PERMANENT WATERLINE EASEMENT
THE STATE OF TEXAS
COUNTY OF TARRANT
KNOW ALL MEN BY THESE PRESENTS
That we, Napoleon M. Smock & Juhayna M. Husseini Trustee (the "Grantor"), for
and in consideration of the sum of $11_571.00 Dollars and other
good and valuable consideration in hand by Grantee herein, the receipt and sufficiency of
which is hereby acknowledged and confessed, have granted, sold and conveyed, and by
these present do grant, sell and convey to the City of Southlake, Grantee herein, of
Tarrant County, Texas a permanent and perpetual non-exclusive easement for the purpose
of installing, repairing, maintaining, altering, replacing, relocating, and operating one
water line into, upon, over, across and under that land in Tan'ant County, Texas
described as follows, to wit:
Being a permanent water line easement, described as follows:
See attached Exhibit "A" for graphic depiction
See attached Exhibit "B" for metes and bounds description together with the right
of ingress and egress as necessary for such purposes.
TO HAVE A_ND TO HOLD the above described easement, together with all
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee,
its successors and assigns forever; and we do hereby certify that we are the owners of the
property described herein and bind ourselves, our heirs and assigns, to warrant and to
forever defend all and singular the premises unto the said Grantee, its successors and
assigns, against the claims of any persons owning, holding, or claiming by, through or
under Grantor.
By acceptance of this conveyance, Grantee hereby agrees to indemnify and hold
harmless Grantor from any loss, cost, damage or expense (including, without limitation,
court costs and reasonable attorney's fees) arising from out of or in any manner connected
with the negligence or intentional misconduct of Grantee in exercising the rights and
obligations granted and set forth herein. The parties hereto agree that only upon the
written consent of all parties hereto and any other parties in interests may this Agreement
be amended or any of the areas be relocated, changed, altered, diminished, or expanded.
Grantor, its successors, heirs or assigns shall have the right to tap into the utilities
in this easement on a perpetual non exclusive basis.
The undersigned does not convey any land, but merely grants the rights, privileges, and
easements herein before set out.

Field Notes
Being a 0.266 acre tract of land in the John A. Freeman Survey, Abstract No. 529, and being
a portion of Lot IA, Block 1 of the C-orbutt Addition of the City of Southlake, Tarrant
County, Texas, said lot being conveyed to Smock and Husseini JV, by deed in Volume 7428,
Page 1100 of the Deed Records of Tarrant County Texas, (D.R.T.C.T.) and being more
particularly described as follows:
BEGINNING at the northwest corner of said Smock and Husseini JV tract, said point being in
the South right-of-way line of State Highway F.M. 1709;
THENCE
$ 89° 05' 27' E, along the north line of said Smock and Husseini ~V tract for a
distance of 252.05 feet to a point for a corner, said point also being in the south
right-of-way line of State Highway F.M. 1709;
THENCE
S 89° 53' 01' E, along the north line of said Smock and Husseini JV tract for a
distance of 326.56 feet to a point for a corner, said point being the northeast
corner of the Smock and Husseini JV tract;
