480-FFORDINANCE NO. 480-FF AN ORDINANCE AMENDING ORDINANCE NO. 480, AS AMENDED, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS; PROVIDING FOR CHANGES IN ADMINISTRATIVE PROCESSING OF APPLICATIONS FOR APPROVAL OF CONCEPT PLANS, DEVELOPMENT PLANS, AND SITE PLANS; ADDING DEFINITIONS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 or'the Local Government Code; and WHEREAS, the city has adopted Ordinance No. 480, as amended, as the Comprehensive Zoning Ordinance for the city; and WHEREAS, the city council has determined that it is appropriate and in the best interests of the city to promote the public health, safety, and general welfare of its residents by amending Ordinance No. 480 to revise the procedures for processing applications; and WHEREAS, the city council has given published notice and held public hearings with respect to the amendment of the zoning ordinance as required by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. Section 4. "Definitions," of Ordinance No. 480, as amended, is hereby amended by revising the definition for "Administrative Official" and by adding definitions for "Clean Review," "Formal Submittal," and "Minor Revisions" thereto to read as follows: I CPYYDOCS\ORDXDRAFTxZONING\480FF-FINAL.DOC Approved - May 18. 1999 Page 1 of 6 "ADMINISTRATIVE OFFICIAL - The official, or his designee, appointed by the City, Manager to enforce and administer the terms of this Ordinance. CLEAN REVIEW - An application review which complies with the requirements of all applicable city ordinances, with the exception of requirements for which a variance is requested, if any, and a limited number of minor revisions as set forth and defined in the most current submittal policies. For purposes of administrative processing of applications, the Administrative Official may adopt procedures and policies, including the number of minor revisions permitted. FORMAL SUBMITTAL - An application which meets the requirements of all applicable city ordinances, except for those items for which a variance is sought, and is deemed by the Administrative Official to have a clean review as defined herein. M1NOR REVISIONS - Items such as labeling, spelling, or other items deemed to be minor by the Administrative Official." SECTION 2. Section 40, "Development Plans and Site Plans," of Ordinance No. 480, as amended, is hereby amended by revising Subsection 40.2, "Application" to read as follows: "40.2 APPLICATION / FORMAL SUBMITTAL - A written application for development plan or site plan approval shall be submitted to the Administrative Official on forms prepared by the City, together with all required documents, such as studies, drawings, exhibits, or other ordinance requirements, in sufficient size and number as required by the most current submittal policies, and any reasonable information requested by the Administrative Official to assist the City in its review of the application. Any site plan or development plan application submitted after a submittal deadline will be processed at the next applicable submittal deadline. An application will not be advertised for public hearing nor forwarded to the Planning and Zoning Commission and the City Council for action until it meets the criteria of a formal submittal." SECTION 3. Section 4l, "Concept Plans," of Ordinance No. 480, as amended, is hereby amended by revising Subsection 41.2, "Application" to read as follows: L CITYDOCS~ORD\DRAFqSZONING~480FF-FINAL DOC Approved - May 18, 1999 Page 2 of 6 "41.2 APPLICATION / FORMAL SUBMIITAL - A written application for concept plan approval shall be submitted to the Administrative Official on forms prepared by the City, together with all required documents, such as studies, drawings, exhibits, or other ordinance requirements, in sufficient size and number as required by the most current submittal policies, and any reasonable information requested by the Administrative Official to assist the City in its review of the application. The application shall be signed by the owner, lessee, developer or option holder of the property. Any concept plan application submitted after a submittal deadline has passed will be processed at the next applicable submittal deadline. An application will not be advertised tbr public hearing nor forwarded to the Planning and Zoning Commission and the City, Council for action until it meets the criteria of a formal submittal." SECTION 4. Section 46. "Amendments to the Zoning Ordinance," of Ordinance No. 480, as amended, is hereby amended by revising Subsection 46.2, "Application" to read as follows: "46.2 APPLICATION / FORMAL SUBMITTAL Zoning Changes (no exhibit required) - An application for a change of zoning classification by a property owner shall be submitted on forms prepared by the City and shall be accompanied by the following: An application form signed by the owner(s) of all property ~vithin the area of request and notary acknowledgment of all signatures. On unplatted properties, a boundary survey shall be provided with a metes and bounds description and with all improvements shown. This survey shall be performed by a public surveyor registered in the State of Texas. Platted properties shall provide the lot, block, subdivision and phase description for each lot requesting a change of zoning. Any documents, such as studies, drawings, exhibits, or other ordinance requirements, in sufficient size and number, as set forth in the most current submittal policies and any reasonable information requested by the Administrative Official to assist the City in its I :\CITYDOCS\ORD\DRAFTXZONING\480FF-FINAL DOC Approved - May 18, 1999 Page 3 of 6 review of the application. Any application submitted after a submittal deadline will be processed at the next applicable submittal deadline. An application will not be forwarded to the Planning and Zoning Commission and the City Council or advertised for any required public hearings until it meets the criteria of a formal submittal. Zoning Changes (requiring exhibits) - An application for a change of zoning classification by a property owner shall be accompanied by a concept plan, development plan, or site plan as required by this ordinance or any other ordinances of the City. Text Amendment - An owner, lessee, developer or option holder of real property within the City may file an application for an amendment to the text of this ordinance. The application shall be submitted on forms prepared by the City and shall be accompanied by any reasonable information requested by the Administrative Official to assist the City in its review of the application. Application Fees - Every application shall be accompanied by the appropriate submittal fee as established by the City, and under no condition shall said fee or any part thereof be refunded for failure of such amendments to be enacted into SECTION 5. This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 6. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, L:\CITYDOCS\ORD\DRAFTXZONING\480FF-FINAI~ DOC Approved - May 18, 1999 Page 4 of 6 sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7. The City Secretary of the City of Southlake is hereby authorized to publish this ordinance in book or pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts ~vithout further proof than the production thereof. SECTION 8. The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least ten (10) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance or its caption and penalty in the official City newspaper one time within ten days after final passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. SECTION 9. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained.
