14 Chairman Creighton called the meeting to order and said them has been a request to go into
15 Executive Session. She said there would be an Executive Session held in order to seek the advice
16 of the City Attorney pursuant to Section 551.071, Texas Local Government Code, regarding matters
17 posted on this agenda. The Executive Session started at 6:17 p.m. and ended at 6:43 p.m.

32 MIDDLE/INTERMEDIATE SCHOOL:
33 Comprehensive Planner Ken Baker presented this item to the Commission for a Rezoning and Site
34 Plan on property legally described as Tracts 1, 1 A, 1 C, 1 D, and 3A situated in the John A. Freeman
35 Survey, Abstract No. 529, and being approximately 37.416 acres. The property is located on the
36 west side of South Kimball Avenue approximately 900' south of East Southlake Boulevard (F. M.
37 1709). The Current Zoning is "SF-20A" Single Family Residential District. The Requested Zoning
38 is "CS" Community Service District. The Land Use Category is Public/Semi-Public and 65 LDN
39 Overlay Corridor. The Owner and Applicant is Carroll Independent School District. Twenty-three
40 (23) written notices were sent to property owners within the 200' notification area, and six (6)
41 responses were received with four (4) being opposed and two (2) being in favor. A letter was also
42 received from three (3) South Kimball Avenue residents in opposition. Three (3) responses from
43 outside the 200' notification area were received with all being opposed.

Brent Kline (Total Program Management) presented this item to the Commission. He said they have
three (3) school board members present tonight: Susan Logan, David Yeltin, and Ed Rankin. He
said there are two (2) assistant superintendents also available: Steve Johnson and John Craft. He said
they sent a packet of information to the residents as requested by the Commission and also met with
the residents. He said he thinks they are in fairly good shape, but there are one or two outstanding
issues remaining.
Chairman Creighton asked what areas are still in disagreement. Mr. Kline said the lighting on the
football field is still an issue. He said the lighting pattern itself is not a problem because they are
under 0.25 foot candles well before they get to the property line. He said they have agreed to the
lights in the parking lot being turned off at 10:00 p.m. He said they need the lights to handle the
function of the school for those fields. He said they have 4:30 p.m. games and 6:30 p.m. games
which would be done by 8:30 or 9:00 p.m., and they have discussed a curfew of 10:00 p.m. to allow
everyone time to clear everyone out of there.

Chairman Creighton opened the Public Hearing.
Dennis Minder, 223 EastwoodDrive, Southlake, Texas, said the homeowners want an 8' fence along
the west property plus the bufferyard plantings. He said they also want the trees to be replaced on
site somewhere. He wants the north road deleted offthe school site and said the school agreed to
do that. He wants the construction traffic limited to the north driveway. He said he is in agreement
to the placement of the sewer connection. Mr. Minder said the school agreed to use lights on the
buildings instead of bells to signal class changes. He said the neighbors requested for there to be no
Joint Use on these fields. He said Woodland Heights is in a unique position since it is down in a
valley; they can hear everything that goes on at the baseball school, the old riding school, and
Grapevine-Colleyville stadium on Highway 26. He said their first choice would be to have no
lighting on this field; their second choice would be to place an overall curfew on this facility. He
said the school does not need lights on the field, concession stands, and bleachers for the five games
a year the school claims will be played after dark.
Darrell Faglie, 505 S. KimballAvenue, $outhlake, Texas, said that as a taxpayer, he knows they will
have this school here. He said he asked the school to have the construction entrance on the north
side and said the school was in agreement with that request. He would also like to see the southern
bus loop to be right mm only onto Kimball Avenue so that a median cut does not have to go in that
location. He also asked that the parent loop be moved to the north to facilitate the median cut to
allow for two driveways on the east side of Kimball Avenue. He said he understood in the meeting
with the school that there would be no Joint Use at this school.
Pamela Muller, 214 Westwood Drive, Southlake, Texas, said she opposes any variances to any
ordinances for this school because she spent many long hours helping compose those ordinances so
that no commercial areas or schools or other neighborhoods impose on the peace and enjoyment of

