ORDINANCE PRESCRIBING RATES FOR CITY'S
WATERWORKS SYSTEM

Council of the City of Southlake, Texas, convened in special session at the
regular meeting place thereof in the City Hall, there being present and
in attendance the following members, to-wit:

AND THE following absent: W. H. CRUMBAKER
constituting a quorum; and among other proceedings had by said City Council
were the following:
Mayor PAUL SCHELL presented for the consideration
of the City Council an ordinance prescribing rates for the City's Waterworks
System. The ordinance was read in full.
Alderman J. J. CARLILE made a motion that any rule requiring
ordinances to be read at more than one meeting be suspended. The motion was
seconded by Alderman J. L. CLOW and carried by the following
vote:
AYES: Alderman T.Tilliams, Cate, Carlile and Clow
NOES: None
Alderman J. J. CARLILE made a motion that the ordinance be
passed finally. The motion was seconded by Alderman J L CLOT?
and carried by the following vote:
AYES: Aldermen Williams, Cate, Carlile and Clow
NOES: None
The ORDINANCE is as follows:
"AN ORDINANCE by the City Council of the City of Southlake,
Texas, prescribing the rates to be charged for services
furnished by the Waterworks System owned and operated
by said City; repealing all ordinances, orders or resolutions in
conflict, and declaring an Emergency. "
WHEREAS, heretofore, to-wit: on the 22nd day of 1NfaM
1965, an election was duly held for the purpose and and a majority of the
resident qualified electors of said City awned taxable property in said City and who
had duly rendered the same for taxation voting at said election authorized the
issuance of $350, 000. 00 Revenue Bonds for the purpose of constructing improve-
ments and extensions to the City's Waterworks System; and
WHEREAS, thereafter, to-wit: on the _ Y2 b day of _Oc.t
1965, by ordinance duly passed and adopted, the City Council of said City
authorized the issuance of $350, 000. 00 Revenue Bonds under authority of
Article 1111 et seq. , Texas Revised Civil Statutes of 1925, an amended,
being--
"AN ORDINANCE by the City Council of the City of Southlake,
Texas, authorizing the issuance of $350. 000. 00 'CITY OF
SOUTHLAKE, TEXAS, WATERWORKS REVENUE BONDS
SERIES 1965' dated August 1, 1965, being for the purpose of
constructing improvements and extensions to the City's Waterworks
System, as authorized by the General Laws of the State of Texas,
particularly Articles 1111 et seq. , Revised Covil Statutes of
Texas, 1925, as amended; prescribing the form of the Bonds and
the form of the interest coupons; pledging the revenues of the
City's combined Waterworks System, after deduction of rea-
sonable operation and maintenance expense as said expenses are
defined by statute to the payment of the principal of and interest
on said Bonds; enacting provisions incident and relating to the
subject and purposes of this ordinance; and declaring an
emergency. "
SECTION 1: That the monthly rates or charges for services
furnished by the Waterworks System shall be as follows:
RATE SCHEDULE: The monthly rate schedule for all customers
is as follows:
First 3, 000 Gallons $6. 50 per .minimum bill
Next 3, 000 gallons 0. 90 per 1, 000 gallons
Next 4, 000 gallons 0. 80 per 1, 000 gallons
Next 4, 000 gallons 0.70 per 1, 000 gallons
All a. _vve 14, 000 gallons 0. 45 per 1, 000 gallons
Tapping Fee - Not less than actual cost to the City.
SECTION 2:That such rates and charges hereby fixed and pre-
scribed shall be paid by the users of the Waterworks System to the City
Secretary of the City of Southlake, Texas, in advance of the 10th day of
each month which 10th day of each month shall be the date that such rates
or charges shall become due and payable, but in no event shall any charges be
be made for the use of waterworks facilities until such time as the same are
placed in operation by the City.
SECTION 3. When the waterworks facilities being constructed or
acquired by the City with a portion of the proceeds of the aforementioned Bonds
has been placed in operation, the City shall thereafter simultaneously collect
thea.mount due to the City for services supplied by the water system and
shall refuse to accept payment for a part of such service unless the entire
amount due from the respective customer for all services supplied by such
system is paid.
SECTION 4: That in the event payment is not.made for the service
supplied any user or customer of the City's Waterworks System 4Rk-plaQ.erl
Wskyst~.m within fifteen (15) days from the date that the same be-
comes due and payable, it shall be the duty of the City Secretary to add a
ten per cent (101o) penalty to the amount past due and unpaid.
