1988-10-18 CITY OF SOUTHLAKE 667 N. Carroll Avenue Regular City Council Meeting October 18, 1988 7:30 p.m. MINUTES Present: Mayor, Johnny H. Westerholm; Councilmembers: Springer, Sally Hall, Jim Wooll, Ralph Evans and Pam Muller. Betty City Staff Present: City Manager, Curtis E. Hawk; Director of Public Works, Bill LeGrand; Fire Chief, Bob Steele; Finance Supervisor, Renee McCarty; City Engineer, Eddie Cheatham; City Attorney, Adrienne Leonard. Invocation: Ralph Evans The meeting was called to order by Mayor Westerholm. The minutes of the October 4 and October 11, were approved as presented. Motion: Evans Second: Muller Ayes: Evans, Muller, Hall, Springer and Wooll Nays: None Approved: 5-0 City Council meetings Agenda Item #3, Mayor's Report Mayor Westerholm announced that the TML Conference will be held in Dallas this year on November 3, 4, and 5. Councilmembers are urged to attend. For further information contact the City Secretary. Agenda Items #4 & #5, City Manager's Report-Dept/Financial Curtis E. Hawk, City Manager summarized the department reports, as well as the monthly financial report. Bob Steele, Fire Chief, reported on Fire Prevention Week. "Sparky" was in attendance as well as a "big sparky" with costume being purchased with donations. Agenda Item #6, 2nd Public Hearing Re: Annexation Mayor Westerholm reviewed the process of annexation stating all property finally annexed shall be zoned Agricultural on a temporary basis pending zoning of the property on a permanent basis in accordance with state zoning statutes. City Council Minutes October 18, 1988 Page 2 Item #6, Annexation, continued Councilmember Sally Hall stated that since the 1st. public hearing, she has obtained information on statistics concerning costs for fire and ambulance service to the City and to the taxpayer. A fire run cost to the City is $333.40 and cost to taxpayer is $133.67. An ambulance run cost to the City is $685.34 and to the taxpayer is $99.60. The City passes services onto the taxpayer at a reduced cost. Public Hearing: Robert Downard - 1255 Randol Mill Ave. He was annexed last year and was not happy at the time. He has become a City Council watcher. As a citizen, he opposes the annexation at this time. Mary Munson - Rt. 1 Florence Rd., Tract 16. She asked what type of streets are in the plan - are private roads in the City plan. If not, we would not be helping them. She is against annexation. Bob Couch 2535 Union Church Road, Tract 13B. Southlake does have a good fire department, however, it costs as much running the equipment as not running the equipment. The City Council's concept that they provide anything for him is wrong. He does not need anything from Southlake and is not in favor of annexation. E.M. Baggett Southlake. Rt. 1 Box 58, Tract 13B. He does not want to be in Royal E. Smith - 300 Timber Trail, Tracts 14 & 16. He thanked the City Manager and Director of Public Works for coming to his home and agreeing to try and work with him in moving the rocks and possibly doing bar ditch repairs. He was impressed by Sally Hall's information on the fire department. No one has ever said they want to be annexed. He does not want to be in Southlake and have Southlake control his farm. Janice Johnson - already decided hearings? What down her throat. Rt. 1 Box 224, Roanoke, Track 16. If the City has they are going to be in Southlake, why the public good are they? She does not want Southlake shoved She does not want to be in Southlake now. Bill Henderson - 700 Cimarron Trail, Tract 16. We fought the "wars" for freedom. This is not freedom. Southlake is trying to force him to give the City money. He does not need our services and does not want in the City. Councilmember Wooll stated it is important that the cities exercise their right by annexing area in their ETJ. Councilmember Springer commented on the water tower situation on Florence Road. Locations of water towers are governed by the pressure planes of an area. It was not located there to offend anyone. City Council Minutes October 18, 1988 Page 3 Annexation - Public Hearing, continued Mike Eagleston - 709 Overland Trail, Tract 16. He came to the area because of no City taxes. What will change for them when they are annexed. His children