AN ORDINANCE AMENDING ORDINANCE NO. 480, THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE,
TEXAS, BY AMENDING SECTION 32, "S-P-2 GENERALIZED SITE
PLAN DISTRICT" BY ALTERING AND CORRECTING CERTAIN
PROCESSING REGULATIONS AND REVISING THE SITE PLAN
REQUIREMENTS IN SUCH DISTRICT; BY AMENDING SECTION 34t
"ACCESSORY USES" BY ADDING AND AMENDING CERTAIN
DEFINITIONS TO CLARIFY THE REGULATIONS CONTAINED THEREIN;
BY AMENDING SECTION 45, "SPECIFIC USE PERMIT" REGARDING
DISTANCE REGULATIONS FOR THE SALE OF ALCOHOLIC BEVERAGES;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
ORDINANCES; PROVIDING A SEVE1L%BILITY CLAUSE; PROVIDING
A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS
CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FOI~M;
PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING FOR
PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AM
EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule city
acting under its charter adopted by the electorate pursuant to
Article XI, Section 5 of the Texas Constitution and Chapter 9 of
the Local Government Code; and
WHEREAS, the City of Southlake has heretofore adopted
Ordinance No. 480, as amended, as the Zoning Ordinance for the
city; and
WHEREAS, the City Council of the City of Southlake now deems
it necessary to amend Ordinance No. 480, as amended, as provided
herein; and
WHEREAS, the City Council has given published notice and held
public hearings with respect to the amendment of the Zoning
Ordinance as required by law.
NOWv THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:

SECTION I
That Section 32, "S-P-2 Generalized Site Plan District
Regulations" of Ordinance No. 480, as amended, is hereby amended
by revising Section 32.3 to read as follows:
"32 . 3.
APPLICATION - A change of zoning to an S-P-2
Site Plan District shall be granted by the City
Council only upon the written application of
the owner or his representative and a
recommendation of Planning and Zoning
Commission. No variances to other city
ordinances, codes or regulations will be
permitted. The S-P-2 Site Plan District allows
the City COuncil to approve variances to
regulations of this ordinance only."
SECTION 2
That Section 32, "S-P-2 Generalized Site Plan District
Regulations" of Ordinance No. 480, as amended, is hereby amended
by revising Section 32.4 to read as follows:
"32.4. SITE PLAN
Applicants for S-P-2 zoning must file an
application for site plan approval in
accordance with the following requirements:
(1) Date, scale, north point, name of owner
and name of person preparing the site
plan.
(2) Location of existing boundary lines and
dimensions of the tract.
(3)
Indicate minimum building setback
dimensions adjacent to all property lines.
(4)
Designation and location of proposed
general land use for each building area.
(5) Designation of the approximate location
and size of points and ingress/egress.
(6)
Centerline of existing water courses,
drainage features and floodway easements.

(7)
Location and size of existing and proposed
streets and alleys with location of all
street intersections adjacent to the area
of request.
(8) Area map indicating the neighborhood in
which the property is located.
(9)
Screening and landscaping plan shall be
required where such treatment is essential
to the property arrangement of the
development. Such plan, when required,
should include screening walls, ornamental
planting, lawns and gardens, playgrounds
and wooded areas that are to be retained.

The site plan must be presented in an approved
final form to the City twenty-five (25) days
prior to the public hearings before the
Planning and Zoning Commission and the City
Council. No ordinance approving the zoning
shall be approved unless and until the site
plan in approved final form is timely
submitted.

The application for a change in zoning shall
be deemed to be denied as a matter of law upon
the applicant's failure to file a site plan in
an approved final form within the time limits
heretofore set out."
SECTION
That Section 34, "Accessory Uses" of Ordinance No. 480, as
amended, is hereby amended by revising Paragraph y. of Section
34.1 to read as follows:
"y. One temporary construction facility and/or one
temporary sales facility by a Developer, including
manufactured housing, not to exceed 500 square feet per
facility, only during actual construction for a period
not to exceed two (2) years and located on property being
developed."
SECTION 4
That Section 45, "Specific Use Permits" of Ordinance No. 480,
as amended, is hereby amended by revising Paragraph b. of Section
45.6 to read as follows:

"b. No alcoholic beverage use shall be located within
three hundred (300) feet of a church, public school or
public hospital. Such measurement shall be made in
accordance with the requirements set forth in Section
109.33 of the Texas Alcoholic Beverage Code."
SECTION 5
This ordinance shall be cumulative of all provisions of
ordinances of the City of Southlake, Texas, except where the
provisions of this ordinance are in direct conflict with the
provisions of such ordinances, in which event the conflicting
provisions of such ordinances are hereby repealed.
SECTION 6
It is hereby declared to be the intention of the city Council
that the phrases, clauses, sentences, paragraphs and sections of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional

SECTION 7
Any person, firm or corporation who violates, disobeys, omits,
~eglects or refuses to comply with or who resists the enforcement
of any of the provisions of this ordinance shall be fined not more
than Two Thousand Dollars ($2,000.00) for each offense. Each day

that a violation is permitted to exist shall constitute a separate
offense.
SECTION S
Ail rights and remedies of the City of Southlake are expressly
saved as to any and all violations of the provisions of Ordinance
No. 480, as amended, or any other ordinances affecting zoning
regulations which have accrued at the time of the effective date
of this ordinance; and, as to such accrued violations and all
pending litigation, both civil and criminal, whether pending in
court or not, under such ordinances, same shall not be affected by
this ordinance but may be prosecuted until final disposition by the
courts.
SECTION 9
The City Secretary of the city of Southlake is hereby
authorized to publish this ordinance in book or pamphlet form for
general distribution among the public, and the operative provisions
of this ordinance as so published shall be admissible in evidence
in all courts without further proof than the production thereof.
SECTION 10
The City Secretary of the City of Southlake is hereby directed
to publish the proposed ordinance or its caption and penalty
together with a notice setting out the time and place for a public
hearing thereon at least ten (10) days before the second reading
of this ordinance, and if this ordinance provides for the
imposition of any penalty, fine or forfeiture for any violation of
any of its provisions, then the City Secretary shall additionally
publish this ordinance in the official City newspaper one time

within ten days after passage of this ordinance, as required by
Section 3.13 of the Charter of the City of Southlake.
SECTION 11
This ordinance shall be in full force and effect from and
after its passage and publication as required by law, and it is so
ordained.
