'Westerholm; Mayor Pro-Tem, Betty Ralph Evans, Pamela Muller, Jim Wooll City Staff Present: City Manager, Lloyd O. Latta, Jr., Director of Public Works, Bill LeGrand; Fire Chief, R.P. Steele; Assistant Fire Chief, David Barnes; City Engineer, Eddie Cheatham; City Accountant, Renee McCarty; City Attorney, John F. Boyle, Jr. and Legal Assistant, Toni Chamberlain. Invocation - Ralph Evans The meeting was called to order by Mayor Westerholm. The minutes of the presented. Motion: Wooll Second: Evans Ayes: Wooll, Evans, Nays: None Approved: 5-0 June 7, City Council Meeting were approved as Springer, Hall and Muller Mayor's Report: Mayor Westerholm presented Ed Norman with a plaque thanking him in behalf of the citizens of Southlake for serving on the Planning and Zoning Commission for 11 years, May 1977 to May 1988. David McMahan was also given a plaque for serving as a City Councilmember for a 2 year term, 1986 to 1988. Mayor Westerholm reminded the audience that the 2nd annual CityFest will be held at Bicentennial Park on July 4th. He encouraged everyone to participate. The Mayor recognized the Southlake Police and Fire Departments for the recognition they received on "Thank You" Sunday at the Grapevine Church of Christ. An announcement was made in regards to the next work session on the master plan which will be held on July 6 at 7:00 p.m. City Manager, Lloyd O. Latta, Jr., noted that an updated land use map is available in the city chambers. The map was prepared by Mike Monroe of Cheatham and Associates. Motion: Springer Second: Muller Ayes: Springer, Muller, Hall, Evans and'Wooll Nays: None Approved: 5-0 #18 to the Agenda Item #18~ City Charter Interpretation Mayor Westerholm referred to a list of questions which were given to him from a group of citizens concerning interpretation to the City Charter. The questfons were answered by himself and City Attorney, John F. Boyle, Jr. The questions are attached as a part of the record. Judy Gilmore served as spokesman for the group, asking questions which also pertains to the City Charter. Public Comments: Judy Gilmore - P. 0. Box 877, Grapevine. How can Lloyd O. Latta be the City Manager according to the charter? Ron Gielow - 1417 Whispering Dell. He wants to address the handling of city employees--they have been treated as 3rd class citizens. They are as much a part of the city as any citizen. Bill Low - 3111 Woodland Drive. He started by commending the City Council for serving the community. Would it be contrary to the City Charter for the City Council to pass a resolution to reinstate the officers, immediately. Is there anything the City Council can do to go on record in support of the 6 officers who are on administrative leave. Mayor'Westerholm answered, this matter is to be dispositioned as soon as possible, that is what the City Council is doing. The City Council will go by due process. council does not have an a~ to grind--they want what is best for Southlake. Mr. Low continued, as a citizen, he feels it is not a bad idea to evaluate the City Attorney. Anything City Council can come up with will be appreciated, it will give assurance to the community. Carter Barcus - 900 Lakewood Drive. People feel safe in our community because of quick response. "If it isn't broke, don't fix it." If it's just a minor administrative problem, get the 6 officers back to work. City Council should consider replacing the City Manager. City Council Minutes June 21, 1988 Page 3 Cheryl Gielow - 1417 Whispering. She stated Sally Hall and Pam Muller have been very responsible to the citizens. Why did the city spend up to $4,000 on a private investigation when the District Attorney would do it for free? City Councilmembers had no comments at this time. A short recess was held at this time. (Left at 9:05 p.m. reconvened at 9:15 p.m.) Agenda Items #4 & #11, DENCO 9-1-1 and Suspension--Impact Fees Item #4, Resolution #88-54,. appointment of a member to the Board of Managers o2 the DENCO Area 9-1-1. Item #11, Resolution 888-61. Temporary suspension of impact fees pending review. Agenda Items #4 & 811 were approved under a consent agenda. Motion: Evans Second: Hall Ayes: Evans, Hall, Springer, Muller and'Wooll Nays: None Approved: 5-0 Agenda Item #5~ Res. 88-57~ Board of Adjustments Resolution #88-57, appointment of two alternate members zoning Board of Adjustments, was discussed. Motion was made and approval given to Dennis Johnson as appointments of alternate members Adjustments. Motion: Hall Second: Springer Ayes: Hall, Springer, Muller, Evans and Wooll Nays: None Approved: 5-0 Mender and to the Board Agenda Item 86¢ Res. 88-55, Memorial to Congress Resolution #88-55, a memorial to the Congress of the United of America, was discussed. Motion was made to approve Resolution #88-55, Motion: Springer Second: Hall Ayes: Springer and Hall Nays: Muller, Evans and Wooll Denied: 2-3 but was denied. to the Ernest of States City Council Minutes June 21, 1988 Page 4 Agenda Item #7~ Res. 88-58~ Moratorium on Development HWYll4 A discussion was held on a moratorium of development on HWY 114 and FM 1709. It was noted that an engineering firm has been hired by the city. Potential routes have been provided to the city. There are three (3) proposed routes at this time. Mayor 'Westerholm stated the resolution is not meant to be anti-growth, but to be responsible. Public comments: David McMahan - 1335 Hidden Glen. He is opposed to a moratorium. Why should we condemn our o.wn city from growth. Phillip Bressinck 1203 Plantation. He is also opposed to a moratorium. Even the word should be kept out of the papers. Richard Eakins - 216 Westwood. We don't need a moratorium put on the city. A bad word to get out. Conner Lam - passed. Motion was made to disapprove Resolution #88-58. Motion: Springer Second: Muller Ayes: Springer, Muller, Hall, Evans and Wooll Nays: None Approved (to disapprove): 5-0 Agenda Item #8~ Res. Resolution #88-59, discussed. 