living in Southlake. She asked if Residential Adjacency had been addressed on this plan.
Interim Planning Director Karen Gandy said yes, but they have one 4:1 slope issue on the southern
building.
Ms. Muller asked ifa noise study has been done as far as decibel levels and the impact the games
would have on the decibel level. Ms. Gandy said they have not done a study on the noise level.
Ms. Muller asked if they comply with the HVAC Ordinance. Ms. Gandy said yes; they should be
in compliance.
Ms. Muller asked if the heights of the buildings are in compliance. Ms. Gandy said it appears that
a portion of the intermediate school is about 6' above the slope line. She said the slope line would
also be impacted by the proposed addition of the south end of the intermediate school.
Ms. Muller asked if the Master Drainage Plan has been completed. Deputy Director of Public Works
Charlie Thomas said the drainage is to go to the northwest comer of the property to a detention pond
and from there to F. M. 1709.
Ms. Muller said the point of the Master Drainage Plan was to look at more than just one area; it was
to look at the impact ora large area regarding flow. She asked if this area of town has been covered
yet in addressing the Master Drainage Plan. Mr. Thomas said their drainage plan is proposing to
grade the southwest comer of the tract to their detention pond, and they will send no more water to
the south. Mr. Thomas said it is his understanding they are going to install a pipe from the detention
pond to F. M. 1709 either to carry the ten-year or twenty-five-year storm with the remainder being
detained and then flowing overland; there would be no open ditches. He said the applicant must
secure easements from their property to F. M. 1709, and they will have to work that out with the
other property owners.
Ms. Muller said she would like to see that addressed if the Commission chooses to approve this item.
She would like to see the water carded underground instead of being left as an open ditch.
Ms. Muller said Kimball Avenue is completely inadequate to handle buses and asked what plans the
City has to improve it. Between Crooked Lane and Heritage Business Park, Mr. Thomas said
Kimball Avenue is presently designed as a four lane divided roadway, and construction will be done
this year. He said the engineering designs for the section between F. M. 1709 and Crooked Lane will
be done this year with the construction in next year's capital improvement program, and it will also
be a four lane divided roadway.
Ms. Muller asked if the improvements will be completed by the time these schools are planned to
open. Mr. Thomas said that is the plan; they plan to be finished by 2001.
Ms. Muller asked if the school could have a Certificate of Occupancy before the road is completed.

Mr. Thomas said he supposes they could but thinks it has been discussed between the City and the
school district that the existing Kimball Avenue could not handle the amount of traffic generated by
the schools.
Ms. Muller said she cannot stress enough how important that is. She said Kimball Avenue is a little
two-lane road with barditches, and it would be very unsafe.
Regarding lighting, Ms. Muller said the topography of this property is unique because it raises,
lowers, and then raises again. She said the lights will have an impact on the adjacent properties. She
said the lights may not light the adjacent properties, but the glare will definitely impact the homes.
She said there is an alternative because a new stadium is being built less than a mile away and if
there is any need for night games, they could certainly be played at that stadium.
Ms. Muller said the school district has also purchased property on Highland Street for a school. She
is deeply concerned again that they are locating a school under a flight path. She said she hopes and
pleads to the school district to look for another alternative. She said these two current schools are
not directly impacted with flyovers all the time but said she wanted to give the Commission an
exhibit of jet departures offthe northwest runway anyway. She said these two schools will require
certain noise abatement designs in the buildings even though they are not directly under a flight path.
She said jets lose flaps and pointed out that it happened less than a year ago in Piano. She said she
is disappointed in the school board for not taking this under consideration.
JeffWang, 595 S. KimballAvenue, Southlake, Texas, said the neighbors agreed for the school district
to reduce parking in order to preserve more green area. He said Mr. Kline promised in a meeting
in December that the south driveway would be fight-in/right-out only and now he is not agreeing to
that. He expressed his concern regarding the median cuts on Kimball Avenue and said Mr. Kline
keeps saying that the school district has no control over the cuts. He said the school is not built yet,
and the school district needs to compromise. He said he wants construction traffic limited to the
north driveway. He said he wants Kimball Avenue widened before a Certificate of Occupancy is
issued to the school. He showed the Commission a diagram of how he would like the median cuts
placed. He said the City does not have a final design for Kimball Avenue yet but it must be a
compromise to the existing traffic and driveways.
C. E. Dorris, 213 EastwoodDrive, Southlake, Texas, said he is not opposed to the school having a
practice field, but he does not want there to be lights or a speaker system on it. He expressed his
concern regarding the drainage. He said they should have a large, underground storm drain to take
care of the water rather than dumping the water on someone's property.
Pattie Minder (SPIN #8 Representative) 223 Eastwood Drive, Southlake, Texas, said Eddie
Cheatham, the engineer for the project, is in the audience and asked if he would ad&ess the drainage
issues.

