The Work Session ended at 7:03 p.m. There was no Executive Session held. The meeting was called back to order by Vice-Chairman Murphy at 7:15 p.m. AGENDA ITEM #2. APPROVAL OF MINUTES: Vice-Chairman Murphy opened discussion of the minutes of the December 4, 1997, Planning and Zoning Commission meeting. Motion was made to approve the December 4, 1997, Planning and Zoning Commission meeting minutes, as presented. LAND USE PLAN UPDATE: Planner Chris Carpenter stated that the primary purpose of the Land Use Plan Update was to combine the recommendations of the Corridor Study with the adopted 1993 Land Use Plan. Mr. Carpenter stated that there are several people in the audience with comments and concems regarding specific changes to the Land Use Plan. Vice-Chairman Murphy opened the public hearing. Gary Miron, ! 75 Miron Drive, Southlake, Texas, stated his concern regarding the change in the Land Use Plan designation on his Miron Drive property to Office Commercial. He was concerned it would change the zoning of his property. Commissioner Jones stated that this Land Use Plan does not change the existing zoning on a property. Mr. Carpenter stated that the zoning regulates the use of a property. Barbara Lamoreaux, 3650 T. W King Road, Southlake, Texas, stated that she opposes the change in the Land Use Plan designation on her property from Medium Density Residential to Low Density Residential. She stated that she had always thought her property would be developed with the highest use possible. She stated that up until a week before this meeting, she was not even aware of the possible Land Use Plan designation change on her property; the City has never informed her of any change. (Planning and Zoning Commission meeting, 12-18-97, tape 1, section #2088) Cara White (SPIN #1 Representative) stated that she feels that Lamoreaux property and the surrounding properties should be Low Density Residential. She stated that the Lamoreauxs do not live in Southlake and asked the Commission to consider those people who actually live in Southlake and who will most be affected by the Land Use Plan designation. Dennis Scifres stated that he is a General Partner of the owner of the Zembrod property which is being proposed as Office Commercial. He stated that he opposes the change from Mixed Use to Office Commercial. He stated that for the City to plan for 400,000 s.f. - 500,000 s.f. of office space south of Southlake Boulevard is not a realistic expectation for the market. Boyd Dollar, 525 Brooks Court, Southlake, Texas, stated that the primary reason the Lamoreaux property was originally proposed as Medium Density Residential was because of the trailer park across White Chapel Boulevard. He stated that now that Bob Jones Park is in that location, it makes more sense to reduce the Land Use Plan back to Low Density Residential. Conner Lam, 1280 Post Oak, Southlake, Texas, asked the Commission to change the Land Use Plan designation on his property to Mixed Use or Retail Commercial, not Low Density Residential. He also asked the Commission to change the designation on the two (2) Brock Drive lots adjacent and to the west of his lot. He stated that he does not currently own these two (2) lots, but foresees them developing as Retail Commercial in the furore. (Planning and Zoning Commission meeting, 12-18-97, tape 1, section #2552) Dona Schroetke, 211 Eastwood Drive, Southlake, Texas, asked the Commission to leave the Zembrod property as Office Commercial. She stated that she speaks for several of her neighbors when she says that she is opposed to any type of retail development on this property. Terry Mullaney, 1515 ~ Carroll Avenue, Southlake, Texas, stated his concern of the changes proposed in Study Area 'B'. He stated that he is opposed to changing the Rockenbaugh property and the Knox property to Medium Density Residential. He stated that he is already extremely concerned about the drainage in this area, and by doubling the number of possible rooftops adjacent to him, the Commission is increasing his concerns greatly. Barbara Lamoreaux asked the Commission what the minimum number of acres it takes for a P.U.D. zoning. Mr. Carpenter stated that P.U.D. zoning requires a minimum of 50 acres. Louis Kaposta, 2311 Crooked Lane, Southlake, Texas, stated his concern about the industrial designation on his property which is zoned agricultural and is currently being used as residential. Commissioner Edmondson stated that the Commission is not proposing any changes to the industrial area around Mr. Kaposta's residence. She stated that area has been shown as industrial for several years. Jim Haltom, 1700 Sunshine Lane, Southlake, Texas, stated that he purchased the Knox property recently. He asked that the Commission be consistent with the surrotmding properties when making changes to the Land Use Plan. He stated that he would rather it be Low Density Residential. He stated that he feels the Commission is handing out upgrades too freely. Vice-Chairman Murphy closed the public hearing. KIMBALL/1709 ADDITION: Motion was made at the applicant's request to table ZA 97-166 and ZA 97-142 and to continue the Public Hearings to the January 8, 1998, Planning and Zoning Commission meeting. (Planning and Zoning Commission meeting, 12-18-97, tape 1, section #3438) The Commission resumed consideration of the Land Use Plan Update. The Commission discussed the Lamoreaux property and decided it should stay as it is shown on the proposed Land Use Plan - Low Density Residential. The Commission discussed the Zembrod property and decided it should stay as it is shown on the proposed Land Use Plan - Office Commercial. The Commission agreed to change Conner Lam's property (shown as 'A' on his diagram) in Study Area 'D' to Office Commercial. Regarding the Rockenbaugh/Knox property, Commissioner Creighton suggested changing it back to Low Density Residential. She stated that Mr. Knox was the person arguing that it should be Medium Density Residential, and