Chair Venesky adjourned the work session at 6:00 p.m. Regular Session: Location: Town Hall Council Chambers 1400 Main Street, Southlake, Texas Members Present: Chair Paul Venesky, Vice -Chair John Huffman, Board members Kourosh Panahy, Ron Evans, Paul Lepicier, Eric Ransom and Mike Smietana Members Absent: Board members Scott Dyche and Bradford Cunningham Staff Present: Dennis Killough, Deputy Director of Planning & Development Services; Richard Schell, Planner II and Stacey Buller, Board Secretary Agenda Item No. 1 — Call to Order: Chair Venesky called the meeting to order at 6:30 p.m. Agenda Item No. 2 — Approval of the Minutes: Chair Venesky opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on May 16, 2013. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on May 16, 2013. Motion: Huffman Second: Panahy Ayes: Panahy, Lepicier, Evans, Ransom, Smietana, Huffman, Venesky Nays: None Abstain: None Vote: 7 -0 -0 Zoning Boaid of Adjustment Meeting Minutes — June 27, 2013 Page 1 of 6 Motion: Carried Agenda Item No. 3 — Administrative Comments: Richard Schell, Planner II, welcomed the newly appointed members to the Board and announced that Paul Venesky has been appointed Chair and John Huffman has been appointed Vice - Chair. Planner Schell announced that there were no submittals for the next regularly scheduled ZBA meeting on July 11, 2013, but that one case on the agenda has requested to table to that meeting. Planner Schell then announced that there was one submittal for the July 25, 2013 meeting, and requested that the Board members to note those meeting dates on their calendars. Agenda Item No. 4 — ZBA -639, Variance to side and rear setbacks: Variance to Ordinance No. 480, Section 11.5(c), requiring a side yard setback of 20' and a Variance to Ordinance No. 480, Section 11.5(d), requiring a rear yard setback of 40'. The request is being made by the applicant, Doug and Kristin Jones, for property described as Lot 15, Block 1, Loch Meadow Estates, an addition to the City of Southlake, Tarrant County, Texas and located at 3056 Loch Meadow Ct., Southlake, Texas. The current zoning is SF -1A — Single Family Residential District. Chair Venesky stated that the applicant has requested to table the case to the July 11, 2013 meeting and called for a motion. A motion was made to table case ZBA -639 to the July 11, 2013 meeting. Variance to front and side setbacks: Variance to Ordinance No. 480, Section 13.5(b), requiring a front yard setback of 35' and a Variance to Ordinance No. 480, Section 13.5(c), requiring a side yard setback of 20'. The request is being made by the applicant, Tod and Sandra Radford, for property described as Lot 1, Block 1, Harrell Place, an addition to the City of Southlake, Tarrant County, Texas and located at 3155 Johnson Rd., Southlake, Texas, The current zoning is SF -30 — Single Family Residential District. Planner Schell presented the case to the Board, stating that the request is to allow the construction of a new home on the property with a front yard setback of 15' and a side yard setback of 15' as is shown on the plot plan and elevations. The front building lines on the plot plan and recorded plat are shown at 40'. The SF -30 zoning district regulations require front setbacks of 35'. Planner Schell was available to answer questions of the Board. Chair Venesky opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Tod Radford, 3185 Johnson Rd. Southlake, Texas, once sworn in, presented additional information and was available to answer questions of the Board. There being no one, Chair Venesky asked if there were those in the audience who wished to speak in opposition to the request. There being no one, Chair Venesky closed the public hearing and opened the item for discussion. Mr. Radford, still under oath, was available to answer additional questions of the Board. A motion was made to approve Agenda Item No. 5, case No. ZBA -640. Motion: Huffman Second: Evans Ayes: Lepicier, Huffman, Panahy, Evans and Venesky Nays: None Abstain: None Vote: 5 -0 -0 Motion: Carried Agenda Item No. 6 — ZBA -641, Variance to rear setback: Variance to Ordinance No. 480, Section 14.5(d), requiring a rear yard setback of 35'. The request is being made by the applicant, Standard Pacific Homes, for property described as Lot 13, Block 1, Shady Oaks, Phase 1A, an addition to the City of Southlake, Tarrant County, Texas and located at 1020 Whittington Pl., Southlake, Texas. The current zoning is SF -20A — Single Family Residential District. Planner Schell stated that the applicant has submitted a letter requesting to withdraw the case and that according to the Rules of Procedure, requests to withdraw