Ordinance No. 392, establishing September 17,1987 as a regular meet- ing of the Southlake City Council. The Mayor explained that the budget and tax rate must be approved during a regular meeting. Due to the time frame, the city attorney prepared Ordinance No. 592 which establishes this meeting as a Regular City Council Meeting. Motion was made and approval given to the approval of Ordinance No. 392. Approved S-0 vote. Ordinance No. 392 establishing September 17, as a regular meeting of the City Council as an emergency ordinance. Appr~oved 4-1 vote. PAGE: INDEX Bill Spivey questioned if City Council is using an emergency ordinan. ce to qualify this meeting as a regular meeting. Mr. Boyle, City Attorney answered that Council is not considering a tax rate ordinance or a budget ordinaJce as an emergency ordinance. Southlake has already had the first reading of these ordinances, we are considering the 2nd readings tonight. Mr. Spivey wanted the minutes to reflect that he protests this as a regular meeting, as it is not in acco: dance with the City Charter. Consideration was given to Ordinance No. 364 Fiscal Year 1988 Budget, 2nd reading. Mayor Westerholm read the caption of the ordinance. Public Hearing Bill Spivey asked who is required to pay personal property tax. Answer: Only businesses. Motion was made and approval given to Ordinance No. 364 FY88 Budget. Approved 4-1 vote. NO. 364 Ordinance No. 565 Tax Levy, was considered for 2nd reading. This ordinance provides for tax rate of .53~ per $100o valuation. Mayor Westerholm read the caption of the ordinance. Public Hearing Bill Spivey reminded the City Council that this is not a regular meeting under the city charter. ORDINANCE NO. 365 NAME OF COUNCILPERSON CiTY OF MINUTES MEETING. DATE: TIME: PLACE:. PAGE: 5 INDEX Curry Springer McMahan ~ooll Stacy Motion was made to approve Ordinance No. 365, Tax Levy for FY 88. Approved 4-1 vote. Ordinance No. 372 annexation of land ORDINANCE into the City of Southlake was NO. 372 discussed. Mayor Westerholm asked for public comments on the proposed ordinance. Bill Spivey- Tract 19 Asked the City Council to consider adopting an ordinance allowing for grandfather clauses, giving the City Council the option to zone businesses mobile homes, and things that are contrary to present zoning ordinances He asked that City Council pass this ordinance before the second reading for annexation. It would make folks feel better toward the city council. Doris Downard- Tract 19 Confused about the ordinance numbers and tract numbers as they appear on the agenda. Mayor Westerholm read the tract numbers being considered in Ordinance No. 372 and the other ordinances on the agenda. Dave Winters Tract 5 Questioned legal notices, were they met. Answer: yes. Comments on zoning ordinance amendments. Mr. Boyle explained the process in applying for amendments to zoning ordinances in conjunction with the annexation ordinances. Virginia Thomas- Tract 16 Wants to know if Southlake has a weed ordinance and if the Whiteners property is currently in the city. NORTH CARROLL AVENUE, SOUTHLAKE TEXAS. PAGE: 4 INDEX Councilperson Stacy explained that Code Enforcement is on a complaint basis only. People must call in and let the city know about the violation James Morgan Tract 19 Is Ordinance No. 372 to vote to annex all property? He remembers several City Councilmembers stating they Want to vote on each tract separately Motion was made and approved to disapprove Ordinance No. 372. Approved 3-2 vote. Motion was made and approval given to reconsider the last action, which was to disapprove Ordinance No. 372. Approved 4-1 vote. Motion was made to change the order of the agenda, moving consideration of Ordinance No. 372 to the end of th agenda. Approved S-0 vote. Mayor Westerholm stated he will address each Ordinance individually and will open the public hearing now for any of the ordinances pertaining to annexation. '\ Public Hearing Bill Nelson- Tract 21 He has a complaint on the City Counci meeting. He feels when Council and the Mayor have consultations with the City Attorney, or each other, the audience should be able to hear. Linda Morgan- Tract 19 She wants all the City Council to giw theirrational on why they are voting to annex or not to annex Tract 19. James Morgan - Tract 19 He has a question in moving agenda item #3 to the end of the agenda. Bill Spive¥- Tract 19 When an ordinance is voted down, is there a delay time before it can be reconsidered? Answer: no. Public Hearing closes. Motion was made to table annexation ordinances, time certain October 6. Reason stated is because this is listed as an emergency on the agenda and it is not believed to be an emergency. Approved S~0 vote. Councilperson Wooll stated he agrees it i~ not an emergency, and he is uncomfortable that we are rushing the process.
