Mr. Blake gave a brief presentation to the Commission showing elevations and
landscaping.
Commission Springer asked about the color of the brick.
Mr. Blake stated that the brick will be painted a light gray and the trim will be either a
cast stone or lime stone color.

"C -3" General Commercial District. SPIN Neighborhood #8.
Daniel Cortez, Planner II presented ZA13 -065.
Commissioner Kubiak asked if the site plan presented meets the criteria of the urban
design plan.
Daniel Cortez stated that it is fairly consistent with the exception of 2 particular areas: 1)
the 1 -2 ft. height knee walls; on the west elevations, the windows are vertically articulated
but the knee walls are not present, and 2) the surface parking.
Commissioner Springer asked about the utility poles located along Carroll Avenue.
Daniel Cortez stated that the applicant will need to address that.
Evan Beatty with Good Fulton & Farrell Architects located at 2808 Fairmount, Suite 300,
Dallas came forward. Mr. Beatty stated that in regards to surface parking, after meeting
with Council members, it was suggested the extra green space be moved to the east side
in order to save more trees.
Commissioner Smith asked about the color scheme for Chuy's.
Mr. Beatty stated that the normal branding for Chuy's is the kiche type design that makes
the look of the building older and loud colors. However, Chuy's is willing to scale that down

in order to come to Southlake.
Commissioner Kubiak stated that he expected a more pedestrian type atmosphere that
would tie into Town Square.
Mr. Beatty explained that the corner of SH 114 and Carroll Avenue has more motor traffic
than pedestrian traffic. With the buildings set back further, it brings the traffic into the
shopping and allows for more tree preservation. Mr. Beatty believes that due to the
location, more people will be inclined to drive to the area versus walk to the area. Also due
to parking regulations for the 60% restaurant use, we are able to exceed the required
parking without sacrificing the landscaping and again preserve more trees.
Commissioner Kubiak expressed that he would like to see a more pedestrian friendly
atmosphere and possibly connecting to Patrizzio's. Commissioner Kubiak also questioned
the driveway and traffic concems that have come up regarding Carroll Avenue and
clarified if the drive shown is 1 lane.
Mr. Beatty stated that a traffic study had been done. The study shows a 50 -ft. stacking with
all the drives that are presented on the site plan. The drive shown is a 24 -ft. 1 lane in and
out.
Commissioner Smith is concerned about their only being one lane and traffic backing up in
the parking lot and questioned whether an additional lane could be added.
Mr. Beatty stated that was possible.
Commissioner Springer asked about the patio.
Mr. Beatty stated that with the tree coverage he believes that the patio will be used
frequently.
Vice Chairman Parrish asked about having a single larger drive entry off of Carroll Avenue
instead of having a drive A and a drive B.
Mr. Beatty stated that there is a median break for drive B, but all traffic studies have been
done with 2 drives in consideration.
Vice Chairman Parrish asked about the utility poles and lines.
Mr. Beatty stated that there are no plans at this time for them.
Vice Chairman Parrish asked about the renderings that are facing Carroll Avenue. He
believes that the development looks more like a strip center and would like to see it more
broken up.
Mr. Beatty pointed out the break between the buildings and believes that the architecture
is accurate for the area.

