areas for use by
tenants or the public.
(i) The location and height of all walls, fences and screen
planting, and landscaping.
(j) The location, size, height, and orientation of all signs
other than signs flat on building facades.
(k) The types of surfacing, such as paving, turfing or
gravel, to be used at the various locations.
(1) The location of fire hydrants.
(m) Drainage plans and information as may be available to
show that the development will not be adversely affected
by flooding action.
(n) Front building elevation sketch.
Section 8. Administrative. On approval of the site plan, all
necessary permits or certificates authorized thereby may be issued.
Subsequent to such approval, minor changes may be authorized by the
enforcing officer when such minor changes will not cause any of the
following circumstances to occur:
(a) A change in the character of the development.
(b) An increase in the ratio of the gross floor areas in
structures to the area of any lot.
(c) An increase in the intensity of use.
(d) A reduction in the originally approved separations
between buildings.
(e) An increase in the problems of circu]ation, safety,
and utilities.
(f) An increase in the external effects on adjacent
property.
(§) A reduction in the originally approved setbacks
from property lines.
(h) An increase in ground coverage by structures.
(i) A reduction in the ratio of off-street parking and
loading space to gross floor area in structures.
(j)
A change in the subject, size, lighting, or
orientation of originally approved signs.
An increase in off-site traffic congestion
resulting from any such change.
Section ~. Requirement For Zoning. NO application for zoning
change for which a request for zoning to Multi-Family, Mobile/Modular
Home Park, Neighborhood Service Community Commercial, Light
Comalercial, Heavy Commercial or Light Industrial is made shall be
accepted or filed by the City Secretary unless a conceptual site plan
or final site plan is filed concurrent therewith.
Section 10. Filin~ Fee. A fee of the greater of $150.00 or
$50.00 per acre encompassed by the Site Plan shall be paid to the
City at the time of filing of each conceptual or final site plan
which fee shall be for the purpose of reimbursing the City for
Administrative and Engineering time expended in reviewing such site
plan. Such fee shall be non-refundable regardless of the disposition
of the Application for zoning.
Section 11. Savings Clause. If any section, clause or
provision of this ordinance should be declared by a Court of
competent jurisdiction to be invalid, or unconstitutional, the same
shall not affect the validity of this ordinance as a whole or any
part thereof, other than the part so declared to be invalid or
unconstitutional.
Section 12. Repealer. This ordinance shall not repeal any
existing ordinance, rule or resolution of the City of Southlake,
Texas, in effect on the date of its passage, but in the event of a
conflict between any such ordinance, rule or resolution this said
ordinance and the terms and provisions contained herein shall
control.
Section 13. Exemptions. This ordinance and the requirements
set forth herein shall not apply to any tract for which a plat
approval request was on file with the City of Southlake on May 7,
