INVOCATION: Johnny Westerholm. The Minutes of the Special City Council Meeting held on December 15, were approved as corrected. The Minutes of the December 16, Regular City Council Meeting were also approved as corrected. MAYORS REPORT: There were no items the Mayors Report. discussed during ZA 86-71. A request was made for a Special Use Permit for the Sale of Off Premises Packaged Beer, for the Jellico Corner Shopping Center. The property, a 4.39 acre tract.of land is out(\of the J.G. Allen Survey, Abstract 18. The request was made b Jim Martin, and Lucky Lady Oil Company. Attorney, George Staples was present representing Mr. Martin. He introduced the Lucky Lady, Sue Jackson, owner of the convenience store, who was also present. Staples noted that a request was made for Off Premises Packaged Beer, about six months ago and it was denied based on traffic on FM 1709. ZA 86-71 E OF 'COUNCILPERSON CITY OF SOUTHLAKE, TEXAs. PAGE: 2 INDEX --Curry McMahan Stacy Westerholm Mr. Staples supplied the Council a copy of a traffic study which was prepared by Mr. Orcutt, Traffic Engineer, to provide facts concerning traffic on FM 1709 and FM 1958. Mr. Orcutt answered questions for Council on the study, which is apart of the record. ~ill Stoner, Chairperson of the Plan- ning and Zoning Commission, informed Council that the P ~ Z recommended approval of the Special Use Permit. PUBLIC HEARING: Pamula Muller- in favor of the permit being issued as improvements have been made to FM1709. She does not want Martins to be discriminated against. When asked how soon Lucky Lady would need the permit, she answered, '!po more than 60 days." Ms. Jackson stated she feels 20% of her sales will be beer and that she intends to have the store open from 5 a.m. to 12 midnight during the wee and 7 a.m. to 12 midnight on Sundays. Councilperson Curry stated he has a problem with the traffic on FM1709, however, if the city had approval of a i~affic light in that area, he would feel better about the request. · Mr. Orcutt stated he has not talked to the State Highway Department abou~ the improvements he has recommended in his study. PAGE: $ INDEX Resolution 86-71 was discussed, allo~ ing for additional Security Lights at Bicentennial Park. City Administrator, Larry Munsie recommended the additional lights be looked at in FY88 Budget. Motion'was made and approved to remove from the agenda. Resolution 87-1. Authorization was given for the purchase of two Scl0 pick-up trucks, one for a Meter Reader, out of the Water Fund and one for the Building Inspector, to be purchased out of the General Fund. Both, budgeted items in FY87 Budget. The bids were opened on January 6, at $ p.m. and were advertised as per V.T.A.S. Low bidder was Graff Chevrolet at a purchase price of $ 8,228. each. Motion was made and approved for approval of Resolution 87-1. Resolution 87-2. Authorization was requested for the purchase of four (4) vehicles. Three Police cars, and one Fire Chief car, as per capital equipment in the FY87 Budgetk As a result of the bid opening, also held on January 6, low bidder was Payton-Wright Ford. Bid was for Ford Crown Victorias, four door sedans at a purchase price of $11,424. each. PAGE: 4 INDEX David McMahan stepped down for the next four agenda items as having a vested interest. An affidavit of conflict of interest is attached to the minutes. ZA 86-65. Zoning request for a 259.989 acre tract of land out of the A.A. Freeman Survey, Abstract ~22, T.M. Hood Survey, Abstract 706, and the L.G.B.Hall Survey, Abstract 686 was considered. Current zoning is Agricultural, request is for the SF3 Single Family Zoning District. The request is made by Belgian American Investments. David McMahan made a presentation in behalf of Belgian Amercian Investments, as did Joe Corkland, Director of Planning for the Invest- ment Group. During the slide presentation, Cork- land stated the property is 2 1/2 miles south of IBM property and will consist of 91½% residential development. PUBLIC HEARING Billy Jon Curb. Stated that SF3 Zoning is the lowest zoning for residential, the presentation shows large'homes, why not SF1 Zoning if not to get away with lessor requirements. He feels it should be SF1 Zoning District. Lloyd Martinson- Stated Longhorn Drive will empty in front of hi~ property. He says traffic is a greal problem and the hill is still there. What about the easement om FM1709- he is afraid it will all be taken off his property. He is not opposed to SF3 for 259.989 acres, he is objecting to the read. He asked that Council table the item until the problems are worked out concerning the 30' strip they have shown on the plat that concerns his property. McMahan stated they will work the · problem out with him. Neil Ingle- Stated there are sewer problems in Cross Timber Hills Addi- tion, what type problems will this addition