STANDARD UTILITY EASEMENT
(PERMANENT)

KNOW ALL MEN BY THESE PRESENTS:
That (I) (We), ~ for and in consideration of the sum of Ten
($10) Dollars and other good Md valuable consideration in hand paid by Grantee herein, the
receipt and sufficiency of which is hereby acknowledged and confessed, have granted, sold
and conveyed, and by these presents do grant, sell and convey to the CITY OF
SOUTHLAKE, Grantee herein, of Tarrant County, Texas a permanent and perpetual
easement for the purpose of installing, repairing, maintaining, aitering, replacing, relocating,
and operating utilities in, into, upon, over, across and under that land in Tarrant County,
Texas described as follows, to-wit:
Being a permanent drainage easement described as follows:
BEGINNING at the northwest comer of Lot 29, Block 2 of Continental Park Estates, an
addition to the City of Southlake, Texas as recorded in Volume 388-98, Page 23 of Deed
Records of Tarrant County, Texas.
THENCE S 75°46'00"E with the northerly line of said Lot 29 for a distance of 193.06 ft. to
the northeast comer of Lot 29;
THENCE S 08°38'00" W with the easterly line of Lot 29 for a distance of 101.52 ft. to the
southeast comer of Lot 29;
THENCE N 75046'00,. W with the southerly line of Lot 29 for a distance of 25.12 ft. to a
point for a comer;
THENCE N 08038'00., E, a distance of 86.45 ft. to a point for a comer;
THENCE N 75°46'00" W, a distance of 101.94 ft. to a point for a comer;
THENCE N 30°46'00" W, a distance of 10.61 ft. to a point for a comer;
THENCE N 75°46'00" W, a distance of 60.0 ft. to a point being in the westerly line of
Lot 29.
THENCE N 14°14'00' E, a distance of 7.5 ft. to the POINT OF BEGINNING.
Also included will be a temporary construction easement 20' wide and being south & west of
the permanent easement. Temporary construction easement to be removed upon completion
of construction.
See attached Exhibit 'A' for metes and bounds description with attached
graphic depiction
together with the right of ingress and egress as necessary for such purposes.
Such permanent easements shall include the right to excavate or fill upon such property, but
Grantee shall replace any fences, improvements, or other fixtures upon said property without
cost to Grantor, or current owner thereof, and shall restore the property, the subject of the
temporary easement, as nearly as possible to its condition prior to entry thereon.
Attached Exhibits "B", Conditions of Easement, and Exhibit "C", Details of
Construction shall be considered a part of this easement agreement.

TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee, its
successors and assigns forever; and I/We do hereby certify that I/We are the owners of the
property described herein and bind myself/ourselves, my/our heirs and assigns, to warrant
and to forever defend all and singular the premises unto the said Grantee, its successors and

EXHIBIT "A"
THOMAS' EASEMENT
Exhibit
The following provisions are made a part of the drainage easement conveyed to the City of
Southlake from Terry Thomas:
1. The City shall construct a 6" thick steel re'mforced concrete slab from the
existing driveway to the existing landscape box.
2. The City shall construct a 6" thick steel reinforced concrete slab between the
fence, house and driveway and leave a 2 ft. wide dirt area next to the house.
3. Build a 6" curb along the north side of the driveway from the property line to
the fence.
4. City will be responsible for hauling off excess debris or spoils and existing
concrete blocks in your yard, as a result of the .contract to construct a concrete
flume.
5. City will repair any physical damage mused by the construction of the flume.
6. City will construct a temporary fence in the back yard to confine the owner's
dog during construction.
7. Attached as Exhibit "C" is a detail drawing of the flume to be constructed.
8. The City will release the existing sewer lien of $ 2,494 within 30 days after
the owners sign the drainage easement.
9. The City will pay all construction and engineering cost associated with the
installation of the flume.
10. City will install new 6' board fence in the north side of the house to include
one walk gate and one drive thru gate.
11. City will quitclaim existing easement paralleling south property line.
12. After the construction of the flume is accepted by the City and all the above
items have been completed, Exhibit "B" of this easement will become null and
void.