Vice Chairman Parrish continued that the parking field is over parked by 80 spots, there
seems to be some maneuverability to break up the parking some and preserving even
more trees. Commissioner Kubiak echoed his concems and would like to see something
more consistent with the 2030 Plan that was laid out conceptually.
Mr. Beatty stated that the parking shown is based on an assumption and /or guess of
seating per restaurant site with 60% of spaces being restaurant. At time of permitting with
seats determined exactly, the parking can be scaled down accordingly.
Commissioner Kubiak asked if they anticipated the restaurant tenants exceeding 60 %.
Mr. Beatty stated no. The interest has been diverse and generally if your tenant base is
greater than 60 %, you run the risk of too much peak demand around lunch and dinner.
Most healthy developments will not go beyond 60 %. Also, something that has been
discussed that is not on these plans is the addition of tree diamonds in the parking field
which would give more tree cover without losing parking spaces. This would have given a
green median in the middle that would have broken up the buildings.
Commissioner Springer added that the existing trees are substantial and would be nice to
be able to reserve them.
Vice Chairman Parrish opened the public hearing.
Victor Awtry, 775 Lakewood Drive, came forward. Mr. Awtry stated that he is the SPIN
chairman for this area. Traffic is a large concern. Drive B is lined up with Lakewood Drive.
Just today traffic was backed up to DPS leaving Carroll Avenue to SH 114. Mr. Awtry
handed out a petition expressing concerns and signed by the residents and businesses
surrounding this development. One suggestion is to add lights along Carroll Avenue to aid
in helping residents exit the adjacent neighborhoods.
Cheryl Taylor, City Engineer stated that the FY2014 enhancement plan is to extend State
Street to Federal Way from SH 114 into Town Square.
Susan Stanek, 800 Lakewood Drive, came forward. Ms. Stanek stated that the properties
within Lakewood are 3 acre properties with horses and trailers. It is already difficult to get
out of the neighborhood and would be even worse if the median was shut down. Drive B
seems to be the most applicable but with a right out only.
Nancy Searl, 775 Bent Wood Lane, came forward. Ms. Searl stated that traffic on Carroll
Avenue is bad now especially at 4pm to 5pm, north bound to access SH 114. The traffic is
usually backed up past DPS blocking the neighborhoods.
Paul Venesky, 403 Wickham Lane, came forward. Mr. Vanesky expressed concern with
the layout of the development and agrees with Vice Chairman's impression with it.
Vice Chairman Parrish closed the public hearing and asked the applicant to come forward
to address the comments made.

Larry Survanka, Traffic Engineer came forward. Mr. Survanka stated that the traffic spill
out is divided by 4 driveways and then continued to explain the traffic survey that was
presented.
Vice Chairman Parrish mentioned to Mr. Survanka that the City had done a traffic study as
well that became available this evening. Parrish believes that the report needs to be
shared and compared with their study in order to assist with traffic.
Commissioner Springer and Vice Chairman stated that Saturday evening needs to be
accounted for due to Gateway Church traffic getting out after service.
Commissioner Springer asked about the band along Building B (Option B) and whether or
not it met City Ordinances.
Mr. Beatty explained that it was a cornice, a metal box with acrylic. The squirrelly lines that
are seen in the background are a yellow acrylic that will be lit up.
Vice Chairman Parrish stated that he has concerns about this project ranging from the
traffic, the driveways, layout of the buildings and the utility poles.
Commissioner Kubiak agreed and added that this was designated as part of Town Square
with a pedestrian atmosphere.
Commissioner McCaskill added that all of these issues can be addressed and resolved
and suggested that the applicant table this item until then.
Commissioner Springer stated that he preferred that the first row of parking spaces should
go away in order to leave the trees and keep the natural buffer. He also addressed the
materials and improving the look of the buildings.
Commissioner Smith agreed with all points.

Zoning Commission Meeting.

Agenda Item 14 - ZA13 -072, Site Plan for Southlake Storage on property being
described as Lot 5B, Brumlow Industrial District Phase 11, an addition to the City of
Southlake, Tarrant County, Texas, located at 1928 Brumlow Avenue, Southlake Texas.
The current zoning is "1 -1" Light Industrial District. SPIN Neighborhood #9.