Chairman Creighton said she would like to hear from Eddie Cheatham and from someone on the
school board regarding the Joint Use issue.
Eddie Cheatham (Cheatham & Associates) said they have had a number of meetings with the City
and the adjacent property owners regarding drainage. He said they are proposing to take the water
from the northwest comer of the site into the detention pond because the detention pond is sized to
detain the increased mnoffthat they are generating by building the school. He said they have been
working with the property owners to the north to grade the northwest comer of the school site onto
their properties. He said they have looked at a number of options to get the water from the northwest
comer to F. M. 1709. They have looked at placing a 36" to 40" pipe north to carry the low flows and
the ten-year storm with the remainder of the water flowing as it does today. He said they are
working with the adjacent property owners along the way and making sure everyone knows what
is going on. He said there will be a 15% decrease in the amount of water that goes onto the northern
properties after the school goes in as compared to what is there today. Mr. Cheatham said the pond
will be graded with a fairly steep grade so that there will not be a flat bottom which could be a
maintenance problem for the school. He said the pond will be landscaped along the west side, and
they are proposing a concrete pilot channel right down the middle of the pond which will catch the
small flows and will keep the bottom of the pond so that the mowers can get in there and keep it
maintained and looking nice. He said the school district does not want an eyesore right behind their
schools anymore than the residents do. Mr. Cheatham said they have looked at the option of
completely going underground with an enclosed system that would carry all the flow underground,
but the cost of doing that would be prohibitive for the school district to bear the total cost. He said
they have discussed the option of sharing in the cost of the underground system with the northern
property owners since it would make their properties more developable.
Commissioner Sandlin asked what the depth of the detention area will be. Mr. Cheatham said it will
be approximately 6' deep at the lower end.
Vice-Chairman Peebles asked if their detention will hold 100-year flood, and Mr. Cheatham said yes.
Commissioner Boutte asked if Mr. Cheatham has given an accurate description of the water flow in
the City's opinion. Mr. Thomas said yes but what hasn't been done is all of the construction details
with actual pipe sizes and things like that. He said the overall plan of the detention pond retaining
their increased runoff on this site and taking the southern portion of water into the pond are proper
ways to develop a site. He said they still have to work with the property owners to the north to
obtain easements and determine exactly how they are going to construct across those properties. He
said all of the details have not been worked out, but the system and the plan is proper.
Commissioner Sandlin asked if someone could articulate why they don't want the road to the north
anymore. Mr. Kline said they are putting in the loop around the school. He said the future street
extension was dashed in and they were never intending to put the right-of-way in there. Once the

1 group to the north develops the right-of-way plan for that street, the school has provided space for
2 that to happen because they see a benefit for the school to allow buses to come in that way. He said
3 it was never a right-of-way in the first place, it was just space left open. He said the neighbors did
4 not want the dashed line on the plan to give any indication that it is set in stone so the school agreed
5 to remove the lines.

Mr. Kline said one of the neighbors mentioned the bufferyard. He said the school has never said
they were asking for a variance on the bufferyards. He said once the fence on the west property line
goes up, the bufferyard will still go in. He said they have approximately 1,200 trees to go on this
property, and they will need every square inch they have to place those trees. He said they will get
as many trees as they can on this site, and any remaining trees will be placed on other school
properties. He said they agreed to keep the construction entrance on the north side. He said they
agreed to a light system instead of a bell system for the changing of classes. He said they agreed to
leave a sewer connection at the northwest comer so that any neighbors who wanted to could connect
at that point. In his opinion, the lights for the ball field and the bleachers need to be there.
Commissioner Sandlin asked about the lights being turned off at a particular time. Mr. Kline said
they are fine with the lights being turned off at 10:00 p.m. just like Bicentennial Park.
Chairman Creighton asked about the neighbors wishes of an absolute curfew with nothing going on
at the school after a certain time. Mr. Kline said they do not see any reason to place a curfew on
anything going on inside the buildings. Just like they do at the other schools, he said they have
agreed to mm off any parking lot lights at 10:00 p.m., but the security lights around the buildings
would remain on.
Commissioner Sandlin asked if they meet the Lighting Ordinance requirements. Mr. Kline said the
two issues regarding the lights on the field are the footcandle levels and the types of lights. He said
the lights they are proposing are white lights versus orange lights.
Chairman Creighton asked Mr. Kline about the concession stands. Mr. Kline said the concession
stands obviously need to be there along with the bleachers; once people are inside an area for a
game, they do not want people going back and forth from the school to the field.
Chairman Creighton asked the school's response to the homeowners' statement regarding night
games being played at the larger stadium.
Dr. Ted Gillum (Superintendent for Carroll tS.D.) said they plan to build three middle schools.
They play their games on Monday and Tuesday nights and since there are three schools all playing
on the same nights, they can't ail play at the same locations. He said they need the fields with lights
to operate their programs. He said the games should be over by 8:30 p.m., and they see no problem
in turning the lights off at a set time. He said 10:00 p.m. would be a very appropriate time to allow
coaches and players time to leave.

