THE DUTIES AND QUALIFICATIONS OF ITS MEMBERS
AND THEIR TERM OF OFFICE, PROVIDING FOR THE
APPOINT~FNT OF ITS MEMBERS, THE METHOD OF
FILl. lNG VACANCIES, MAKING STAFF SERVICES
AVAILABLE TO TNB CITY PLANNING AND ZONING
COH}~ISSION, PRESCRIBING POWERS AND DUTIES
OF THE CITY PLANNING AND ZONING COmmISSION,
PROVIDING FOR ADOPTION OF RULES AND REGULA-
TIONS, REPEALING ORDINANCE NO. 203, CREATING
A SODTULAKE CITY PLANNING AND ZONING CO~IS-
SION, AND PROVIDING A SAVINGS CLAUSE.
BE IT ORDAINED BY THE CITY COIINCIL OF THE CITY OF SOUTHLAKE, TEXAS,
THAT:
SECTION I.
There is hereby created and established within the City of Southlake,
Texas, a City Planning and Zoning Commission which shall be snbject
to the jurisdiction of the Southlake City Council. Such City
Planning and Zoning Commission shall be composed of seven (7)
memhers whose o£~ices have been created and established. The
members of the City Planning and Zoning Commission shall be resident
citizens of the corporate limits of the City of Southlake, Texas,
an0 oualified voters of the City of Southlake, Texas. The members
of the City Planning and Zoning Commission shall be appointed by
the City Council. The term of office of said members shall be
three (5) years. All vacancies occurring on the City Planning and
Zoning Commission shall be filled by appointment of the City
Council. The offices of Chairperson, and Vice-Chairperson will
be cot the period of one (1) year. They will be chosen by the
City Council. The Zoning Administrator will Yecord the minutes of
each meeting of the Planning and Zoning Commission and will be
responsible for the records. The Zoning Administrator will have
no vote at the meetings.
SECTION II.
The Planning and Zoning Commission shall receive reports, advice
and available services from the various City Deoartments as re-
quired and as directed by the Mayor, or his designated representa-
tive. When directed by the Mayor, any Department Head or official
of the City of Southlake shall be available to the Planning and
Zoning Commission for advice and consultation, and they shall
cooperate with and render such services for the Planning and
Zoning Commission as shall come within the scope of the duties of
the Mayor.
SECTION III.
The City Planning and Zoning Commission shall have the power and
authority and it shall be its duties:
a). To make studies and project plans for the improvement
of the City of Southlake, with a view of its development and ex-
tension, and to recommend all matters for the development and ad-
vancement of the City facilities, layouts and appearance and to
perform the duties imposed upon the City Planning and Zoning
Commission by the Statutes of the State of Texas.
b). To study and recommend plans of the whole or any portion
of the City of Southlake and of land outside the City limits
within the extraterritorial jurisdiction of the City of Southlake.
c). To aid and assist the Mayor in the procuring of
financial and other aids and assistance for the City from the State
and Federal Government and their agencies for each and all of the
purposes herein ennmerated.
d). To act with ~and assist all other municipal boards,
governmental agencies, regional associations and especially the
City Council in formulating proper plans for municipal development.
e). To plan and recommend the location, plan and extent
of city alleyways, parks, playgrounds, airports, automobile
parking places and other public grounds, and public improvements,
for the location and planning of public buildings, schools and
other properties and of public utilities including bus terminals,
railroad depots and terminals, whether public or privately owned,
for water, lights, sanitation, sewer disposal, drainage, flood
control, transportation, communication and shipping facilities,
and for the removal, relocation, widening, extension, narrowing,
vacating, abandonment or change of use of any of the foregoing
public places, works, buildings, facilities or utilities.
f). To select and recommend routes of streets, avenues
and boulevards and particularly to investigate and recommend
the opening, widening or abandonment of streets, avenues,
boulevards and alleyways, and drainage ways or the changing
thereof to conform to the city's system, present and future, all
streets, avenues, boulevards, alleyways, drainage ways and parks.
g). To investigate, consider and make recommendations about
the layout and plan of any new subdivision to the City of Southlake
on property within the extraterritorial jurisdiction of the City
of Soutblake and to act upon plans, plats or replats of additions,
within the city limits and within the extraterritorial jurisdiction
of the City of Southlake, in a manner described from time to
time by the City Council,
h). To recommend general rules and regulations governing
plats and subdivisions of land within the corporate limits of the
City of Southlake or within the extraterritorial jurisdiction
of the City of Southlake, to promote health, safety, moral and
general welfare of the community, and the safe and orderly
and healthful development of the community.
ii. To recommend plans for improving, developing, expanding
and beautifying the parks, lakes and public buildings in or ad-
jacent to the City and to cooperate with the City Council and other
agencies of the City in advising, establishing, locating, improving,
selecting, expanding and maintaining the public parks, playgrounds
and lakes for public recreation.
j). To aid and assist the City Council by recommending
plans for the development of civic centers and to make investiga-
tions, consider and make recommendations concerning traffic
regulations.
k). To review all zoning regulations and make recommendations
on amendments thereto and to review and make recommendations on
exceptions permitted under Ordinance No. 261. This duty shall not
be construed as the power to grant variances as stated in Article
1011a-lOllj, Civil Statutes.
1). To serve as the Zoning Commission in order that the City
may avail itself of the powers conferred by Article lOIla-lOllj,
and specifically for the City Planning Commission to serve as a
Zoning Commission as states in Article 1011-f~
m). To recommend the boundaries of the various districts
into which the City should be zoned and to recommend appropriate
regulations to be enforced therein. The Planning and Zoning
Commission shall hold public hearings thereon following which it
will submit a report for City Council consideration.
SECTION IV
The City Planning and Zoning Commission shall meet on the second
and fourth Tuesday nights, at 7:30 p.m. in the City Council
Chambers of City Hall, 667 North Carroll Avenue, Southlake, Texas.
Four (4) members of the City Planning and Zoning Commission shall
constitute a quorum for the transaction of business.
SECTION V
Should any member of the City Planning and Zoning Commission be
absent for three (3) consecutive regular meetings, or fail to
attend a total of four (4) regular or special meetings of the
City Planning and Zoning Commission during any three (3) month
period, provided that the City Planning and Zoning Commission had
scheduled four (4) or more meetings during such a three (3) month
period, it shall be the responsibility of the chairperson, or vice-
chairperson, of the City Planning and Zoning Commission to notify
the City Council, through the City Secretary, with a record of said
absences and of any and all circumstances related to the absences.
The City Council shall have sole authority to replace such member
if in their opinion such action is justified.
SECTION VI
All that certain Ordinance No. 54, and No. 203, entitled "An
Ordinance Creating a Planning and Zoning Commission for the Town
of Southlake" is hereby repealed.
In the event of conflict between any provision of this ordinance
and Ordinance No. 160-A and/or Ordinance No. 261 of the City of
Southlake, then, the provisions of Ordinance No. 160-A and/or
Ordinance No. 261 shall prevail.