Pamela Holt, 1225 Stanhope Court, Southlake came forward. Mrs. Holt stated that this is
the final expansion for Southlake Storage.
Vice Chairman Parrish asked about the lighting on the west side facing the neighborhood.
Mrs. Holts stated that the facility will use LED lighting required by the City Ordinance with a
down cast. Also, this property does not allow access after 10pm. Mrs. Holt continued to
stated that the buildings are lower than allowed, they are painted earth tones with a green
roof in order to blend in with the natural surroundings and noise is kept to a minimum.
Commissioner Kubiak asked what the official hours of operation were and what are the
peak hours?
Mrs. Holt stated 7am to 10pm. The peak hours are generally in the moming due to
contractors.
Commissioner Springer asked why the pond is being drained.
Mrs. Holt stated that it is for safety reasons.
Commissioner Springer asked about the lighting and the possibility of pole lights.
Mrs. Holt stated that there will not be any pole lights.
Commissioner Smith asked about traffic with customers.
Mrs. Holt stated that at any given time they have 3 customers on site and that is primarily
in the morning. With the expansion, that number may double to 6.
Vice Chairman Parrish opened the public hearing.
Craig Rothmeier, 803 Shadow Glen Drive, Southlake came forward. Mr. Rothmeier stated
that he did live on Chadwick Crossing in Colleyville which backs up to this facility. The
homeowners that currently live on Chadwick Crossing had 3 concerns which have all been
addressed by the Southlake staff and the applicant.
Debbie Fernandez, 1727 Byron Nelson Parkway, Colleyville. Mrs. Fernandez asked that
the fencing that boarders the neighborhood be 8 -ft. instead of 6 -ft. All other issues have
been addressed.
Vice Chairman Parrish closed the public hearing and asked the applicant to come forward.
Mrs. Holt addressed the fence and agreed to the 8 -ft. fence.
Justin Landes, with JD Landes at 1107 E 1 Street in Fort Worth. The pond came from
using land fill creating the pond which does catch the run off from the site. However, it will
become a dry pond. Any run off received releases into Bear Creek through a series of

Motion to approve ZA13 -072 subject to Site Plan Review Summary No. 2 and Staff
Report dated August 7, 2013 with variances 1) Pitched Roof: The Overlay Section 43 of
the Zoning Ordinance requires for buildings within 400 -feet of residentially zoned
properties or that have a residential land use designation to the pitched roof if they are
less than 6,000 square feet., 2) Building Articulation: The Overlay Section 43 of the
Zoning Ordinance requires for buildings within 400 -feet of residentially zoned properties
or that have a residential land use designation to have articulated facades., 3) Driveway
Spacing: The Driveway Ordinance No. 634 requires there to be a minimum driveway
centerline spacing distance of 250 -feet along an arterial street., 4) Driveway Stacking
Depth: The Driveway Ordinance No. 634 requires there to be a minimum of 28 -feet of
stacking depth from Brumlow Avenue., 5) Bufferyards: a) Zoning Ordinance No. 480.
Section 42, as amended requires a 5 -foot type 'A' bufferyard along the south boundary
identified as S1, the north boundary identified as N1 and the east boundary identified as
E3. The applicant has withdrawn their request for Variance 5.b and is willing to build an

Southlake came forward and presented the Garden District. Mr. Corson explained the
concept plan along with the Brownstones and Lofts.
Vice Chairman Parrish asked about the pricing for the residence.
Mr. Corson stated that the starting price will be $300.00 per square foot.
Commissioner McCaskill verified that the residence will be a 5 - story building. The limit