go to Keller schools. What is the Mayor's vision for the City so that they will all know what they will be in for. Mayor Westerholm sees the City of Southlake as a "Key" city in the metroplex. "We are in a key position" with IBM complex, Perots, Hunts, transportation hub, Hwy 114 and FM 1709. Our area is a good place to raise kids. It's rural, it has conveniences. We are looking at a good tax base. We are glad to have IBM and would like to have GTE. Wayne Edwards - 624 Overland Trail, Tract 16. Asked questions about police protection, water service, sewer system. Questioned the service plan and the time limit for services to be implemented. He cannot see anything he would gain by the annexation. Cindy Walbridge - 704 Cimarron Trail, Tract 16. She is opposed to annexation. She does not like the restrictions, compared to what they will have to pay for services. When will they have services? Ken McMann - Vista Trail Est., Tract 16. He commends the new City Manager, but wonders when are we going to get the police department in order. Southlake has a good fire department. Questioned sewer system. He is not proud of the post office, when is Southlake going to get a post office? Joy Clark - 755 Randol Mill Rd. She was annexed into Southlake in October 1987. She does not want more people in Southlake. The current citizens do not want more people in Southlake. The City Council needs to listen to the citizens. Marsha Palla - 1207 Cross Timber Dr. She stated if you are a citizen you will be made to hook up to the sewer at about $4,000 each plus hook-up fees. She does not blame the people for not wanting to be in Southlake. Kevin Learner 716 Overland, Tract 16. He is not a rebel rouser or trouble maker, but we are infringing on his rights. What are we going to do for him. Is there anything he can do to stop it? He is opposed to being annexed. Leland Burg Union Church Rd., Tract 13B. He is opposed to annexation. There being no further comments, the public hearing was closed. City Council Minutes October 18, 1988 Page 4 Agenda Item 915, Res 88-94, Draft Annexation Ordinance Resolution 988-94, authorizing the city attorney to draft ordinances annexing certain territory into the city limits of the City of Southlake, was discussed. It was agreed that each tract of land will be a separate ordinance and voted on individually. Motion was made to approve Resolution 88-94. Motion: Hall Second: Springer Ayes: Hall, Springer, Evans and Wooll Nays: Muller Approved: 4-1 Agenda Items, 11, 12, 13, 14, 16, and 17, Consent Agenda Items Mayor Westerholm read each item considered for consent agenda. They include: Item #11 Resolution 88-90. Naming an Acting City Manager according to Section 4.15 of the Home Rule Charter. Item 912 Resolution 88-91. Authorizing the Mayor to execute the renewal agreement with Tarrant County for the collection of taxes in the City of Southlake, Tarrant and Denton Counties. Item 913 Resolution 88-92. Authorizing the Mayor to execute the renewal agreement with Tarrant County for the Food Establishment Surveillance Program. Item 914 Resolution 88-93. Authorizing the Mayor to execute an agreement for Land Lease. Item 916 Resolution 88-96. Urging the State of Texas to accept its prisoners presently housed in Tarrant County jail into Texas Department of Corrections. Item 917 Resolution 88-97. Authorizing the Mayor to enter into an Inter-local Assistance Agreement with area cities for Tarrant County Arson Abatement Program. Motion was made to approve the consent agenda items. City Council reconvened at 9:50 p.m. Agenda Item #7, Ord 451, Amending Ord 334, SP1 & SP2 Ordinance #451, 1st. reading amending Ordinance ~334, to clarify the intent of Section 5.18 and 5.19 relating to SP1 and SP2 Site Plan Districts. A discussion was held concerning the amendment. The recommendation from P & Z was to approve the ordinance with the addition of "similar uses" in the 1st. whereas clause on page 2. Public Comments: Joe Bentley 214 Westwood Drive. He explained the reason for the request as he heard Bill Spivey explain at the last P & Z meeting. Mr. Spivey went to a lender to borrow on his property which was annexed into Southlake in October 1987, only to find that the SP1 and SP2 zoning created a