Westerholm; Councilmembers: Charles Curry, Betty Springer, David McMahan, Jim Wooll and Rick Stacy. City Staff Present: City Manager, Lloyd O. Latta, Jr.; Public Works Director, William LeGrand; Police Chief, Jerry Crowder; Fire Chief, R.P. Steele; City Engineer, Eddie Cheatham; City Accountant, Renee McCarty; City Attorney, Ken Dippel and Legal Assistant, Toni Chamberlain. Mayor, Johnny H. Westerholm called the meeting to order at 7:30 p.m. Invocation - Charles Curry The minutes of the February approved as presented. Motion: Curry Second: Wooll Ayes: Curry, Wooll, Springer, Nays: None Approved: 5-0 16, 1988 City Council Meeting were McMahan and Stacy Mayor's Report: Mayor Westerholm announced that the executive session from the February 29, City Council Meeting will be continued tonight after agenda item $4. Congratulations were extended to Renee McCarty, City Accountant, for completing a course on accounting and finance from UTA. A petition was presented from Cross Timber Hills Homeowners Association with 160 names in favor of not going below 1/2 acre lot sizes in Southlake. The petition was presented by Blaine Fergerson. A~enda Item $4, Audit Report Presentation A presentation was made by Terry Bouton of Judd, and Smith, auditors for the City of Southlake. Mr. financial highlights for the past three years. Thomas, Beasley Bouton reviewed Agenda Item $5, 1st Public Hearing~ Annexation Tract 31D Mayor Westerholm stated that the lst of two concerning the request for annexation of Tract tonight. public hearings 31D will be held Minutes of City Council Meeting March 1, 1988 Page 2 City Manager, Lloyd O. Latta, Jr., informed the Council and the public that a service plan for the area is not complete at this time, but will be available at the Special City Council Meeting to be held on March 8, 1988. Public Hearing Fred Johnson - Rt. 8 Box 32 Bob Jones Road. He is an organizer and a signer of the petition. He stated his reason for wanting to be annexed into the city is to block a helicopter plant from going in near his property as it will make his property unsuitable. John Richardson - 12 Homestead Drive. He wants his home to be in a residential area and not an'industrial area. Bill Sawchuck - 11 Homestead Drive. He is in favor of annexation and always has been. He does not want the helicopter plant going in. Harold Knight 1749 E. Highland. He owns approximately 10 acres in Indian Creek. In favor of annexation. Les Clow - 820 Shady Oaks Drive. Very much in favor of annexation. Phil Marstella 1807 Cimmaron Trail, Grapevine. He feels it very beneficial if he too were in Southlake. He explained his operation in detail. He feels the tax base he would bring the City would also be beneficial. Ruth Smith - 340 Bob Jones Road. She stated they had never planned on coming into the city, but feels they need control in that area. Fears that the value will go down on her property if industrial uses are allowed. Susan Johnson Rt. 8 Box 32 Bob Jones Road. They are not against Mr. Marstella, they do not want industrial in their residential area. The public hearing was closed. Motion was made and approval given to have the 2nd public on March 8, at a Special City Council Meeting at 7:30 p.m. Motion: McMahan Second: Stacy Ayes: McMahan, Stacy, Curry, Springer and'Wooll Nays: None Approved: 5-0 hearing Minutes of City Council Meeting March 1, 1988 Page 3 Airport Litigation, Continued from February 29, Council Meetin~ The continuation of the executive session from the February 29, City Council meeting was held in closed session pursuant to V.T.A.S. Article 6252-17 on the airport litigation. DFW Airport and F.A.A. vs City of Southlake. The City Council reconvened in open session at 8:45 p.m. Mayor Westerholm stated that during the executive session City Council had discussions concerning the litigation that is currently going on between DFW Airport, FAA and the City of Southlake. They had consultation during the session with attorneys representing Southlake in this effort. The attorneys made certain recommendations to City Cbuncil. DFW Airport Board, upon an agreement that they have, came to a proposed agreement with the city. It is the consensus of Council that at this time they should make a decision to accept or reject this agreement. Motion was made and approval given presented. Motion: Wooll Second: Stacy Ayes: Wooll, Stacy, Curry and McMahan Nays: Springer Approved: 4-1 to accept the~ agreement as Betty Springer stated that she does not have any problems with what is in the agreement, its what is not in the agreement that concerns her. She feels we have now opened up a larger part of the city to adverse noise. To say yes to this agreement, is telling the people in those areas we just don't care. Councilmember Curry stated this is a step in opening up communications and being a good neighbor. Councilmember Wooll stated he supports the agreement as it offers Southlake the best deal we can get, and it was the advise of our legal council that it is as good a deal as we can get out of a victory in circuit court and that victory would probably be appealed and cost the city further money. He looks forward to establishing a better relationship with the airport. The agreement has its defects but he does not know how to get a better deal. Mayor Westerholm summarized the agreement which is a part of the minutes. Colby Springer stated that it seems the airport used the legal process to trap the whole situation as long as possible and to try the will of the citizens of Southlake and especially the City Council. Why did City Council have to vote on the agreement tonight? We are letting the airport tell us what to do. Agenda Item #6, Zoning IBM~ Ord. ~334-29 Ordinance No. 334-29 (ZAS~-01) zoning request for a 5.919 acre tract of land out of the R.D. Price Survey, Abst. 1707. The current zoning is agricultural, request is for Planned Unit Development Districts, R-2, R-l, 0-2, O-1 and Community Service. Owner of the property is International Business Machines. · 1st. reading. Ed Walts, attorney for IBM, addressed the City Council. no comments during the public hearing. Price Survey, Abst. 1207. Current zoning is Agricultural, request is for Planned Unit Development District, R-2, R-l, O-1, 0-2 and Community Service. Owner of the property is International Business Machines. 1st. reading. There were no comments during the public hearing. Motion was made to zoning request. Motion: Curry Second: Stacy Ayes: Curry, Stacy, Nays: None Approved: 4-0 approve the 1st. reading of Ordinance #334-29 Springer and McMahan Minutes of City Council Meeting March 1, 1988 Page 5 Agenda Item ~8, ZA88-04~ Preliminar~ Plat for Ravenaux Place ZA88-04, Preliminary plat approval for Ravenaux Place Addition. 24.10 acre tract of land out of the Thomas Hood Survey, Abstract 706. A replat of Lots lA & lB Crumbaker Addition. Owners Fox and Lee Custom Builders and Daniel R. Ahlers. John Levitt, engineer, was present representing owners Wayne Lee and Mick Fox. The city staff recommended approval provided they comply with Cheatham's review letter of February 9, 1988. Motion was made and approval given to approve the preliminary plat with the understanding that' items 1 and 2 of the February 9, 1988 Cheatham letter are complied with. Motion: Stacy Second: Curry Ayes: Stacy, Curry, Springer, McMahan and Wooll Nays: None Approved: 5-0 Agenda Item #9~ Request for Variance to Sign Ordinance A request was made by L.J. Hooker for a variance to the sign ordinance. Location of the proposed sign is the corner of Hwy 114 and FM 1709. Public Works Director, William LeGrand, stated that the sign permit does not meet Section K of the sign ordinance - size of advertising sign. Public Comments included: Jim Martin - He feels sign ordinance is unfair; a small business man needs all the help he can get. Bob Couch - Asked the question, "does the grandfather clause hold up on the annexed area for sign's that were already there". He is opposed to not being able to have\his signs. David Pearson - passed. Motion was made to disapprove the variance as requested. The sign is located at 1430 W. Continental Blvd., is in the city right-of-way. City staff recommended that the sign be moved as it is a hazard. Mr. Dippel, city attorney, stated there is legal exposure sign in the right-of-way. Motion was made to deny the variance as requested. Motion: Stacy Second: Curry Ayes: Stacy, Curry, Springer, McMahan and Wooll Nays: None Approved (to deny): 5-0 sign and traffic to the A~enda Item #11, Variance to Sign Ordinance The request for variance to the sign ordinance for a sign located on the southwest corner of FM 