Chairman Hudson read aloud the comment cards presented. In support but does not wish to speak: BJ Couch, 2535 Union Church Rd and Tim Welch, project engineer at 1308 Norwood Dr., Suite 200 Bedford. Chairman Hudson opened the public hearing. Joseph and Kimiela Mortazavi of 2651 Union Church Rd. came forward. Mrs. Mortazavi stated that the main concern they have is the drainage followed by the privacy fence. Steve Anderson, Civil Engineer came forward. Mr. Anderson stated that they were aware of the drainage issues of the area. The Mortazavi property drains onto the applicant's property. The applicant's property will need to take the drainage down Union Church. Southlake is currently working with the City of Keller to address the drainage along Union Church and the existing drainage channels. Chairman Hudson asked about the existing storm drain along Union Church. Mr. Anderson stated that the on the Watermere Development there is a large pond that is part of the detention system. Mr. Murway came forward to address the fence. At this time there are no specific plans but is willing to communicate with the neighbors. Chairman Hudson closed the public hearing. Motion to approve ZA13 -046 subject to Concept Plan Review Summary No. 2 dated September 13, 2013 and Staff Report dated September 19, 2013 and the applicant's willingness to meet with the adjacent property owners regarding the fencing. Richard Schell presented ZA13 -060 and ZA13 -061 together. Stephen Coslik with Woodmont Land Company located at 2100 West 7 Street, Fort Worth came forward. Mr. Coslik gave a detailed presentation regarding the elevations of all buildings, landscaping and amenities associated with the project. Peter Jacobson also with Woodmont Land Company assisted Mr. Coslik with the presentation. Chairman Hudson asked about the steps and if they were elevated or if it was a grade change. Mr. Jacobson stated it was a grade change. Chairman Hudson asked about the concrete. Mr. Jacobson stated that it was pavers, stamped concrete and interval colored concrete. Commissioner Forman asked about the actual size of the fountains and stated that City Council will most likely ask for specifics. Mr. Jacobson gave the correct dimensions of the fountains. Commissioner Springer brought up the roof top mechanical systems and that City Council will want to see some screening and how it will be integrated into the current site plans. Commissioner Kubiak asked about tenants and what kind of uses will there be. Mr. Coslik stated that he was unable to give names but the uses will be retail such as sporting goods, a grocery store, and other popular retail along with restaurants and a Yoga /Pilates studio. Commissioner Kubiak clarified that this would be built in one phase and would like to see Planning and Zoning Commission Meeting Minutes — September 19, 2013 Page 4 of 11 that in the motion. Commissioner Forman asked about the screening wall along Zena Rucker Road and the lights that are shown hanging overhead. Mr. Jacobson stated that it is a masonry wall with wrought iron in between. In regards to the hanging lights, they will be limited to the one area and they create a nice atmosphere in the evening. Commissioner McCaskill asked where the lights will be specifically. Mr. Jacobson stated that they would be limited to the area referred to as the living room. Commissioner Parrish asked if the applicant has had any discussion with TXDOT regarding the corner of Carroll Avenue and Southlake Boulevard and the pedestrian walkway and area. Mr. Jacobson stated that based on discussion with Cheryl Taylor regarding this area. The applicant is proposing to put in as much hardscape and landscape as possible in the right - of -way. An application has been submitted to TXDOT to do so. Commissioner Parrish added that the bollards at the corner are a nice addition but believes more will be needed. Chairman Hudson stated to the applicant that what is being presented regarding the amenities is what he would like to see built. Chairman Hudson read aloud the comment card for this item: Phillip Bressinck, 210 Glenrose Court is in support but does not wish to speak. Chairman Hudson opened and closed the public hearing. The Commission discussed back and forth about the new features and the development and how pedestrian friendly it is. The discussion included Mr. Coslik and Mr. Jacobson. Motion to approve subject to Site Plan Review Summary No. 3 and Staff Report dated September 13, 2013 with the following stipulations; 1) The Village area will have integral colored concrete, 2) The large fountain feature at Carroll Avenue and 1709 will be a minimum of 85 -ft. across, 3) The small fountain feature within the Village area will be a minimum of 40 -ft. across, 4) The applicant prior to going to City Council will address the screening on the roofs for the equipment, 5) This will be one phase construction and the entire project must be complete within 120 days of the initial issuance of a certificate of occupancy, 6) The living room area will be the only area that will have overhead strung lights, 7) The applicant will address the safety features along the pedestrian access at the corner of 1709 and Carroll Avenue and ready to report to Council regarding their discussion with TXDOT concerning hardscape into the right -of -way, 8) The architectural features such as custom benches, lighting fixtures and fire pits will be similar to what has been presented, 9) Noting the applicant's willingness to incorporate village Planning and Zoning Commission Meeting Minutes — September 19, 2013 Page 5 of 11 features into the run area buildings 10) Building Tower Road and Zena Rucker Blvd as part of the phasing 11) Improvements needed on Carroll Avenue as part of the phasing, 12) All variances being requested a) Driveway Stacking, b) Driveway Spacing c) Driveway Connections d) Parking Lot Landscape Islands e) Lighting Design. Commissioner Forman recused himself from CP13 -002 and ZA13 -075. Daniel Cortez presented CP13 -002 and ZA13 -075 together. Warren Johnson with Johnson Design Group located at 3221 W Alabama, Houston came forward. Mr. Johnson gave a separate presentation. Commissioner McCaskill asked for clarification of the landscaping. Mr. Johnson explained the landscaping and the elevation more clearly. Mr. Johnson showed the elevator and covered walkway with the focus of the second story being a restaurant instead of retail with outdoor dining. Commissioner Kubiak asked if the applicant was willing to have some cross over and pedestrian access areas. Mr. Johnson agreed. Commissioner Springer asked why the applicant isn't willing to remodel versus the demolition and rebuild. Mr. Johnson stated that the company would like to start from fresh especially with the facade. Chairman Hudson opened and closed the public hearing. Chairman Hudson added that he would like to see 2 of the spaces taken out in the southwest corner. Gary DeVleer with Hodges located at 13642 Omega, Dallas came forward and stated that the removal of the spaces are not a problem. The Commission discussed the facade and building materials and agreed on specifics. David Keener, 575 Southview Trail, Southlake came forward. Mr. Keener gave a separate presentation. This presentation included the site plan, elevations, landscaping and services along with amenities and activities. Keith Katerri, 7309 Vangurard Court, Colleyville came forward to explain the services more in depth. Chairman Hudson asked about when phase 1 will be done. Mr. Katerri stated 6 months. Commissioner Parrish asked about the cottages and access. Mr. Katerri stated independent access per cottage. Commissioner Kubiak asked about the fencing. Chairman Hudson asked about the covered parking and the solar panels and where they will be located.
