KNOW ALL ~ BY THESE PRES~I~PS:
That (I) (We), Tommy G. Morgan and Virginia Gail Morgan ,
for and in consideration of the sum of Ten ($10) Dollars and other good and
valuable consideration in hand paid by Grantee herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, have granted, sold and
conveyed, and by these presents do grant, sell and convey to the CITY OF
SOUTHLAEE, Grantee herein, of Tarrant County, Texas a permanent and perpetual
easement for the purpose of installing, repairing, maintaining, altering,
replacing, relocating, and operating utilities in, into, upon, over, across and
under that land in Tarrant County, Texas described as follows, to-wit:
Temporary 10 foot & 15 foot Wide Drainage Easement:
See attached Exhibit 'A' for metes and bounds description
See attached Exhibit 'B' for Graphic depiction
See attached Exhibit 'C' {or Special Conditions
described as follows, to-wit:
Temporary 30 foot Wide Construction Easement:
Immediately adjacent to the above described easement in a configuration as
shown on the attached Exhibit 'B'
See attached Exhibit 'C' for Special Conditions
Such temporary and permanent easements shall include the right to excavate upon
such property, but Grantee shall replace any fences or other fixtures upon said
property without cost to Grantor, and shall restore the property, the subject of
the temporary and permanent easements, as nearly as possible to its condition
prior to entry thereon.
The City will not be responsible for loss or damage to any trees as a result to
the installation of the storm drain pipe.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said
Grantee, its successors and assigns forever; and I/We do hereby bind
myself/ourselves, my/our heirs and assigns, to warrant and to forever defend all
and singular the premises unto the said Grantee, its successors and assigns,
against every person whomsoever lawfully claiming or to claim same or any
thereof.

Drainage and Utility Easement
BEING a tract of land out of the John Childress Survey, Abstract 253,
Tarrant County, Texas, and being a portion of Lot 7, Block 1 of the
Cross Tiraber Hills Addition, Phase I, to the City of Southlake~' Tarrant
County, Texas as recorded in V. 388-152, P. 63, Plat Records, Tarrant
County, Texas and being mor~particularly described by metes and bounds
as follows:
COMMENCING from a 1/2" iron rod found for the northeast corner of said
Lot, being in the west R.O.W. of the cul-de-sac for Cross Timber Drive;
THENCE N59°33'00'' W along the north property line of said lot a
distance of 53.96 feet to a point; THENCE S30°27'00" W a distance of
7.5 feet to a point in the south line of an existing 7.5' drainage and
utility easement (total width of 15.0' centered on lot line) for the
POINT OF BEGINNING;
