Christopher Homes is requesting approval of a Zoning Change and Concept Plan on property described as Tracts 2C11, 2C12 and 2C13, W. Martin Survey, Abstract No. 1068, City of Southlake, Tarrant County, Texas and located at 1833, 1847 and 1851 Our Ln., Southlake, TX. The current zoning is "AG" Agriculture District. The requested zoning is "SF-1K Single Family Residential District. Spin Neighborhood # 5. REQUEST: The applicant is requesting approval of a Zoning Change and Concept Plan from "AG Agricultural District to "SF-1K Single Family Residential District to allow construction of a new home on the property. Two concept plan options, Option A and Option B, have been submitted (see pages 2 and 3 of Attachment C). The applicant is requesting approval of both options to allow the location of the garage, either on the right side or on the left side of the house, to be determined at a later date. An application for a one - lot plat showing, which can be administratively approved, has also been submitted. The applicant is designing the driveway entrance from Our Ln. as a turnaround for fire and other emergency equipment (see exhibit on page 4 of Attachment C). The Fire Department has included a comment that an additional turnaround interior to the property will also be required if fire apparatus access is required farther than 150 feet from Our Ln. The additional turnaround, if required, will be approved as part of the building permit approval. City sewer is not available to the property, so the property is intended to be served by a private septic system that will require approval by the Tarrant County Health Department. The applicant will install an 8" water line from Randol Mill Ave. to the southwest corner of the property. A proposed fire hydrant is also shown on both the Option A and Option B Concept plans. VARIANCE REQUESTED: A variance to Subdivision Ord. No. 483, Section 8.01(A), which requires that all lots front on a public or private street, is requested. Our Lane is currently a private street that doesn't meet the Subdivision Ordinance requirements in Section 5.04 and 5.05 regarding private streets. The applicant is requesting a variance to allow the lot to front on Our Lane as it currently exists and has submitted a letter agreeing to the conditions that have been placed on other lots that have been approved on Our Lane, which are as follows: Case No. ZA13-043 ACTION NEEDED: ATTACHMENTS: STAFF CONTACT: a. The request to change the zoning to "SF-1A" Single Family Residential District is consistent with this land use designation. PATHWAYS MASTER PLAN: The subject property is exempt from the sidewalk requirement because sidewalks do not exist on both sides of the lot and the lot is not located within 1500' of a public or private school on the same side of the street. WATER & SEWER: This site is currently serviced by a 2" water line along Our Lane. City sewer is not available, so the sites will be served by a private septic system. DRAINAGE COMMENTS: Drainage is from east to west on the eastern portion of the lot and from south to north on the western portion of the lot where the new home is proposed. A grading plan will be required prior to issuance of a building permit. TREE PRESERVATION: Eight (8) existing trees are proposed to be removed on the Option "A" plan and five (5) existing trees are proposed to be removed on the Option "B" plan. Easements shall be dedicated by plat. Provide all necessary easements for water, sanitary sewer and drainage. Easements shall be 15- foot minimum and located on one lot — not centered on the property line. A 20-foot easement is required if both storm sewer and sanitary sewer will be located within the easement. Water and sewer lines shall not cross property lines without being in a public easement or in the right-of-way. Construction of the water line shall be required prior to issuing building permits. Water services shall not cross lot lines. Water meters shall be located in an easement or in the right-of-way. Contours may be obtained from the City of Southlake. The discharge of post development runoff must have no adverse impact on downstream properties and meet the provisions of Ordinance # 605. Driveway culverts must be sized by an engineer and submitted for approval to the City Engineer. An 18-inch minimum concrete culvert is required. Fire apparatus access needs to be an all-weather surface, asphalt or concrete, a minimum of 10 feet wide and able to support the imposed loads of fire apparatus. (A minimum of 80,000 pounds GVW) If fire apparatus access is required farther than 150 feet from Our Ln., an approved turn -around must be provided for fire apparatus. This approved turn -around must be placed at a point where the apparatus will not be required to back-up more than 150 feet to turn around and exit the property. FIRE HYDRANT COMMENTS: The residence must be located within 1000 feet of a fire hydrant, measured as the hose would be laid. A fire hydrant exist on Randol Mill Ave. within 1000 feet of the property and a fire hydrant is proposed at the end of the 8" water line to be installed by the property owner. Approval of the zoning change and concept plan is subject to approval of a one -lot plat showing (ZA13-044) that creates a lot meeting the minimum one acre minimum lot size in the SF-1A zoning district. All lighting must comply with the Lighting Ordinance No. 693, as amended. I disapprove of the rezoning ZA13-043 because I see no turn around or hammer head for emergency vehicular. Where will the burden of cost go if one is required now or in the future? 2. I do not see or understand where an 8" water main is being looped around to Randol Mill! And who is responsible for the cost. 3. Are the owners of each property responsible for the cost of improvements, amenities or maintenance on Our Ln. and is that based on the amount of property or frontage they own! That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and affirmed. SECTION 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to provide adequate light and air; to prevent over -crowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and surface water, parks and other commercial needs and development of the community. They have been made after a full and complete hearing with reasonable consideration among other things of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 5. That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Case No. Attachment F ZA13-043 Page 5 Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract or tracts of land described herein. SECTION 7. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9. The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance in its entirety on the City website together with a notice setting out the time and place for Case No. Attachment F ZA13-043 Page 6 a public hearing thereon at least ten (10) days before the second reading of this ordinance, and it this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. SECTION 10. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained.