since the property has apparently sold to Mr. Haltom, who does not mind it being Low Density Residential, she feels it should be changed back. Commissioner Tate disagreed with Commissioner Creighton and stated that the Commission discussed this area for several evenings and feels it should remain as Medium Density Residential. Commissioner Jones agreed with Conunissioner Tate. Commissioner LeVrier stated that he sees the creek as a dividing line and supports leaving it as Medium Density Residential. Commissioner Edmondson stated that she is adamantly opposed to Medium Density Residential on the Rockenbaugh/Knox property. The majority of the Commission agreed with leaving the Rockenbaugh/Knox property shown as Medium Density Residential. Commissioner Jones suggested changing the southwest comer of East Highland Street and North Kimball Avenue to something other than residential. After discussion, it was agreed to leave the southwest comer as Medium Density Residential. Commissioner Edmondson stated that due to the changes on the following properties, she cannot support this Land Use Plan: the RockenbauglVKnox property; the Schelling property; the southeast corner of Shady Lane and North Kimball Avenue nol~!~ We; a large tract of Retail Commercial on the ~outh side of F.M ..... , Commissioner Creighton stated that she agrees with most of Commissioner Edmondson's concerns, in particularly, regarding the Rockenbaugh/Knox tract. She stated that it seems to be more the result ora private deal than it is trying to remain consistent with the Land Use Plan that had been in effect in the City. Motion was made to approve the Land Use Plan Update as shown on the December 18, 1997, plan and reflecting the Commission's recommendations tonight. REZONING AND CONCEPT PLAN FOR HILLTOP COUNTRY PLAZA: Planner Stefanie Sarakaitis informed the Commission that this request is for a Zoning Change on property being legally described as Tract IA, W. E. Mayfield Subdivision, being a portion of Tract 1, W. E. Mayfield Subdivision, according to the plat recorded in Volume 388-C, Page 4, Plat Records, Tarrant County, Texas, and being approximately 3.021 acres. Twelve (12) written notices were sent to property owners within the 200' notification, and four (4) responses have been received with all being in favor. Ray Williamson, 479 ~ Highland, Southlake, Texas, presented this item to the Commission. He stated that he intends to maintain the site as natural as possible. He compared the quality of the restaurant to that of a "Ruth Chris" restaurant. He corrected the name of the development to be "Hill Country" which, he stated, could be compared to developments in the Texas Hill Country; it will have a motif of natural elements with rock and stone. Mr. Williamson asked for a variance to Staff Comments Item #4 (10' Type 'B' bufferyard along west property line). The Commission discussed their various concems with the location and the proximity of the two (2) driveways on this site. John Levitt (J.E. Levitt Engineers) 726 Commerce, Suite 104, Southlake, Texas, stated that he suggested to Mr. Williamson to place a common access driveway along the west property line adjacent to the T-Bird Nest. He stated that when the T-Bird Nest develops, they will probably close off the 12' asphalt driveway and have a common access easement all the way across to Liberty Bank. Commissioner Creighton stated that she is equally concerned about the driveways and the stacking depths. She stated that if the middle driveway was moved to the far east property line, the applicant would have more ability to have a greater stacking distance. Commissioner LeVrier stated that Mr. Williamson also might think about flipping the locations of his restaurant and bank. Commissioner Edmondson asked Mr. Williamson if there are many trees within the 5' bufferyard along the west property line. Mr. Williamson stated that his goal is to keep the bufferyard as natural as possible and once he gets a tree survey, he will have a better idea of exactly where the trees are located. Vice-Chairman Murphy stated that if the variance is granted for the 5' bufferyard, he would like to see the plantings for the 10' bufferyard placed elsewhere on the site. Mr. Levitt stated that is not a problem. Planner Dennis Killough stated that this whole area is currently under a "Collector Analysis" study and this site may be impacted by this study. He stated that any action taken on driveways and driveway spacings may need to be reconsidered when the site plan comes forward. The property is located in the 2600-block of East Southlake Boulevard, being approximately 600' east of Bluebonnet Drive on the south side of East Southlake Boulevard. He also asked for a variance to Items #4a, #4b, and #4c (driveway spacings and stacking depths). Vice-Chairman Murphy stated that the north driveway on Lot 2 presents a problem because it is too close to F.M. 1709, and it is confusing for people turning into this development offofF.M. 1709. Mr. Myers stated that he agrees and that he will eliminate the drive. Commissioner Creighton stated that she is concerned with the stacking depth on the eastern driveway especially when the tract to the east develops and will share that driveway. Mr. Myers stated that the developer to the east of him will probably have their main driveway on the eastern side of their own property and will use his driveway as a secondary access. Planner Dennis Killough stated that he needs to add a Review Comment #4e which states that the eastern drive of Lot 4, which is east of the proposed driveway, does not meet the spacing requirement from their proposed 50' R.O.W. He said it is spaced at 225' and it requires 500'. Mr. Myers asked for a variance to Items #5a (60' R.O.W. width) and #5b (R.O.W. intersecting F.M. 1709 at 90°). Mr. Myers stated that Mayor Stacy has indicated that anything above 80° is okay. Mr. Myers stated that he would like some flexibility - maybe 85 ° and up.
