Chairman Boutte called the meeting to order at 6:48 p.m.
There was no Work Session held.
AGENDA ITEM #2, APPROVAL OF MINUTES:
Chairman Boutte opened discussion of the minutes of the Planning and Zoning Commission meeting
held on September 7, 2000.
Motion was made to approve the minutes of the Planning and Zoning Commission meeting held
on September 7, 2000, as presented.

There were no Administrative Comments.
Chairman Boutte said the Consent Agenda items are considered to be routine and will be enacted
with one motion unless a Commission member or an audience member requests for an item to be
removed from the Consent Agenda in which it will then be placed on the Regular Agenda and
considered in its normal sequence. No one requested for an item to be removed from the Consent
Agenda.
Ralph Evans, 315 N. Shady Oaks Drive, Southlake, Texas, said he is representing White's Chapel
United Methodist Church and asked the Commission to table Agenda Item #7, ZA00-100.

AGENDA ITEM #8, ZA00-074, SITE PLAN FOR THE CHILDREN'S COURTYARD:
Comprehensive Planner Ken Baker presented this item to the Commission for a Site Plan for The
Children's Courtyard being on property legally described as Lots 8, 9, 10, and 11, Block 6,
Southridge Lakes, Phase C-l, being 3.0349 acres. The property is located on the northeast and
southeast comers of the intersection of North Peytonville Avenue and Corporate Circle. This site
consists of two (2) lots. The Current Zoning is "C-3" General Commemial District. The Land Use
Category is Office Commemial. The Owner of the property is Realtex Ventures, Inc. The Applicant
is Gary Wood of Wood-Stovall Architects. Fifteen notices were sent to property owners within the
200' notification area, and two responses were received with one being in favor and one being
undecided.
Commissioner Jones asked when the construction on Peytonville Avenue will take place. Staff
Engineer Angela Turner said it will take place in November or December.
Gary Wood (~ood-Stovall Architects) 806 E. Abram Street, Arlington, Texas, presented this item
to the Commission and reviewed the requested variances with them.
Chairman Boutte asked Mr. Wood what his landscaping plans are along Peytonville Avenue; he said
he is thinking that proper landscaping may help screen the dumpster from the second story windows
of the residences across the street. Mr. Wood said they are proposing to meet the City's ordinance
for landscape buffering in that bufferyard; typically they provide more landscaping than what is
required. Mr. Wood said there will also be the required 3' tall shrubs in front of the parking area. He
said he does not have a landscape plan drawn up yet.

1 Chairman Boutte said he is wondering ifa strategically placed canopy tree in the bufferyard along
2 Peytonville Avenue would help mitigate the impact of the dumpster. Mr. Wood said they could
3 definitely do that; they would be happy to plant a few extra trees in order to help screen it.

5 Commissioner Home asked if this building will be the typical red brick he has seen on other
6 Children's Courtyard buildings. Mr. Wood said these buildings will have a brownish-blend brick
7 and a stone with a brownish tint to it.

9 Commissioner Jones asked if they can physically do anything else with the dumpster for Building
10 'A'. Mr. Wood said he considered placing it along Peytonville Avenue with the doors facing in
11 towards the building, but the problem is then that it would be located within the building setback.

13 Chairman Boutte said he does not know if all of the Commissioners are familiar with the history of
14 this property and asked David McMahan to speak to that.

16 David McMahan, 1335 Hidden Glen, Southlake, Texas, gave the Commissioners a brief history of
17 the property.

21 Chairman Boutte opened the Public Hearing.

23 Debbie Engler-Key, 10,5 Killdeer Court, Southlake, Texas, said she is not opposed to this plan but
24 asked the Commission to consider the view from the Myer's Meadow subdivision. She asked if
25 there is some way the views from their homes can be protected and also from the increased traffic
26 that will be coming out behind their homes. She requested for the shrubbery or plantings to not be
27 just ornamental but to give them some protection from the traffic and the dumpsters. She also asked
28 the Commission to consider the fact that there are high school drivers in this area.

34 Chairman Boutte said his one concern is getting the homeowners' view screened as well as possible.

36 Commissioner Terrell agreed with Chairman Boutte's concern and said another concern of his is
37 regarding the requested variances of the screening device along the back. He said he is concerned
38 about the possibility of a fire or the possibility of all the existing trees along the north property line
39 going away for some reason.

41 Commissioner Jones said he has a hard time with having a dumpster along a main road. He is
42 opposed to residents having to look at dumpster doors.

44 Commissioner Home asked Mr. Wood how else he could screen the dumpster. Mr. Wood said any
45 screening they do would have to comply with City regulations; they will make every effort possible

to improve the dumpster situation as best they can.
Mr. Wood said since the dumpster is located next to a common access easement, they could look
at turning it 90-degrees so that the doors would open away fi.om the residential area. Mr. McMahan
said he thinks the owner of the Tetco Gas Station would be willing to work with him if they need
a little comer cut for access in that direction; he cannot promise it because he does not own that land,
but he would certainly ask. He said he believes they can get that done.
Commissioner Jones stated again that he is opposed to the residential property owners having to look
at the dumpster doors; he would like to make it clear in the motion that what is shown is not
acceptable.
Chairman Boutte closed the Public Hearing.

Motion was made to approve ZA00-074 subject to Site Plan Review Summary No. 2, dated
September 15, 2000; to accept the variance in Item #1 (bufferyard); to accept the variance in Item
#2 as requested (north site dumpster); to accept the variance to Item #3 but stating that the screening
device must be maintained in perpetuity; and to acknowledge the applicant's agreement to make sure
the doors on the south site dumpster shall not face Peytonville Avenue.

Chairman Boutte said the Commission is very concerned about the south site dumpster and would
like the opening turned away from the residences across the street; the Commission understands the
applicant may need to work out an agreement with the neighboring gas station. He said another
option may be to screen the dumpster with vegetation within the 10' bufferyard along Peytonville
Avenue. He wanted to make sure City Council understands the Commission's concerns about this.
