PUBLIC HEARING Daniel Cortez presented Item No. 11. Curtis Young with The Sage Group located at 1130 N Carroll Avenue came forward. Mr. Young stated that he was available for questions. Chairman Hudson opened the public hearing. Kathy Roberts of 612 Northwood Trail came forward. Mrs. Roberts verified that only one house will be built and asked for clarification of where the house will be located on the back portion of the property. Mrs. Roberts also expressed concern about the noise, trash and inconvenience of construction and questioned how long the construction will take. Mr. Young confirmed that yes only one house will be built and that the rear setback is 40 -ft. Dennis Killough added that in regards to construction that as long as the owner has an active permit, construction will be allowed. However, during construction the owner /builder will have to comply with the noise ordinance and comply with keeping the construction site clean and clear of trash as noted in the Property Maintenance Code. Hours of operation would have to comply with the Construction Hours as noted in the City Code. Chairman Hudson closed the public hearing. Heather Alvarez with Landry Architects located at 1202 Richardson Dr. Suite 106 in Richardson, Texas came forward. Chairman Hudson asked about how long the storefront may take. Ms. Alvarez stated about 2 weeks. Chairman Hudson asked if there were going to be any changes on the interior. Ms. Alvarez stated yes. A building permit has be obtained and that aspect of the project is currently moving forward. Chairman Hudson asked if Markham was a franchise. Ms. Alvarez stated that this will we the 2 store. Requested Zoning: TZD - Transition Zoning District. SPIN Neighborhood # 10. PUBLIC HEARING Daniel Cortez presented Item No. 9 and No. 10 together. Curtis Young with The Sage Group located at 1130 N Carroll Avenue and Tom Matthews with Four Peak Development located at 2600 E Southlake Boulevard came forward. Both Mr. Matthews and Mr. Young gave a separate presentations addressing the zoning change, house and lot design along with drainage and landscaping. Chairman Hudson questioned the Tree Survey. The Chairman stated that a key would be helpful when moving forward to City Council. Mr. Young stated that he worked closely with Keith Martin, Landscape Administrator for the City when creating this Tree Survey. However, when the survey was taken it was mid - winter and a lot of the species were unidentifiable. Planning and Zoning Commission Meeting Minutes —May 9, 2013 Page 4of10 Commissioner Fairchild expressed concern about elevation especially from the neighbors to the east. Mr. Young agreed that the site's elevation is higher due to the natural topography. However, that was taken into consideration with the landscaping plan and drainage. If there are considerable gaps between trees, more will be added. Commissioner Fairchild gave suggestions regarding Lots 16 and 17 to help reduce the elevation to the east. Both Mr. Young and Mr. Matthews stated that they would be happy to contact those homeowner's to the east to work with them. Commissioner Forman agreed with Commissioner Fairchild and would like to see more done to eliminate some of the elevation differences. Mr. Matthews added that first floor elevations were modified and /or waived for this reason. Chairman Hudson asked about the design features for the garages. Mr. Young stated that are exact to Ridgeview I. Commissioner Fairchild verified that when Ridgeview II is complete, there will only be one HOA. Commission Kubiak asked about TXDOT's thought about the center turning lane on Davis Boulevard and future plans. Mr. Young stated that TXDOT at this time had no intention of putting in a median. Mr. Matthews stated that currently there are eight curb cuts along Ridgeview I because of former uses. However, it is now being reduced down to one. Mr. Young asked Daniel Cortez about the long term plan for the City. The display is a portion of the Urban Design Plan that was adopted in 2008. This is conceptual and to be used as a guide. TXDOT received a copy for review and approved the openings that are seen. Chairman Hudson opened and closed the public hearing. Motion to approved ZA13 -035, subject to Development Plan Review Summary No. 4 dated May 9, 2013, Staff Report dated May 9, 2013 and Modifications requested; 1) Density: The Transition Zoning District allows for no greater than 2.0 dwelling units per acre. The applicant is proposing 2.10 dwelling units per acre 2) TZD Component: The Transition Zoning District requires that two (2) out of the three (3) TZD components (Retail, Retail /Neighborhood Edge, Neighborhood) be part of the proposed Planning and Zoning Commission Meeting Minutes -May 9, 2013 Page 5 of 10 development. The applicant proposes only one (1) component (Neighborhood) 3) First Floor Elevation: The Transition Zoning District requires that the first floor elevation of single - family dwellings shall be raised a minimum of two (2) feet above the finished level of the public sidewalk/trail in front of the residential structures. The applicant is requesting that the first floor elevation be at the grade of the lot where it is located 4) Continuous Planter Strip: The Transition Zoning District requires that a minimum of six (6) feet of continuous planter strip width be located between the back of curb of the road and the sidewalk. The applicant is proposing to have four and a half (4V2) feet of continuous planter strip. PUBLIC HEARING Motion to approve ZA13 -036, noting the applicant's willingness to meet with the surrounding property owners to fill in any gaps of trees that may exist and making that subject to Plat Review Summary No. 2, dated May 3, 2013 and Staff Report dated May 9, 2013. PUBLIC HEARING Commissioner Fairchild recused himself from CP13 -001 and ZA13 -019 and left the meeting at 7:31 pm. Lorrie Fletcher presented Items 7 and 8 together. Planning and Zoning Commission Meeting Minutes -May 