88-59~ Enforcing Perimeter Street Ord. enforcing the perimeter street ordinance, was Public comments: David McMahan - 1335 Hidden Glen. He is asking the City Council to have a work session and invite the developers before acting on this. '\ Motion was made to table Resolution ~88-59 until a work session can be held. Cities Motion was made to approve Resolution #88-56 naming as the delegate to Metroport Cities Partnership and Muller as the alternate. Motion: Wooll Second: Hall Ayes: Wooll, Hall, Springer, Muller and Evans Nays: None Approved: 5-0 Betty Springer naming Pamela Councilmember, Jim Wooll, stepped down for agenda item #10 as having a vested interest. Agenda Item #10~ Res. 88-60~ IBM Donation of 1-1/2 Acre Tract Resolution 888-60, acceptance of a gift of 1-1/2 acres of land from IBM for a future fire station, was discussed. City Manager, Lloyd O. Latta Jr., stated that north of Dove Rd. on Old Sam School Rd. on the west side is the location of land being donated to us. The land is restricted to a fire station. The city has 5 years in which to build, or it will revert back to IBM. Motion was made to approve Resolution %88-60. Motion: Evans Second: Hall Ayes: Evans, Hall, Muller and Springer Nays: None Approved: 4-0 Agenda Item %12, Ord. 439~ Reclassifyin~/Rezonin~ Ordinance #439, 1st. reading re~lassifying/rezoning areas 37, 47A, 47B, 48A, 48B, 48C and 48D, was discussed. Area 37. Owner John Church was not present. Commercial reclassified to 0-1 District. Zoning was Light Area 47A. Owner Noble Craft was represented by attorney, Linda Smith, with Snahard and Gambill. The property is shown on the tax roll as being owned by Can-Metal Building Systems. Ms. Smith stated that Mr. Craft's vested rights may be taken from him if the City Council down zones his land. Craft purchased the land with a use of retail. The request is for Retail-1. City Council Minutes June 21, 1988 Page 6 Area 47B. Owner, Les Clow was present and is asking for Retail-1. Area 48B and 48C. They are asking for Retail-1, not Office-1. Area 48A. J.R. Jones was present and is also asking for Retail-1. Area 48D. Dr. Johnny Richards is asking for Retail-1. The ordinance proposed the reclassification for Area 31 as Retail-l, Area 32A to Retail-1 and Area 32B to Office-1. Public Hearing: David McMahan - 1335 Hidden Glen. He is zoned retail. A~enda Item #14~ Ord. 438~ Extendin~ Buildin~ Codes to ETJ Ordinance #438, 2nd. reading extending the city's building codes to the extraterritorial jurisdiction of the City of Southlake, was discussed. Agenda Item #15, Ord. 440~ Sewer Installation/Connection Ordinance ~440 was discusse~ which included issues related to sewer installation and connection requirements and property to be served by septic tanks where sewer service is unavailable. Bill LeGrand, Director or Public Works, asked that City Council approve the 1st. reading. Public Hearing: David McMahan - 1335 Hidden Glen. In favor of reduction of lot sizes. There is a necessity to vitalize the growth of our community. He asked city Council to not table this again this evening. Richard Eakins - 211 'Westwood. '\ He is in favor of what McMahan said. It is time to get on with this. The master plan does not have to be approved to go on with this ordinance. Phillip Bressinck - passed. Joe Bently - 214'Westwood Dr. It is a disservice to the citizens to not deal with this. If we have a vote, lets get on with this. He stated his concern with the ordinance. He feels page 6, section 5.26-7 restriction should be removed. If there is public good, why can't it comply to all residential districts, he wants to know where were the people when the city put industrial in his residential area. He stated we need this ordinance because the city has some big expenses that need to be covered. City Council Minutes June 21, 1988 Page 8 Karen Hodges - 1210 Ashmore Ct. She is asking that the City Council delay the ordinance on lot slzes. Harold Knight - 1740 Highland. He hopes the City Council will set the lot size ordinance to leave green areas to enhance the area. Conner Lam - passed. Kay Kleinkoff - 163 Jelli¢o Circle. She is against passage of Ordinance #420. Growth is important to all of us. They see Keller where lot size is smaller. She wants to see a change in the Charter so that all citizens can vote on this. Motion was'~made to withdra~ Section #420. Motion was made to approve the variance as requested. He referred to ingress, egress in the south part of town. Weeds in the ditches in the industrial areas of town need mowing. Let try to improve our thoroughfare plan. Marion Compton - 225 Sweet St. She referred to Personnel Rules and Regulations for city employees Section 6 age requirement. She also questioned the letter to six officers concerning leave from home during administrative leave. Bill Low. Why didn't the City Attorney and City Manager go to the District Attorney first. Mr. Boyle read a letter from the District Attorney, Tim Curry. Motion was made and approval given to adjourn.
