Carroll Ave. Southlake, TX 76092 ~0 0 © 98021E16 EXHIBIT B 4,180 square feet Sfland being a portion of Lot 14, Block 1, Cross Timbers I-Iills, Phase I, an addition to the city of Southlake, Tarrant County, Texas according to the plat recorded in Volume 388/152, Page 63, Plat Records of Tarrant County, Texas; said 4,180 square feet of land being more particularly described by metes and bounds as follows: BEGINNING at a 1/2 inch iron rod found at the northwest comer of said Lot 14; THENCE N 89° 42' 00" E, 278.65 feet along the north line of said Lot 14; THENCE S 24° 57' 00" E, 16.50 feet along the east line of said Lot 14; THENCE S 89° 42' 00" W, 278.63 feet; THENCE N 25° 00' 00" W, 16.51 feet along the west line of said Lot 14 to the POINT OF BEGINNING and containing 4,180 square feet of land. Dear Sirs, In response to the Sanitary Sewer Project here are the amendments to our property as I understand them. 1. In consideration for said easement, the city will waive the $1300 fee. 2. The construction fence will be installed around the northern perimeter of the shed so the contractor will be denied access and not disturb the shed. 3. We do not want the drawing to show stockpile on the North side of the shed due to the fact this will be in the drip line of trees. As stated in your letter of the 29th 'As far as the City knows the drawing is to scale and accurate.' It appears to be a little off. 4. Construction fence wilt be installed around the drip-tine of the protected trees in the north east comer of your property. 5. No stockpile will be allowed within I0 feet of your pool. 6. The city will bore any-'6" diameter tree or larger. The trees in the north- east portion of your property will be bored. 7. The contractor will access your property from the right-of-way of Wood Creek Lane. A section of the existing fence will be removed so that the contractor can continue construction of the sewer line to your north east property comer. A temporary fence will be installed to contain any dogs during construction when the existing fence is removed. The contractor shall restore the fence and your yard to its original or better condition prior to construction. The disturbed areas of the yard shall be sodded with the grass type of your choice. All irrigation lines and appurtenances shall be repaired to original or better condition as well. This includes any new flower beds or ponds that may be installed on the North side of the property (if disturbed). 8. The plans show the removal or replacement of the existing cedar saplings along the north property line. This should say replacement of same size cedar saplings. 9. The city can not assure that the septic leach lines will not be disturbed during construction because the exact location is not known. However, at no time will your residence be without sewer service. If the contractor disturbs the leach field lines, the contractor will repair or replace the leach lines immediately so sewer service to your residence is not interrupted. The replacement of the leach lines will be in accordance with the Uniform Plumbing Code and inspected by a City inspector prior to backfilling or coveting up leach lines. 10. Any damage to the Pool due to the construction equipment of a backhoe and a bore machine traveling the North side of the pool will be repaired by the city. 11. The city will issue another contract when and if ever another resident of or neighborhood wishes to tie on to the North side of our property. 12. The City requires a two-year maintenance bond from the contractor for any repairs needed as a result of the construction following construction of the sewer line. We would love to sign the papers Friday.