cases that are submitted after public notices have been sent require formal consent of the Board. A motion was made to approve the request to withdraw case No. ZBA -641. The request is being made by the applicant, Matt and Lisa Carroll, for property described as Lot 6, Block 1, Wimbledon Estates, an addition to the City of Southlake, Tarrant County, Texas and located at 1720 Grass Ct., Southlake, Texas. The current zoning is SF -1A — Single Family Residential District. Chair Venesky opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. The builder, Betty Baker, Veranda Designer Homes, 1594 Hart St., Suite 200, Southlake, Texas, once sworn in, was available to answer questions of the Board. Once the applicant completed her presentation, Chair Venesky asked if there were those in the audience who wished to speak in favor of the request. Lisa Carroll, 2604 Independence Rd., Colleyville, TX, the applicant and owner of the property, spoke in favor of the request. Chair Venesky asked if there were those in the audience who wished to speak in opposition to the request. There being no one, Chair Venesky closed the public hearing and opened the item for discussion. The applicant requested to table the case to the July 11, 2013 meeting. A motion was made to table Agenda Item No. 7, case No. ZBA -642, to the July 11, 2013 meeting. Motion: Panahy Second: Huffman Ayes: Lepicier, Huffman, Panahy, Evans and Venesky Nays: None Abstain: None Vote: 5 -0 -0 Motion: Carried Agenda Item No. 8 — ZBA -643, Variance to rear setback: Variance to Ordinance No. 480, Section 14.5(d), requiring a rear yard setback of 35' on lots fronting on a cul -de -sac. The request is being made by the applicant, George A. Ondarza, for property described as Lot 10, Block 1, Ridgewood II, an addition to the City of Southlake, Tarrant County, Texas and located at 2802 Watts Ct., Southlake, Texas. The current zoning is SF -20A — Single Family Residential District. Planner Schell presented the case to the Board, stating that the request is to allow a covered porch to be constructed approximately 30' from the rear property line. Planner Schell was available to answer questions of the Board. Chair Venesky opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Once the applicant completed his presentation, Chair Venesky asked if there were those in the audience who wished to speak in favor of the request. Brent Booher, 2802 Watts Ct. Southlake, Texas, the owner of the property, spoke in favor of the request. Chair Venesky asked if there were those in the audience who wished to speak in opposition to the request. There being no one, Chair Venesky asked the applicant if he would like to make a rebuttal. Mr. Ondarza, still under oath, presented additional information to the Board. Chair Venesky closed the public hearing and opened the item for discussion. A motion was made to approve Agenda Item No. 8, case No. ZBA -643. Variance to front and rear setbacks: Variance to Ordinance No. 480, Section 14.5(b), requiring a front yard setback of 35' and a Variance to Ordinance No. 480, Section 14.5(d), requiring a rear yard setback of 40'. The request is being made by the applicant, Mehul Patel, for property described as Lot 1, Block 2, Kimball Hills, an addition to the City of Southlake, Tarrant County, Texas and located at 2117 Kimball Hill Ct., Southlake, Texas. The current zoning is SF -20A — Single Family Residential District. Planner Schell presented the case to the Board, stating that the request is to allow a principal residence to be constructed approximately 25' from the front building line on Miracle Pointe Dr. and approximately 35' from the rear property line. Planner Schell was available to answer questions of the Board. Chair Venesky opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. The owner and applicant, Vaishali Patel, 308 Wright Ave., Rockwall, Texas, once sworn in, presented information and was available to answer questions of the Board. Once the applicant completed her presentation, Chair Venesky asked if there were those in the audience who wished to speak in favor of the request. Zoning Board of Adjustment Meeting Minutes — June 27, 2013 Michael Hamil, 3611 W. Pioneer Pkwy., Arlington, Texas, the architect of the proposed home, spoke in favor of the request. Chair Venesky asked if there were those in the audience who wished to speak in opposition to the request. There being no one, Chair Venesky asked the applicant if she would like to add any additional information. The applicant declined. Chair Venesky closed the public hearing and opened the item for discussion. A motion was made to approve Agenda Item No. 9, case No. ZBA -644.