Dr. Gillum said in his opinion he does not see the issue of whether it is or whether it isn't Joint Use
really being a function of this school and building this school. He thinks that is an issue that needs
to be decided between the City Council and the School Board. He said it does not impact the
operation of their program except for scheduling issues. He thinks it is a separate issue that needs
to be addressed at the City Council/School Board level.
Chairman Creighton questioned if the School Board could articulate why they want Joint Use or why
they feel they need Joint Use.
Susan Logan (Carroll ~S.D. School Board) said the Joint Use issue needs to be a Board issue and
they need to talk to the City before they meet. She said the Board needs to meet on the issue. She
said they had a Board meeting Monday night, but the agenda was already set. She said this is a very
serious issue because it will impact the children of Southlake for years to come. She said she has
found no consensus in speaking to Boardmembers individually on a casual basis. She cannot speak
for the Board because they have not met.
David Yeltin (Carroll I.S.D. School Board), 1346 Lakeview, Southlake, Texas, said he would not
want to see anything done to limit Joint Use projects in the future. He said anything done tonight
might put a limitation on Joint Use, and it may be a foolish limitation in the future.

Vice-Chairman Peebles said it is his understanding that this cannot become a Joint Use facility until
such time it passes City Council. He said he would be inclined to leave it out of the zoning and let
it come up when the Joint Use issue is presented to City Council for approval.
Mr. Kline said they have met with several of the neighbors on the east side of Kimball Avenue
regarding the driveway cuts and median cuts. He said they can move the parent loop driveway up
a little to line up with the Johnson's driveway. He said he stated in the meeting with the residents
that he would need to confer with his traffic consultant regarding traffic movements of the southem
driveway. He said his traffic consultant said it was safer to have all three traffic movements (right
in, left out, right out) provided for on the southern driveway. He said the issue of the placement of
median cuts will be determined by the City's study on Kimball Avenue.
Tracy Henry (traffic consultanO said the predominant reason they have the driveway as both left out
and right out is because they are trying to avoid on site turning around of the buses. She said
approximately 50% of the buses will go north and 50% will go south.
Commissioner Home asked Mr. Wang if his primary concern is a bus turning left out of the school's
driveway as he is trying to tum left out of his driveway. Mr. Wang said that is one of his concerns.
He said since his children cannot go to Southlake schools and must go to Grapevine-Colleyville
schools, his wife must make a left-hand turn in the morning to take the children to school. If there
are buses mining left out of the school driveway, he said his wife will never get out of her driveway.

Commissioner Home said he has not heard anything about signage. He said if the school buses have
a sign as they come out of the driveway it may help the problem.
City Attomey Debra Drayovitch said she does not believe the islands have been designed yet. She
said the islands are part of the street that is entirely within the management of the City and its
Department of Public Works.
Vice-Chairman Peebles asked if the school district was allowed to proceed forward with the
driveways as shown and it got to be a problem, would there be room to put in a right turn only
island.
Mr. Thomas said if this plan is approved allowing no left tums out of the southem driveway, then
they have to design the median opening in such a way that traffic can mm left into the driveway but
no traffic can tum left out of the driveway.
Commissioner Sandlin asked who came up with the idea of having medians on Kimball Avenue in
the first place. He said he does not understand why Kimball Avenue is shown as a boulevard with
medians. Mr. Thomas said our Master Thoroughfare Plan shows a four-lane divided section.
Mr. Thomas said raised medians with left turn lanes are much safer than a continuous left turn lane.
He said a driveway could be designed with a pork chop that allows right out only traffic but also
allows for right in and left in traffic.
Vice-Chairman Peebles asked if there is room for a pork chop on the southem driveway as it is
currently shown. Mr. Thomas said yes, it could be designed in such a way as to accommodate a pork
chop.
Vice-Chairman Peebles asked if the Commission approved it like it is shown, would there be
flexibility to come back later and add a pork chop if it needed?
Mr. Faglie said he will not have a median cut for southbound traffic from his driveway as it shown;
he will have to go north and make a U-turn and then go south. He said he is willing to move his
driveway north in order to share a common driveway with Mr. Wang.
Ms. Gandy said when she was looking at the plan today she noticed the required parking appears to
be 458 spaces because they need to consider the additional 250 seating capacity for the stadium. She
said if they grant a 10% variance that will be about 45 spaces so they will still be about 15 spaces
short. Mr. Kline said they agree to remove the Future Bleachers offthe Site Plan and if they want
to add those in the future, they will come back for approval.
Mr. Minder said after reviewing Table 'C' regarding lighting, they are showing 150' from the football
field to the property line but if you look at the plat, it is actually 136' from the property line to the
edge of the lights so there is at least a 16' discrepancy. Mr. Kline apologized and said that after

