Re: Tracts 1B4L3, I B4L4, 1B4L5, Harrison Decker Survey, Abstract 438, also described as Lots 26, 27,
and 28, Continental Trailer Park and located at 1223, 1221, and 1219 Woodsey Court
1, Theresa Von Rq,th, owner of the above property, do hereby request permission to place a new
manufactured home on my property at 1223 Woodsey Court in the following configuration. The home
(currently owned by Steve and Sandra Williams) is seventy-six (76) feet long and cannot be placed in
conformance with the zoning ordinance setbacks due to certain conditions: the width of the lot being only
80q'feet, the slope of the lot, the location of the existing septic systems, and the location of trees on the lot.
The most practical location is parallel to the rear property line, with the home being placed 15' offthe rear
property line and 15' off the side property line adjacent to my neighbor on Lot 25. With this siting, the
home would be in conformance with three of the four setbacks with the only encroachment being onto Lot
27 which is also under my ownership. As owner, I have no concern with the encroachment or setback
issues.
I do understand that the City of Southlake's zoning and subdivision ordinances prohibit the construction
of a structure across a property line, but that the City is willing to accept this placement due to the unique
circumstances and subject to certain conditions being met: I) that Lots 26 and 27 not be sold (in part or
whole) so long as the home is situated in the proposed configuration (which is not in conformance with
zoning setback requirements); 2) that the property lines not be reconfigured except by a plat approved by
the City and in conformance with the zoning and subdivision ordinances of the City.
The City, as a party to this agreement, is in no way condoning the placement of the home across the
common property line of Lots 26 and 27 and is in no way granting any legal, nonconforming fights to like
structures when said structure (currently owned by Mr. and Mrs, Williams) is removed from the site
because the proposed siting is not in conformance with the ordinance in its initial placement.
The owner hereby acknowledges and accepts the terms of these conditions and hereby affirms that all
future homes shall be placed in accordance to the city's ordinances at that time.
