KNOW ALL MEN BY THESE PRESENTS:

($10) Dollars and other good and valuable consideration in hand paid by Grantee herein,
the receipt and sufficiency of which is hereby acknowledged and confessed, have granted,
sold and conveyed, and by these presents do grant, sell and convey to the City of
Southlake, Grantee herein, of Tarrant County, Texas a permanent and perpetual easement
for the purpose of installing, repairing, maintaining, altering, replacing, relocating, and
operating utilities in, into, upon, over, across and under that land in Tarrant County,
Texas described as fbllows, to-wit:
Being a permanent utility easement and temporary construction easement described as
follows:

See attached Exhibit 'B' for metes and bounds description together with the right
of ingress and egress as necessary for such purposes.
TO ItAVE AND TO HOLD the above described easement, together ~vith all and
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee,
its successors e_nd assigns forever; and We do hereby certify that We are the owners of
the property described herein and bind ourselves, our heirs and assigns, to warrant and to
forever defend all and singular the premises unto the said Grantee, its successors and
assigns, against every person whomsoever iawfi-fiiy claiming or to claim same or any
thereof.

15' Permanent Utility Easement
35' Temporary Construction Easement
Being a 0.060 acre tract of land in the Benjamin J. Foster Survey, Abstract No. 519, City
of Southlake, Tarrant County, Texas and being a strip of land, over, through, and across
Block 4, Lot 39 of the Cross Timber Hills Addition in Volume 388-170, P.78,
(P.R.T.C.T.) and being more particularly described as follows:
COMMENCING at a ~/2" iron rod found for a corner, said point being the northwest
property corner of said Lot 39, the southwest property corner of Block 4, Lot 38 and in
the east property line of Block 4, Lot 46, both of the Cross Timber Hills Addition in
Volume 388-170, P.78 (P.R.T.C.T.);
THENCE
N 90° E, a distance of 8.14 feet along the north property line of said Lot
39 to a point for a comer, said point being the POINT OF BEGINNING;
THENCE
N 90° E, a distance of 15.03 feet along said proper~:y line to a point for a
comer;
THENCE
S 03° 28' 47" W, a distance of 173.82 feet to a point for a comer, said
point being in the south property line of said Lot 39 and in the north
property line of Block 4, Lot 40 of the Cross Timber Hills Addition in
Volume 388-170, P.78 (P.R.T.C.T.);

N 89° 13' 15" W, a distance of 15.02 feet along said property line to a
point for a comer, said point being the southwest property comer of said
Lot 39, the northwest property corner of said Lot 40, and being in the east
property li~e of Block 4, Lot 45 of the Cross Timber Hills Addition in
Volume 388-170, P.78 (P.R.T.C.T.);

N 03° 28' 47" E, a distance of 173.62 feet to the POINT OF
BEGINNING, containing within these metes and bounds 0.060 acres or
