PERMANENT DRAINAGE
EASEMENT
THE STATE OF TEXAS
COUNTY OF TARRANT
KNOW ALL MEN BY THESE PRESENTS:
That, We, Maguire Partners-Solana Limited Partnership, a Texas limited
partnership, Grantor herein, for and in consideration of the sum of Ten ($10)
Dollars and other good and valuable consideration in hand paid by Grantee
herein, the receipt and sufficiency of which is hereby acknowledged and
confessed, subject to the reservation set forth below, have granted, sold and
conveyed, and by these presents do grant, sell and convey to the City of
Southlake, Grantee herein, of Tarrant County, Texas, a permanent and
perpetual drainage easement for the purpose of installing and maintaining said
drainage improvements upon, over, across and under that land in Tarrant
County, Texas as described as follows, to-wit:
Being a permanent drainage easement, described as follows:
See attached Exhibit "A" for graphic depiction.
See attached Exhibit "B" for metes and bounds description together with the
right of ingress and egress as necessary for such purposes.
Such permanent easements shall include the right to enter for purposes of
maintaining the drainage improvements upon such property, but Grantee shall
replace any fences, improvements, or other fixtures upon said property without
cost to Grantor, or any then current owner thereof, and shall restore the
property, the subject of the permanent easement, as nearly as possible to its
condition prior to entry thereon.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said
Grantee, its successors and assigns, for so long as this easement is used for
the purposes set forth herein: and subject to any and all easements, rights,
restrictions and encumbrances filed of record in the Real Property Records of
Tarrant County, Texas, or which an on the ground inspection would reveal, and
subject to the reservation set forth below. We do hereby certify that We are the
owners of the property described herein and bind ourselves, our heirs and
assigns, to warrant and to forever defend all and singular the premises unto the
said Grantee, its successors and assigns, against every person whomsoever
lawfully claiming or to claim same or any part thereof by, through or under
Grantor, but not otherwise. Grantor reserves for itself, its successors and
assigns, the right to install, repair, maintain, alter, replace, relocate and operate
utilities, driveways and parking areas in, into, upon, over, across and under the
land described above, provided that such installation, repair, maintenance,
alteration, replacement, relocation or operation does not interfere with any
drainage facilities within the easement and is performed in accordance with all
City Ordinances and regulations.

Field Notes
Being a 0.0115 acre tract of land in the J. B. Martin Survey, Abstract No. 1134, City of
Southlake, Tarrant County, Texas and being a portion of a tract of land conveyed to
International Business Machines Corporation, as recorded in Volume 10~1131~ P.100,
(D.R.T.C.T.) and being more particularly described as follows:
BEGINNING at a point at the southwest comer of an existing 20 x 50 feet Drainage
Easement, being in the southerly line of said International Business Machines Corporation
tract of land, same being the north right-of-way line of Dove Road, said point being
N 89°30'18" W, a distance of 20.00 feet from the southeast comer of said International
Business Machines Corporation tract;
THENCE
N 89030' 18" W, continuing along the southerly line of said International
Business Machines Corporation tract of land, also being the north right-of-
way line of Dove Road, a distance of 10.00 feet to a point;
THENCE
N 02°38'01" W, leaving the north right-of-way line of Dove Road, parallel
with said existing 20 x 50 feet Drainage Easement, a distance of 50.00 feet
