SEWER LINE EASEMENT
OFFICIAL RECORD
KNOWN ALL MEN BY THESE PRESENTS:
That Jere L. Francis and Janice L. Francis of 1211 Ashmoore Court Southlake, Texas
hereinafter called "Grantor," whether one or more, for and in consideration of TEN AND NO/100
DOLLARS ($10.00) and other valuable consideration to Grantor in hand paid by Don W. Rose of
1209 Ashmore Court Southlake, Texas, hereinafter called "Grantee," has granted, sold and
conveyed and by these presents does grant, sell and convey unto said Grantee, his successors and
assigns, an easement for a sewer line across and upon all that certain tract of land located in
Tarrant County, Texas, more particularly described as Lot 3 HIGHLAND ESTATES ADDITION,
to the CITY OF SOUTHLAKE, TARRANT COUNTY, according to the Plat and dedication
recorded in Volume 388-134, Page 100, Plat Records Tarrant County, Texas.
Said sewer easement shall be 10 foot wide centered along the center line of a
sewer line meandering near the common property line of lot's 3 and 4 as
iliustreted in EXHIBIT "A" attached.
Grantee shall have the right to construct, maintain and repair a sewer line within the
casement, including the right to grade and clear trees, shrubs, and brush in order to establish and
maintain such sewer line.
Said easement shall be for a private sewer line for use by Grantee, his and her successors
and assigns, their contractors, licensees, and agents for passage of their vehicles and equipment.
Grantor reserves the right to use the easement, provided such use shall not include the
growing of trees thereon or any other use that may interfere with the exercise by the grantee of the
right hereby granted to it.
TO HAVE AND TO HOLD the above described sewer line easement unto the said
Grantee, his successors and assigns, until the sewer line shall be abandoned, and it that event said
sewer line easement shall cease and all rights herein granted shall terminate and revert to Grantor
or Grantor's successors or assigns; and Grantor hereby bind themself their successors, assigns, and
legal representatives, to warrant and forever defend the above described easement and right-of-way
unto Grantee, their suecassors and assigns, against eve~ person whomsoever lawfully claiming or
to claim the same or any part thereo£

Properties: Lots 3 and 4 of Highland Estates known as
1209 Ashmoore Court, Southlake, Texas

It is the desire of the owners of the above properties to have an
easement on either and/or both lots for the installation of sewer
lines. The lines will be run separately but in a common trench
for a majority of the distance to the connector for the city
line. This request is made because of the extreme distance from
the houses to the hookup points, the extensive amount of backhoe
work that will be involved, the necessity to cross a small stream
in a drainage area and to prevent the removal of large oak trees
to stay within the confines of the properties. The lines will be
installed as close as possible to the common property line
consistent with the above criteria. Both owners agree to permit
access to the lines in the event future maintenance or repairs
are necessary, and this authority will carry forward to any
future owners.
