PROJECT: Specific Use Permit for a Mass Gathering — Stars & Stripes
EXECUTIVE
SUMMARY: The City of Southlake is requesting approval of a specific use permit to allow a
mass gathering for the Independence Day Stars & Stripes event. The event is held
on property located within Southlake Town Square and generally located within the
area between E. Southlake Blvd. to the south, State Highway 114 to the north and
Carroll Avenue to the west. The current zoning is DT — Downtown District. SPIN
Neighborhood # 8.
REQUEST: The annual Stars & Stripes event is held once a year, typically on July 3rd from 6
p.m. to 11 p.m. The event consists of bands and entertainment, as well as
concessions. This event has been held annually since 1999. The staff is bringing
this item forward to permit the event in perpetuity in a consistent manner as other
Southlake Town Square events such as Art in the Square and Home for the
Holidays.

PROPERTY SITUATION: Southlake Town Square, generally located within the area between E.
Southlake Blvd. to the south, State Highway 114 to the north and Carroll
Avenue to the west.
LEGAL DESCRIPTION: Southlake Town Square Phase One and Grand Avenue
LAND USE CATEGORY: Town Center
CURRENT ZONING: DT — Downtown District
HISTORY: The Stars & Stripes Independence Day event has been held annually since
July 1999.
Other mass gathering events in Southlake Town Square:
• Art in the Square; held annually since May 2000. Current approved
SUP is valid in perpetuity.
• Showcase in the Square; held annually since June 2012. Current
approved SUP is valid until February 7, 2015. (3-year approval)
• Oktoberfest; held annually since October 2002. Current approved
SUP expires June 21, 2014. (3-year approval)
• Southlake Green Day; held annually since March 2009. Current
approved SUP valid until November 16, 2013. (3-year approval)
• Home for the Holidays; held annually since November 1999.
Current approved SUP is valid in perpetuity.
• Spokes 4 Hope; approved in October 2009. Current approved SUP
allows for three events over a period of 6 years which will expire
October 6, 2015.
P&Z ACTION: June 6, 2013; Approved (6-0) in perpetuity subject to the scope presented
and Staff Report dated May 30, 2013.
STAFF COMMENTS: The City Council shall consider the following in determining whether to
grant a Specific Use Permit for a mass gathering event according to the
Comprehensive Zoning Ordinance No. 480, Section 45.14c, as amended:
1. whether there is convenient and safe access for the ingress and egress
of pedestrians and vehicular traffic;
2. whether sufficient traffic control personnel is proposed to insure safety
to all members of the traveling public, including pedestrians, along all
public roadways in the proximity of the mass gathering and/or along
which the public is likely to travel to reach the mass gathering areas
shall be provided;
3. whether the mass gathering area is well drained and so arranged to
provide sufficient space for persons assembled, vehicles, sanitary
facilities, and appurtenant equipment;

4. whether sufficient illumination will be provided at night to protect the
safety of the persons assembled;
5. whether adequate parking areas, including disabled persons' parking
spaces, shall be provided for persons arriving by vehicular means. If
the promoter proposes to utilize temporary off -site parking, then the
promoter the mass gathering event the off -site temporary parking area
will not be utilized for purposes other than the mass gathering event;
and
6. whether adequate provisions have been made for food supply, medical
assistance, garbage disposal, water supply, parking, sanitation and
toilet facilities, vermin control, and safety.
The City Council may establish specific conditions depending upon the
nature of the proposed event and traffic, health and safety issues according
to Ordinance 480, Section 45.14.a, as amended.
The applicant understands that an annual review of their festival plan will
need the following city staff approvals:
• Scope of the event - Planning Department
• Public roadways, traffic direction contracts, security issues — Police
Department
• Fire lane and hydrants accessibility - Fire Department
• Tents and generators will require permits/inspections - Building
Inspections/Fire Department

report. Due to the limited scope of this request, a staff review was not
generated.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A
MASS GATHERING FOR STARS & STRIPES LOCATED WITHIN
SOUTHLAKE TOWN SQUARE, SOUTHLAKE, TEXAS, AND BEING
GENERALLY LOCATED WITHIN THE AREA BETWEEN EAST
SOUTHLAKE BOULEVARD TO THE SOUTH, STATE HIGHWAY 114
TO THE NORTH AND CARROLL AVENUE TO THE WEST, MORE
FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS
DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO
AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for a mass gathering for Stars & Stripes has been
requested by a person or corporation having a proprietary interest in the property zoned as "D7
Downtown District; and,
WHEREAS, in accordance with the requirements of Section 45.1 (36) of the City's
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have
given the requisite notices by publication and otherwise, and have afforded the persons interested
and situated in the affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific
Use Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for a mass gathering for Stars & Stripes, on property within
the City of Southlake, Texas, Southlake Town Square, being generally located within the area
between East Southlake Boulevard to the south, State Highway 114 to the north and Carroll Avenue
to the west and being described as Southlake Town Square, an addition to the City of Southlake,
Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the
approved Site Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective
date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions

set forth herein. The following specific requirements and special conditions shall be applicable to the
granting of this Specific Use Permit:
SECTION 2.
This resolution shall become effective on the date of approval by the City Council.
