Continental Park Estates (Lot 23R, Block 2) - Temporary Construction EasementCity of Southlake, Texas State of Texas: County of Tarrant: OFFICIAL RECORD Temporary Construction Easement Agreement This agreement between Roger Lemieux and the City of Southlake is for the purpose of granting to the City of Southlake a temporary construction easement through a portion of Lot 23R, Block 2, Continental Park Estates, which is owned by Mr. Lemieux. The City has contracted with Wright Construction to install a sewer line within an existing 7 1/2 foot easement on Mr. Lemieux's east property line. An additional 30' temporary construction easement to the existing 7 1/2 foot easement is necessary to allow construction equipment to ingress and egress the property and to perform normal construction activities associated with the installation of a sewer line. The temporary construction easement shall be 30 feet wide, paralleling the east property line from the front property line south to a white wood fence; a distance of approximately 125 feet. The exception to the 30 foot easement is that the contractor will not be allowed to enter, exit or traverse across Mr. Lemieux'$ concrete driveway. The City of Southlake by this letter guarantees that the property will be returned to as good or better condition than before construction started and that any damage to fences, grass, sprinkler systems, etc., will be repaired or replaced to the reasonable satisfaction of Mr. Lemieux. The grass will be hydromulched with a rye-burmuda grass combination approved by Mr. Lemieux. The City agrees to eliminate an existing low point in the street in front of Mr. Lemieux's property when Oakwood Drive is reconstructed. The reconstruction of Oakwood Drive is a part of the sewer contract with Wright Construction. Prior to acceptance of the sewer line, the City will insure that Mr. Lemieux's property has been restored to his reasonable satisfaction. Upon the final acceptance of the sewer line by the City of Southlake or March 1, 1991, whichever comes first, no further use of the temporary construction easement area shall be made by the City or its agents except for repairs required under %he contractor's one-year warranty.