1709 and White Chapel Road. The applicant is Larry Cole Company. It was noted by staff that the request is the result of staff trying to remove the sign. According to the sign ordinance, off premises signs are not permitted in Southlake. Motion was made and approval give to disapprove requested. Motion: Curry Second: Wooll Ayes: Curry, Wooll, Springer and McMahan Nays: Stacy Approved (to deny): 4-1 the variance as Agenda Item 912~ Staff Approval of Sign Permit Requests A discussion was held concerning staff approval of sign permit requests. It was suggested by Councilmember Stacy that city staff have the same authority that is now given to City Council according to the ordinance. Agenda Item #13~ Final Site Plan for Bank Place The final site plan for Lot 5, Block B, Southlake Bank Place Addition was discussed. The owner, Southlake Associates, were represented by John Levitt Engineers. Motion was made to approve the site plan as presented. Motion: Springer Second: Curry Abstained: Stacy Ayes: Springer, Curry and Wooll Nays: None Approved: 3-0-1 Agenda Item #14, Request for Variance to Masonry Ordinance The request owner, Gary Bank Place. for variance to the masonry ordinance was requested by Fickes. The request is for Lot 5, Block B, Southlake It was noted by John Levitt that the request is for an all metal building to match the two existing buildings on Lot 5, Block B, Southlake Bank Place. City staff commented that they cannot issue a building permit unless the request meets the masonry requirements. Motion was made to approve the request for variance. It was noted that the reasons include 1) the use of alternating stairs leading from lower porch to upper Minutes of City Council Meeting March 1, 1988 Page 8 porch and 2) The use of 2-3/4" hand railing on stairs between first and second floors. Public Works Director, William LeGrand, stated the International Conference of Building Officials denied the use, so he is asking City Council to grant a variance as requested. Motion was made and approval given to grant requested. Motion: Wooll Second: Stacy Ayes: Wooll, Stacy, Springer, McMahan and Curry Nays: None Approved: 5-0 the variance as Agenda Item #16~ Ordinance #415~ Masonry Ordinance #415, 2nd. reading, amending the masonry requirements was considered in public hearing. There were no comments during the public hearing. Motion was made to table Ordinance #415. Motion: Stacy Second: Springer Ayes: Curry, Springer and Wooll Nays: Stacy and McMahan Approved (to table): 3-2 Agenda Item #17, Ordinance #334-27, Equestrian Center Request Ordinance #334-27, 2nd. reading, request for Special Exception Use Permit for an Equestrian Center on South White Chapel Rd. There were no comments during the public hearing. Motions was made and approval given for the Equestrian Center for fifteen (15) the site plan. It was noted that Westlake has agreed with the agreement with exhibit "A". Motion was made and approval given to exhibit "A". A Police Protection Agreement for IBM/MTP Westlake site was discussed. Ed Walts, attorney for IBM, explained the agreement to City Council members. Motion was made and approval given to the agreement. After discussion, Motion was made and approval given Deferred Compensation Program for employees. Motion: Wooll Second: Springer Ayes: Wooll, Springer, Curry, McMahan and Stacy Nays: None Approved: 5-0 Thoroughfare changes and Agenda Item #26~ Airport Compatible Zonin~ Ordinance A brief discussion was held concerning the Airport Compatible Zoning Ordinance. The ordinance draft will be reviewed by the Planning and Zoning Commission at their March 17, meeting. Agenda Item #27, Financial Report The City Manager reviewed the monthly financial report for February for the City Council. Agenda Item #28, Department Reports The February monthly department reports Council. were reviewed for the City Public Forum Doug Cox - 202 Randol Mill Road. Mr. Cox presented a petition signed by 8. property owners against Eutectic Metals of Southlake. A copy of a report, prepared by Jones and Neuse, Inc., Engineering and Environmental Consultants for the Texas Water Commission, was also presented. The petition is concerning environmental and pollution problems associated with the operations of Eutectic Metals. He asked for the city's cooperation in resolving the problem.