talking to Howard Vestal of VLK Architects, they will agree to redo the drawing.
Howard Vestal (VLK Architects) said the lighting on the football field will comply with the Lighting
Ordinance. He said if the 16' discrepancy exists, they will correct the drawings to comply with the
ordinance. Mr. Kline said the lighting will degrade by the time it gets to the property line to be in
the 0.2 to 0.25 footcandle level. Mr. Kline said they will comply with the footcandle level at the
property line.
Ms. Muller said she understands there are excess trees that won't fit on this site and suggested
placing those trees either in the Woodland Heights subdivision or in the median which would help
to provide a buffer for the residents.
Commissioner Home asked if the trees could be placed in the median. Mr. Thomas said the school
is proposing to dedicate additional right-of-way to provide for a wider median than normal. He said
the City normally builds a 14' median, and the school is discussing a 24' median so there would be
room to plant trees.
Commissioner Sandlin said if the school district finds there is not enough room on this site, he
agrees that it would be a good idea to plant the trees on another school site.
Ms. Muller said she did not see the Master Trail Plan addressed on the school's plan. Ms. Gandy
said it is her understanding there will be a trail on the west side of Kimball Avenue and the school
district wants to pick up the trail and meander it through their sidewalk area and then continue
northward. She thinks they have addressed it, but she does not think the Parks Department really
prefers it that way; they prefer it in the right-of-way.
Ms. Muller said she thinks the agreements pertaining to lighting have been left a little vague. She
suggested that the lights be used no later than 7:00 p.m. Monday through Friday and not at all on
Saturday and Sunday. She suggested that the lights be used no later than 9:00 p.m. one day a week,
Monday through Friday but not more than five times per school year. She also asked if they could
tilt the lights down more so that they won't be angled towards the residential properties.
Motion was made to approve ZA 99-120 subject to Site Plan Review Summary No. 1, December
3, 1999, as per the following:
· deleting Item #5 to allow vertical and horizontal articulation as shown;
· modifying Item #6d, granting relief from constructing parking islands in the parallel parking
spaces only;
· on Item #8, granting relief on the following lighting standards for the stadium: allowing 30 foot
candles instead of the required 20 foot candles and allowing white light instead of the yellow
light and acknowledging the applicant's commitment to comply will all other provisions of the
lighting ordinance;
· on Item #9, accepting the applicant's decision to remove the 250 Future Bleachers from the west
side;

therefore bringing the existing required parking into compliance;
and with the following additional conditions: accepting the applicant's commitment to use lights
rather than bells to announce class changes;
that Joint Use of the facilities be subject to City Council's decision;
accepting the applicant's commitment to move the southern parent loop driveway to the North
to comply with the 250-foot spacing requirement and to better align with the Johnson's driveway
across Kimball Avenue and reserving the right for the city to later require the construction of a
"pork chop" in the southernmost drive (restricting the traffic movements) should circulation and
safety concerns arise in the field;
· acknowledging that the drainage will flow to F.M. 1709 and that the current runoff to the north
will be reduced by 15%;
· deleting the northern circulation road from the plan;
· requiring the bufferyard on the West;
· requiring the planting of as many required trees on the site as directed by the Landscape
Administrator and then plant any "leftover" ones in the Kimball medians and any others at other
school locations;
· requiring that all construction traffic use the northernmost driveway;
· acknowledging that the lights will be turned off at 10:00 p.m.;
· acknowledging that the HVAC system will be screened from adjacent properties;
· and acknowledging that a sanitary sewer connection will be made available in the northwest
comer of the site and that neighboring properties may tie on at the neighbors' expense.
