2013-02-14 1 CI S OU F TH LAKE TEXAS REGULAR ZONING BOARD OF ADJUSTMENT MEETING: February 14, 2013 Location: Town Hall Council Chambers 1400 Main Street, Southlake, Texas Members Present: Chair Shawn McCaskill, Vice -Chair Phyllis Lambert, Board Members Dustin Andrews, Paul Venesky, and Daniel Kubiak Members Absent: None Staff Present: Dennis Killough, Deputy Director of Planning & Development Services; Richard Schell, Planner II, and Stacey Buller, Board Secretary REGULAR SESSION: Agenda Item No. 1 — Call to Order: Chair McCaskill called the meeting to order at 6:30 p.m. Agenda Item No. 2 — Approval of the Minutes: Chair McCaskill opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on January 24, 2013. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on January 24, 2013, as corrected. Motion: Lambert Second: Venesky Ayes: McCaskill, Lambert, Andrews, Venesky, and Kubiak Nays: None Abstain: None Vote: 5 -0 -0 Motion: Carried Agenda Item No. 3 — Administrative Comments: Richard Schell, Planner II, announced the next scheduled ZBA meeting is March 14, 2013 and there is one (1) submittal for the meeting. Agenda Item No. 4 — ZBA -632, Variance to Ordinance: Variance to Ordinance No. 480, Section 11.5(d) requiring a minimum rear yard setback of forty (40) feet. The request is being made by the applicant, Ray Mulholland, for property described as Lot 9R, Block C, Lakewood Ridge Addition, an addition to the City of Southlake, Denton County, Texas located at 4380 Saddle Ridge Rd., Southlake, Texas. The current zoning is SF -1A Single Family Residential District. Richard Schell, Planner II, reported forty four (44) notices were mailed out within two hundred (200) feet with three (3) responses received. Wilson, Murrell & Sally B (12, 13), 4721 N. Zoning Board of Adjustment Meeting Minutes — February 14, 2013 Page 1 of 2 Planner Schell presented the case to the Board, stating that the variance requested would allow for a rear yard setback of twenty (20) feet instead of the required minimum of forty (40) feet due to a hardship caused by a drainage swale. The applicant, Ray Mulholland, 4380 Saddle Ridge, Southlake, Texas, once sworn in, stated he is requesting a variance to allow the placement of an accessory building approximately twenty (20) feet from rear property line. The applicant would like to maintain the drainage swale and not disturb the natural run off. Vice -Chair Lambert verified that the applicant owns both lots 38 and 39 (on the Surrounding Property Owners map). Planner Schell stated that the parcel data has not been updated and that the lots have been platted into one lot. Vice -Chair Lambert questioned the placement of the existing accessory building on Lot 11 (on the Surrounding Property Owners map). Planner Schell explained that Lot 11 was platted before 1977 and that the proposed building would meet all current zoning requirements except for the rear setback. Board Member Andrews asked if the drainage swale is required by the City. Planner Schell confirmed that it is not and that it is not in a drainage easement. Board Member Venesky questioned the placement of the building in accordance with the adjacent accessory building. Planner Schell verified that the proposed location is within regulations.
