. ($10.00) Dollars and other good .and valuable consideration in hand paid by the CITY OF
SOUTHLAKE, home rule municipal corporation of the County of Tarrant, State of Texas,
GRANTEE herein, the receipt and sufficiency of which is hereby acknowledged and confessed, do
hereby grant, sell and convey unto the said GRANTEE a permanent and perpetual easement for the
purpose of installing, repairing, maintaining, altering, replacing, relocating, rebuilding, removing,
and operating Pedestrian facilities in, into, upon, over, across, under and through all that land in
Tarrant County Texas described as follows, to -wit:
A Permanent Pedestrian Easement containing approximately 0.2198 acres through Tract 9, of
Airpark Estates, a subdivision in the T. J. Thompson Survey, Abstract No. 1502, in the City of
Southlake, Tarrant County, Texas, with property address of 1000 S. Peytonville Avenue and as more
particularly described in Exhibit "A ", and shown on Exhibit "B" attached hereto and incorporated
herein.
together with the right of ingress and egress as necessary for such purposes.

GRANTOR covenants and agrees that GRANTOR and GRANTOR's heirs, representatives,
• successors and assigns shall at no time erect, place or construct, or cause to be erected, placed or
constructed in, into, upon, over, across or under any easements granted herein any temporary or
permanent structures, and it is further agreed that GRANTEE shall have the right to excavate and
fill upon said permanent easement and to remove from said permanent easement, any fences,
buildings or other obstructions as may now be found upon said permanent easement.
It is further intended that the Permanent Pedestrian Easement herein granted to the GRANTEE shall
run with the land and forever be a right in and to the land belonging to GRANTOR, and
GRANTOR'S successors and assigns, and said grant is expressly excepted from any right of
reversion of said premises under any prior deeds in GRANTOR's chain of title. The Permanent
PedestrianEasement, rights and privileges granted therein are exclusive, and GRANTOR covenants
that it will not convey any other easement or conflicting rights within the area covered by the grant
to any other person.

PERMANENT PEDESTRIAN EASEMENT
Being a 9,576 square feet tract of land situated in and being a part of Tract 9, Airpark Estates, a
subdivision in the T. J. Thompson Survey, Abstract No. 1502 in the City of Southlake, Tarrant
County, Texas according to the plat recorded in Volume 388 -123, Page 99, Plat Records, of Tarrant
County, Texas, said 9,576 square feet of land being more particularly described by metes and bounds
as follows:
COMMENCING at a 1/2 inch iron rod with a plastic cap stamped "DAA" found in the south line
of said Tract 9 at the northeast corner of Lot 11, Block 6 of Southlake Woods Phase 2 Addition to
the City of Southlake, Tarrant County, Texas according to the plat recorded in Cabinet A, Slide
5943, Plat Records of Tarrant County, Texas;
THENCE N 89 Degrees 03 Minutes 25 Seconds E, 5.88 feet along the south line of Tract 9 to the
POINT of BEGINNING of the tract herein described;
THENCE N 00 Degrees 59 Minutes 26 Seconds W, a distance of 256.05 feet to the north line of said
Tract 9;
THENCE S 89 Degrees 43 Minutes 50 Seconds E, along the north line of said Tract, a distance of
36.39 feet to the northeast corner of said tract in South Peytonville Avenue;
THENCE S 01 Degrees 28 Minutes 25 Seconds E, along the east line of said tract, in said Avenue,
a distance of 255.29 feet to the southeast corner of said tract;
THENCE S 89 Degrees 03 Minutes 25 Seconds W, along the south line of said tract, a distance of
