Paul Ward, Buikting Official, descri bed thc difference in thc lights and clarified the variance requcst. Malcohn Jackson, · (2 hmf of Building Services, discussed thc history behind thc Ordinance and this application for a variance, lie stated the original lights at this site were white and explained the effort of thc Applicanl to comply with the Ordinance. ('hainnan Murphy called for discussion from the Commissioners. Commissioner Muller stated that she felt the Applicant was lcd to believe that he was working with Stafi'm complying with the Ordinance and that she supported the requested variance for lighting for this reason and not tbr thc issue of thc color of the building. Malcohn Jackson further explained the circulnstances that lcd to this variance request and stated that if the Applicant had not elected to install new light poles that the original white lights, which were chosen to compliment the color of the huilding, would have been allowed. Commissioner Terrcll stated his concern for future development and thc conformance of the lighting with the Ordinance. If this was strictly an issue of color he would not be in favor, however, he agrees with Commissioner Muller that the Applicant was lcd to believe he was working with Staff to comply with thc Ordinance and that thc circumstances warrant this variance request. Furthermore, he stated for the record that his decision should not lead furore developers to believe that they can request a xariancc for lighting based on the color of their building. The Commission held lengthy discussion regarding the issue of the articulation of buildings 'A', 'A- l' and 'B'. They also discussed the variance requests regarding the driveways for stacking and spacing. Thc Commissioners agreed that there were insufficient hardships to warrant the exemption in articulation regulations us requested, however, would address that issue further m the next item ZA01-122, Site Plan. The question arosc as to how many truck deliveries would be made during the week in an effort to ensure safety in consideration of driveway variance requests. Bob .llooncT, Carler&Burgexs. responded that typically two to three deliveries would be made to Ultimate Electronics weekly. Commissioner Muller stated since there was an existing sidewalk to thc cast along FM 1709 (fronting thc dry cleaners, etc.) that she would like to see that sidewalk continued along the front of this prupcrty. Staff responded that the sidewalk is only required by the Master Trail Plan along the north side of FMIT09. ,]c~[f' lYang, SPIN # 7 r~79rcxentative, 595 S. Kimball, Southlake, TX clarified the sidewalk issue stating that the sidewalk in place was different in that it was only four feet wide and did not meet the specit'ications of thc Trail Plan. Hc said it was not required.., it was just put in voluntary and perhaps it was installed due to extra concrete that was available. She stated that thc south and west sides of buildings 'A- 1' and 'A' needed to look nice. She was also concerned about the Land Usc Plan showing residential adjacency and asked why it was not being considered due to being located in the airport overlay zone. She said she would like to see nice articulation from every angle seen from Nolen Drive and FM1709.
