sufficiency of which is hereby acknowledged and confessed, have granted, sold and conveyed,
and by these presents do grant, sell and convey to the City of Southlake, Grantee herein, of
Tarrant County, Texas a permanent and perpetual easement for the purpose of installing,
repairing, maintaining, altering, replacing, relocating, and operating utilities in, into, upon,
over, across and under that land in Tarrant County, Texas described as follows, to-wit:
Being a permanent 15 foot wide utility and access easement and a temporary 35 foot wide
construction easement, described as follows:
See attached Exhibit 'A' for metes and bounds description together with the right of
ingress and egress as necessary for such purposes.
See attached Exhibit 'B' for graphic depiction.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee, its
successors and assigns forever; and I do hereby certify that I am the owner of the property
described herein and bind myself, my heirs and assigns, to warrant and to forever defend all
and singular the premises unto the said Grantee, its successors and assigns, against every
person whomsoever lawfully claiming or to claim same or any thereof.

ACCESS EASEMENT

That for and in consideration of one dollar and other good consideration to the undersigned Mid
Cities Ready Mix, Inc. (herein styled grantor) paid, the receipt of which is hereby acknowledged,
the said grantor does hereby grant, sell and convey unto the Trinity River Authority of Texas, its
successors and assigns the right to ingress, egress and regress over and through the following
described land for the purpose of access to inspect, maintain, operate, repair, etc. at will, in whole
or in part a metering station located on this tract of land which is described as follows:
Being tract 4-R out of the Brumlow Industrial Addition to the City of Southlake as recorded in
volume 388-174, Page 19 of plat records, Tarrant County, Texas.
To have and to hold unto said grantee, its successors and assigns, so long as said metering station
is operational.
The consideration first above recited as being paid to grantor by grantee is in full satisfaction of
every right hereby granted. All covenants and agreements herein contained shall extend to and
be binding upon the respective heirs, legal representatives, successors and assigns of parties
hereto.
It is hereby understood that party securing this grant on behalf of grantee is without authority to
make any covenant or agreement not herein expressed.

PROPERTY DESCRIPTION
Being a portion of a tract of land in the Harrison Decker Survey, Abstract No. 438,
described as Tract 4R, Brumlow Industrial Addition to the City of Southlake
recorded in Volume 388-174, Page 19, Plat Records, Tarrant County, Texas,
(PRTCT), and being more particularly described by metes and bounds as follows:
BEGINNING at a point for the southwest corner of said Tract 4R,
THENCE N 19°15'00" W, along a west line of said tract a distance of 15.04
feet, to a point for corner;
THENCE
N 66o25'00'' E, a distance of 606.84 feet, to a point for corner in a
curve to the left having a radius of 3332.60 feet, with a long chord
bearing N 62020'46" E a distance of 451.20 feet;
THENCE
Northeasterly along said curve an are length of 451.55 feet to a point in