have? Water lines are also a problem, what is the time table on improvements to FM17097 Are we going to add to FM1709 traffic problems? He is opposed to zoning without water and sewer and that he would not be opposed if water and sewer are provided first. Mayor Latta indicated we cannot stop development while waiting for the State Highway Department to complete FM 1709. Virginia Clow- No objections to SF5 Zoning District. Melissa Cedars- Concerned over SF5 ZoninG· Bill Stoner stated the P ~ Z Commission voted in favor of the request. He added that there~were no objections to residential zoning from the public at the P ~ Z meeting. Sketer Bailey called in and was not objecting to zoning, but wants to work with the developers concerning his property. Motion was made to approve the zoning to SF3 for the 259.989 acres. The property is owned by Belgian American Investments. PUBLIC HEARING Lloyd Martinson- Opposed. He stated this is a residential area. This rezoning would get into Spot Zoning. Sewer problems will be created by too much concrete. He is against any commercial in the area. Virginia Clow- We need commercial in that area. She stated the origim master plan showed commercial for the four corners. She is in favor of the zoning request. Stoner stated P 5 Z vote was three in favor and three opposed. Motion was made and approved to to Retail 2 as there is no basis turn down the request. to ZA 86-67 Zoning request for a 5.04 acre tract of land, Present zoning is Agricultural, request is for 01 Zoning District. It was noted all land will be deed restricted. PUBLIb HEARING Lloyd Martinson-' Opposed. He feels he has lost his privacy. He is also concerned over drainage in the area. Virginia Clow- In favor. She stated we all need to think of what is best for the city and not for ourselves as individuals. Stoner stated the P & recommended denial of 01. Also, due to the fact that Shady Oaks has recently been turned down for Commercial. Mayor Latta stated it will t~k~ a vote of 5 in order to turn t~e decision of the Planning and Zoning Commission. Motion was made to approve ZA 86-67 to Office 1. Request was denied for 01. ZA 86-68 The preliminary plat for a 284.669 acre tract of land to be known as Old Southlake Ranch was presented in Phase I and Phase 2. David McMahan stated with the planne¢ green belt and recreation areas, Belgian American is setting a presi- dent in the area. The homeowners association will pay for maintenance in the greenbelt areas. PUBLIC HEARING Billy Jon Curb- What is planned for primeter streets? He is concerned that in a phase by phase development: if we don't look at it as a picture and determine that all roads are planne~ for, we may not have a good plan. -He feels that with large developments, a plan needs to be worked out with the School Board for new schools. Lloyd Martinson- Opposed to Longhorn Drive, and also that the subdivision is infringing on his privacy. He stated that sewerage is a problem as the percolation is not good in that area. DATE: January 6,1987 TIME: 7:$0 p.m. PLACE: CITY COUNCIL CITY OF SOUTHLAKE, COUNCIL CHAMBERS 667 NORTH CARROLL AVENUE, SOUTHLAKE TEXAS. PAGE: 8 INDEX Fred Jo¥ce- He will consider the layout on Peytonville Avenue on the final plat. He also speaks for his nephew, LeRoy McCain. Nell Ingle- He asked if Peytonville Avenue will be curb and gutter. McMahan answered that the interior streets will be guttered except for a small section of Peytonville by th~ Ingle Home. Ingle is in agreement with the plat except for Lot 1, Block E. Virginia Clow- In favor. Stoner stated that most of the comments at P ~ Z meeting were in regard to drainage. The commission is concerned over a drainage problem in the south portion of town. This plat will set the tone for the south side of town and how the city will handle drainage. Traffic on FM1709 was also a concern. Stoner stated he personally voted against the plat because of the pond on the greenbelt and the retension pond and the improvements to Peytonville Avenue. P and Z vote was 5-1 in favor. Cheatham review letter dated 12-5-86 was discussed. McMahan pointed out that most comments have been already met and they are working with Cheatham on the rest of the comments. It was suggested that a road be stubbed Out to the east for future development. The right-of- way on FM1709 has not been considered at this time. Motion was made to approve the preliminary plat based on the fact that the drainage study will be approved for all the subdivision before approval of Phase 1 will be given. PUBLIC'FORUM Paumla Muller- Stated she was concerned that a member of the City Council has passed along a false statement concerning the Airport Board. The rumor included that the airport committee was offered 10% usage of the runway by the Airport Board and turned it down and choose to go the legal route.
