AN ORDINANCE PROHIBITING THE SHOOTING,
SELLING, MANUFACTURING AND STORAGE OF
FIREWORKS: DECLARING FIREWORKS A N~IS-
ANCE: PROVIDING INJUNCTIVE RELIEF AND
PENALTY FOR VIOLATION.
Be it Ordained by the City Council of the City
of Southlake, Texas:
SECTION 1. "Fireworks" as such term is used in this Ordin-
ance, is defined to be any rocket, cracker, torpedo, grenade,
Roman candle, gun, revolver, pistol, cartridge or other com-
bustible material used for fireworks purposes. "Business",
as used in this Ordinance, is defined to be any firm, single
proprietorship, partnership, corporation, association, or any
other business entity, regardless of whether such "business"
is operated for profit or for non-profit.
SECTION 2. It shall be unlawful for any person or persons
to cast, throw or fire in any manner, any fireworks of any
description within the corporate limits of the City of South-
lake, Texas.
SECTION 3. It shall be unlawful for any person or persons
or business to exhibit or have in his or its possession, with
intent to sell, offer for sale, or give away, fireworks of
any description within the corporate limits of the City of
Southlake, Texas.
SECTION 4- It shall be unlawful for any person or persons
or business to store or manufacture fireworks of any des-
crOp,ion within the corporate limits of the City of South-
lake, Texas.
SECTION 5. The presence of fireworks of any description
within the corporate limits of the City of Southlake,
Texas, under any circumstance declared ~-nlawful by Section
2, 3, or 4 of this Ordinance is hereby declared to be a
nuisance and appropriate injunctive relief may be insti-
tuted by said City in any court of competent jurisdiction.
Resort to penal complaint in corporation court shall be
be deemed a prerequisite to injunctive relief.
SECTION 6. No person or persons or business shall aid or
assist a minor in any manner in the commission of a violation
of this Ordinance. The commission of a violation of this
Ordinance by a minor on property under the control or owner-
ship of a person or persons, or business, shall be prima
facie proof of such person or persons or business aiding
such minor to violate this Ordinance.
SECTION 7. ~ny person or persons, or business who shall
violate this Ordinance, shall, upon conviction of such
charged violation, be subject to a fine of not less than
$1.00 or more than $100.00 and it is further provided that
in connection with Sections 3 and 4 of this Ordinance, each
day such violation continues shall be considered a separate
violation.
SECTION 8. This Ordinance shall not apply to the possession,
or use of, signaling devices for current daily consumption by
railroads and other means of transportation requiring them;
nor to the possession, sale or use of normal stocks of flash-
light compositions by photographers or dealers in photographic
supplies; nor to the possession or use of flares or rockets
fer military or police or emergency purposes by others.