9, 2013 Page 6 of 10 Frank Viola with GVW Resources LLC located at 1401 Storm Court, Bedford came forward to answer any questions. Chairman Hudson asked if the buildings were going to be phased or built all at once. Mr. Viola stated that they will be built all at once. Mr.Kubiak asked about pre - leasing for the two office buildings and what the occupancy percentage was for the neighboring office buildings. Mr. Viola stated that one building is already being considered by a doctor's office. Mr. Viola believes it is at 100 %. Chairman Hudson asked if the spaces will be rented or owned. Mr. Viola stated that he and Mrs. Taylor will be handling all the management duties including the maintenance of the lots. Commissioner Forman asked about traffic, parking, and hours of operation of the salon. Mr. Viola stated that generally the salon will be open Tuesday through Saturday, 9am — 5pm. Commissioner Kubiak asked how many were on the waiting list for the salon and how many suites. Mr. Viola stated 78 on the waiting list with 48 suites. Mr. Kubiak asked about leasing agreements or requirements for construction loans. Mr. Viola stated that they are financially stable and there are no leasing requirements. Mr. Kubiak verified that due to that statement, once approved they can begin construction right away. Mr. Kubiak continued to ask about the unit layout. Mr. Viola stated that it would be based on the individual leasing the unit and the use they would need. Chairman Hudson explained the cross access easement and that the property next door where the animal hospital is followed by Mama's Pizza and the Tiquando Facility is, they have a cross access easement. If the animal hospital ever choses to redevelop, was a cross access easement considered to this property? Dennis Killough stated no. Mr. Viola continued regarding the interior site plan. He explained the suites and their sizes with the corner rooms being the larger ones. Planning and Zoning Commission Meeting Minutes —May 9, 2013 Page 7 of 10 Mr. Kubiak asked if it would be easier to find a building suited for the use or to build from the ground up as proposed. Mr. Viola stated that new construction is easier and more affordable in the long run. Mr. Kubiak is concerned that if Mr. Viola is not successful, it would be costly to change. Mr. Viola stated that there will not be any Toad bearing walls in the center and the spaces could easily be turned into something else if necessary. Commissioner Forman expressed his concern about the west elevation and lack of design. Mr. Viola stated that the current design from other elevations can be continued along the west. Commissioner Forman asked what days are the busiest and what are the peak times? Mr. Viola stated Thursday, Friday and Saturday with mornings on Thursday and Friday being peak and Saturday afternoon. Chairman Hudson opened the public hearing. Stephanos Thomopoulos of 132 Londonberry Terrace came forward and stated that she is in favor of the development as long as the developer places some trees between them and the development and replaces the fence that separates the two properties. Barbara Heller of 124 Londonberry Terrace spoke on behalf of the HOA for Stratford Parc. Ms. Heller is in support of the development but is concerned with the proper foliage separating the properties and the parking spaces during peak hours. Ms. Heller clarified that if the site plan and use changes, the developer would have to come back before the Commission. Lori Taylor with Mahalo Investments LLC located at 150 Lilac Lane came forward. Ms. Taylor explained the concept of the plan and answered all parking concerns and landscaping plans. Commissioner Kubiak asked about 311 and 321 E Southlake Boulevard and what lease space is available. Ms. Taylor stated that all spaces are leased and occupied. The three buildings that are before you tonight are under contract pending tonight's decision and City Council's decision. Steve Ruffner, DVM with Golden Triangle Animal Hospital located at 425 W Southlake Boulevard came forward. Mr. Ruffner clarified that all access to this property will be along Southlake Boulevard. The current access that is there has impacted his property Planning and Zoning Commission Meeting Minutes -May 9, 2013 Page 8 of 10 in a negative way. Additional concern is the use of the building and what happens if it remains empty. Landscaping is also an issue and keeping it fresh. Mr. Ruffner is not against the development but is concerned. Chairman Hudson asked about the median and how it has impacted his business. Mr. Ruffner stated that median causes all traffic to make turnarounds up and down all of Southlake Boulevard along with using parking Tots as a turnaround that is safer. The Commission discussed the access and the median for the property and along Southlake Boulevard. Steve Shrum of Glacier Commercial at 415 Highland Oaks Circle came forward. Mr. Shrum believes the market is good and the building will not have trouble leasing. Commissioner Parrish asked about Georgetown and the leasing percentage for that property. Mr. Shrum stated that it is currently at 95% to 100% and is predominately doctor's office. John Fry with The Design Group came forward to address the issues on the West side and will address the West side with Council. Mr. Viola came forward. Regarding Stephanos Thomopoulos and Barbara Heller request; landscape plan shows a zigzag of trees that will block the view of the commercial development but is willing to add a few more trees to create a cluster of trees and the fence will be replaced with cedar stained wood. Mr. Viola addressed parking and access for his property and Golden Triangle Animal Hospital. Mr. Viola stated that the elevations of his property are 4 -ft. higher than the animal hospital. It is visible from the street. This will help with that problem. Chairman Hudson closed the public hearing. Motion to approve CP13 -001, subject to Staff Report dated May 3, 2013.
