conveyed, and by these presents do grant, sell and convey to the City of Southiake, Grantee
herein, of Tarrant County, Texas a permanent and perpetual easement for the purpose of
installing, repairing, maintaining, altering, replacing, relocating, and operating utilities in,
into, upon, over, across and under that land in Tarrant County, Texas described as follows, to-

defend all and singular the premises unto the said Grantee, its successors and assigns, against
every person whomsoever lawfully claiming or to claim same or any thereof.

Estates, as recorded in Volume 388-177, Page 7 of the Plat Records of Tarrant County, Texas,
and being more particularly described as follows:
BEGINNING at thc northeast corner of said Lot 9, Block 2 and the southeast comer of said Lot
8, Block 2;

S 00o37'24" E, for a distance of 10.05 feet to a point for a comer in the east
property line of said Lot 9, Block 2 of Diamond Circle Estates, said point also

Dear Mr. Decinti:
Based upon our discussion on Tuesday, July 8, I997, the City of Southlake
~vill offer you the following for the 10-foot permanent utility easement:
· "Bore" the sewer under any trees you wish to save in the northern and
eastem easements.
· Any damage to your yard ,,,,'ill be repaired to as reasonably close to the
original condition as possible.
· Your "server tap" will be located on the east boundary of your property.
City will waive the "Neighborhood Participation Fee" of $1,300 for you
and a like amount for your neighbor to the north because of the corrLmon
easement you share and for any damages that may occur to this property
within the easement due to construction of the sewer.
Cheatham and Associates will FAX you a copy of the plans, which show
your lot.
You ,,','ill need to hire a plumber to connect your house line to the service
tap provided for your at the service mains.
I hope this answers your questions and the easement will be signed. We are
ready to advertise for bids upon the receipt of the easement. Your
cooperation is truly appreciated by the City and your neighborhood.