category of zoning that put a lid on his ability to borrow against his property. We know that that was not the intent of the ordinance. Jim Martin - Jellico Corners. He stated Bill Spivey has a financial problem. When the appraiser came to evaluate his property, it was reported to be 1/2 million dollars short of previous appraisals. He only wants the ordinance changed to allow for similar uses and that will satisfy the lender and he can get his financing. Motion was made to table Ordinance #451, 1st. November 1, 1988. Motion: Wooll Second: Evans Ayes: wooll, Evans, Muller, Hall and Springer Nays: None Approved (to table): 5-0 reading, time certain Agenda Item #8, Ord 334-44, I-2 Zoning Request, West Continental Ordinance ~334-44 (ZA88-31) 1st. reading was discussed for the request for zoning a 3.001 acre tract of land out of the T.J. Thompson Survey, Abst. 1502 more commonly known as 2030 W. Continental. The current zoning is Agricultural with a request for I-2 Zoning District. Owner of the property, Sam Culbertson, was represented by Linda Kane, lessee of the property. She stated she was annexed into the city in October 1987, and wishes to expand her animal kennel. City Council Minutes October 18, 1988 Page 6 Agenda Item #8, Ord 334-44, continued The P & Z Commission recommended the request for I-2 zoning be changed to a request for Special Exception Use Permit for a kennel on Agricultural land for a two year permit. Public Hearing: Jim Martin Jellico Corners. She already has a kennel on her property, get the ordinance in order. Motion was made to deny the request for zoning as requested. Motion: Wooll Second: Muller Ayes: Wooll, Muller, Hall, Springer and Evans Nays: None Approved (to table): 5-0 Agenda Item ~10, Establishing a Charter Review Committee The establishment of a Charter Review Committee was discussed. Motion was made to establish a Charter Review Committee of approximately 15 members, giving the original Charter Commission members first chance to participate. The City Secretary is to poll the Charter members to determine interest from them first. Motion: Wooll Second: Evans Ayes: Wooll, Evans, Springer and Hall Nays: Muller Approved: 4-1 City Council Minutes October 18, 1988 Page 7 A~enda Item #18, Discussion: Tree Ordinance Councilmember Sally Hall led a discussion in regards to an ordinance being adopted to conserve trees. She stated that we need to protect our environment in Southlake by protecting the trees. Among other things, trees can provide the best buffer from noise. The P & Z Commission will also be looking at a tree ordinance. A~enda Item #19, Public Forum Jim Martin - Jellico Corners. Informed the problem concerning paper work for ambulance inform Chief Steele on the matter. City Council about a service. He is to Rick Stacy - passed. Bill Low Woodland Trail. He referenced another new business in Southlake and their willingness to provide a new shotgun to the police department. He suggested the City move as fast as possible in re-staffing our police department to 21 personnel. Robert Downard - 755 Randol Mill Ave. The folks in the annexation area are not displeased with the police department. They simply feel they are covered by County Sheriff. He objects to cutting corners as in agenda item #8. Kay Kleinkauff - 163 Jellico Circle. She is proud to be a Southlake citizen. Aloha Payne Whispering Lane. to be a citizen of Southlake. Items include: A. The evaluation, appointment, and employment of a city attorney. B. TO consider authorizing the City Manager to employ special counsel of his choice to assist in personnel matters. C. The appointment and employment of a police chief. E. Litigation: Swift et al vs Lemke and the City of Southlake. Cause No. 352-115610-88. At this time, City Council convened in Executive Session. Council reconvened in public session at 12:05 p.m. Agenda Item ~21, Any Action Re: City Attorney Motion was made to accept the resignation of the city attorney, Hutchison, Price, Boyle and Dransfield, to be effective immediately and to employ the firm of Fielding, Barrett and Taylor as city attorney to be effective immediately. Rynecki with the firm of VonBriesen and Redmond as special counsel to assist in personnel matters and rules.
