EXECUTIVE SESSION: If a need arises to seek the advice from the City Attorney as to the posted
subject matter of this Zoning Board of Adjustment meeting, the issues or matters will be discussed in

Pursuant to Section 551.071, Texas Government Code, the Board may meet in executive session to
consult with the City Attorney regarding matters authorized by Section 551.071, including matters
posted on this agenda.

4. Consider: ZBA-646, Variance to Ordinance No. 480, Section 14.5(b), requiring a front yard
setback of 35', a Variance to Ordinance No. 480, Section 14.5(d), requiring a rear yard setback of
40' and a Variance to Ordinance No. 480, Section 33.14, requiring a minimum lot size of one acre
for the use of an on-site sewage facility (OSSF). The request is being made by the applicant,
Robert and Sarah Keepers, for property described as Lot 2R, Block 4, Southlake Park Addition, an
addition to the City of Southlake, Tarrant County, Texas and located at 455 Southlake Park Rd. E.,
Southlake, Texas. The current zoning is SF -20B — Single Family Residential District.

Agenda Item No. 1 — Call to Order: Chair Venesky called the meeting to order at 6:30 p.m.
Agenda Item No. 2 — Approval of the Minutes: Chair Venesky opened the discussion of the
minutes of the Zoning Board of Adjustment meeting held on July 25, 2013.
A motion was made to approve the corrected minutes of the Zoning Board of Adjustment
meeting held on July 25, 2013.

Agenda Item No. 3 — Administrative Comments: Richard Schell, Planner II, announced that
there are no submittals for the next regularly scheduled ZBA meeting on August 29, 2013 and
one submittal for the September 12, 2013 meeting. Planner Schell requested that the Board
members note the meeting date on their calendars.
Agenda Item No. 4 — ZBA -646, Variance to Front and Rear Setbacks and Minimum Lot
Size for OSSR: Variance to Ordinance No. 480, Section 14.5(b), requiring a front yard setback
of 35', a Variance to Ordinance No. 480, Section 14.5(d), requiring a rear yard setback of 40',
and a Variance to Ordinance No. 480, Section 33.14, requiring a minimum lot size for the use of
an on -site sewage facility (OSSF). The request is being made by the applicant, Robert and
Sarah Keepers, for property described as Lot 2R, Block 4, Southlake Park Addition, an addition
to the City of Southlake, Tarrant County, Texas and located at 455 Southlake Park Rd,
Southlake, Texas. The current zoning is SF -20B — Single Family Residential District.

Planner Schell presented the case to the Board, stating that the applicant is requesting approval
of a Variance to Ordinance No. 480, Section 14.5(b), requiring a front yard setback of 35', a
Variance to Ordinance No. 480, Section 14.5(d), requiring a rear yard setback of 40' to allow a
new home to be constructed approximately 15' from the front and rear property lines. The
applicant is also requesting approval of a Variance to Ordinance No. 480, Section 33.14,
requiring a minimum lot size of one acre to the use of an on -site sewage facility (OSSF) to allow
an OSSF on a lot that is approximately 38,800 square feet (0.89 acres). Planner Schell was
available to answer questions of the Board.
Chair Venesky opened the public hearing and called upon the applicant or the applicant's
representative to make such comments and present evidence as the applicant should desire.
Robert Keeper, 455 Southlake Park Rd., Southlake, TX, the applicant and owner of the
property, once sworn in, presented testimony and was available to answer questions of the
Board.
Once the applicant completed his presentation, Chair Venesky asked if there were those in the
audience who wished to speak in favor of the request.
David Butler, 3108 Southlake Park Rd., Southlake, TX, spoke in favor of the request.
Chair Venesky asked if there were those in the audience who wished to speak in opposition of
the request.
There being no one, Chair Venesky closed the public hearing and opened the item for
discussion.
A motion was made to approve case ZBA -646 section (1) the front (North) setback Variance
and section (3) the OSSF Variance.

A motion was made to approve case ZBA -646 section (2) the Variance to the rear yard
setbacks with a conditions: (a) requiring full, dense, year round visual coverage of the rear
(Southside) of the property and (b) approval of the plan by the City's Landscape Administrator
prior to issuance of a building permit.