is 3 - story which is the reason for the special use permit.
Mr. Corson stated that only applies in the Garden District and Overlay District. It does
not apply in the Downtown District. The only limitation is height.
Commissioner Kubiak asked how tall the residence will be compared to the parking
garage.
Mr. Corson stated that the residence building will be 12 -ft higher.
Vice Chairman Parrish verified that the top floor is amenities only.
Mr. Corson stated that the 1 floor will be lobby, 2 floor will be used for climate control
storage, 3 and 4 floor will be residences and the 5 floor will be an exercise facility
with a separate yoga /pilates room. The roof top will serve as a community terrace.
Commissioner Kubiak asked about the lease price.
Mr. Corson stated $2.00 to $2.25 per square foot.
Commissioner Smith asked what the plan was for transitioning from lease to own.
Mr. Corson explained condominium construction and financing. Based on that
information, all residences will be rented out and then at some point start selling but with
no timeline. The ultimate goal is to sell all of the residences in the end.
Commissioner Smith asked for more explanation as to why not sell the residences up
front.
Mr. Corson stated that it is difficult to get financing for such a development on each unit.
It is easier to finance the entire building, then sell, lease and /or rent each unit.
Commissioner Smith expressed concern in the 25% sold for construction.
Commissioner Smith would like to see that number higher.
Commissioner Springer is concerned that if the Brownstones can't be sold, that those
will also go on the market for rent.
Mr. Corson stated that was not the intent.
Vice Chairman Parrish opened the public hearing.
Mark Biersmith, 1589 Main Street, Southlake came forward. Mr. Biersmith is in support
of this development. However, there is a problem with the Home Depot deliveries with
noise and time of deliveries.
Valentino Cardillo and Shawn Cardillo, 1560 Main Street, Southlake came forward. Mr.
& Mrs. Cardillo gave a presentation in opposition of this development due to safety,

traffic and property value. Mrs. Cardillo suggested a co -op versus renting.
Joseph Schirle, 1512 Main Street, Southlake came forward. Mr. Schirle's requests are
to clean up the field currently known as the Garden District if construction does not start
within 12 months, individual owners, not a corporation, Brownstones to have 4 story
residence and the Condominium be restricted to 4 story residence.
Lisa Alexander, 1562 Main Street, Southlake came forward. Ms. Alexander is happy
with the development. Her only concern is the speed of the traffic. Would like to see
some speed humps put down to help with traffic.
Ryan Smith, 1532 Main Street, Southlake came forward. Mr. Smith agrees with Ms.
Alexander.
Vice Chairman Parrish closed the public hearing and asked the applicant to come
forward.
Mr. Corson addressed all issues that were mentioned. Mr. Corson is in agreement
regarding Home Depot and traffic humps and will work with City Staff to address those
issues. Regarding a co -op, there are no state regulations within the State of Texas so
that is not an option for this development.
Commissioner Smith and Commissioner Kubiak like the concept plan as presented.
However, they both would like to see speed humps added into the motion along with
landscaping the area if construction doesn't start. Commissioner McCaskill and
Commissioner Springer agreed.
Dennis Killough stated that those items can be part of the motion.
Motion to approve ZA13 -011, subject to Revised Concept Plan Review Summary No. 4
and Staff Report dated August 8, 2013 with variance to Section 37.6(a) of Zoning
Ordinance No. 480, as amended, limits the height of residential buildings in the Garden
District to three stories and fifty -two feet in height and include the applicant's willingness
to work with Staff to have a traffic calming devise included along Summit Avenue and
the applicant's willingness to landscape and irrigate the property north of Main if
construction does not begin within 12 months.

Commissioner Kubiak believes that the lease to own process will correct itself based on
the testimony of current owners and the speed that the Brownstones move.
Commissioner Springer and Commissioner Smith disagree. The disagreement is not
based on whether or not the property moves. It comes down to pride of ownership. The
concept is good along with the placement. If the banks are not willing to take a risk why
would we. Commissioner McCaskill is in agreement.
Mr. Corson stated that Cooper and Stebbins have too much invested money and time
into Town Square to bring in something that would fail. Mr. Corson continued to state
that Cooper and Stebbins already have families and people lined up with deposits for
this development.
Frank Bliss stated that for financing reasons, it is easier to build and lease /rent then sell
later.
Mr. Corson stated that the percentage and phasing is flexible.
Vice Chairman Parrish stated he believes raising the percentage is good and can be
made part of the motion. This assessment is based on the HOA comments and support.
Commissioner Smith stated that she could support that but would like to see more
information on the transition from rental to purchase. Commissioner Smith is suggesting
