CITY OF SOUTHLAKE CITY COUNCIL MEETING 667 N. Carroll Ave. February 16, 1988 MINUTES Councilmembers Present - Mayor, Councilmembers: Charles Curry, Betty Wooll and Rick Stacy. Johnny H. Westerholm; Springer, David McMahan, Jim City Staff Present City Manager, Lloyd O. Latta, Jr.; Director of Public Works, Bill LeGrand; Police Chief, Jerry Crowder; Fire Chief, R.P. Steele; Accountant, Renee McCarty; City Engineer, Eddie Cheatham and City Attorneys, John F. Boyle and Toni Chamberlain. Invocation'~ David McMahan Mayor, Johnny H. Westerholm called the meeting to order at 7:30 p.m. The minutes of the February 2, 1988 City Council Meeting approved as amended. Motion: Rick Stacy Second: Jim Wooll Ayes: Rick Stacy, Jim Wooll, David McMahan, Charles Curry and Betty Springer Nays: None Approved: 5-0 were Mayor's Report: Mayor, Westerholm noted Girls Scots of America. a Valentine the City received from the The Mayor received a letter from Roy English stating that Boys and Girls Basketball teams have been established. The players are chosen not only on ability to play ball but on scholastic achievement with representatives from different schools and different cities. Those selected from Carroll Schd~ls include: Laura Seemore, Dusty Kenvich and Richard Brown. The game will be played on March 19 at SMU, Moody Coliseum. A proclamation, proclaiming March as Youth Art Month, was read and approved. Steele was recognized as receiving the honor of being appointed "Fire Chief of the Year" at the annual Tarrant County Firefighters Association Banquet held on February 14, 1988. Mayor Westerholm noted a success story of our Police Department. Several years ago, Kenneth Haley was riding his bike home from DFW one night and was the victim of a hit and run accident. His body laid in the weeds for approximately five months. Southlake Police solved the case this past week when an arrest was made for that crime. Thanks were given to the department. Agenda Item~ #4, City Secretary's Pre-termination Hearing The City Secretary, Sandra L. LeGrand was asked to step agenda item 84. down for Mayor Westerholm read a statement into the record. This is a hearing placed on the City Council agenda at the request of City Councilmembers for the purpose of considering the dismissal or retention of the City Secretary, Sandra L. LeGrand. Ms. LeGrand has the option of having this hearing in an executive session or in a public session. If the hearing is in an executive session, all parties will be excused from City Council Chambers and the hearing will be conducted in the presence of City Council, City Attorney, temporary City Secretary, City Manager, Mrs. LeGrand and her attorney, if she has one, and witnesses that she may call. All witnesses will be excluded except for the time they are testifying before the City Council. The procedures for the hearing will be conducted in the following manner: 1) Any member or members of their intentions and decision Secretary. City Council may state the basis for to consider the dismissal of the City 2) The City Secretary may then present her response and any witnesses she desires to present on her behalf. All testimony presented shall be direct testimony relative to the issue at hand. Any and all questions shall be directed to the Mayor. There shall be no cross examination of any witness by parties presenting evidence. The City Council may respond to questions and ask questions of any witnesses. All witnesses shall limit their remarks to a reasonable time period. City Council does reserve the right to impose a time limit on witnesses. The Mayor as the presiding officer and City Council as a governing body shall conduct the hearing and be in charge of all matters. All witnesses shall be sworn in prior to any testimony. Any decision of City Council shall be made in public. City Council may state its reasons for their decisions. City Council Meeting Minutes February 16, 1988 Page 3 Mrs. LeGrand indicated she would like this to be an open hearing. .Mayor Westerholm asked that City Council make any statements at this time. In summary, the reasons given by Coun¢ilmembers include: lack of cohesiveness between managerial offices of Mayor, City Manager and City Secretary, the inability of the City Secretary to adjust to the responsibilities given her under the new City Charter, interfering with the office of City Manager, inability to get along with past City Administrator, Larry Munsie and interfering with other employees and family members Bill and Mike LeGrand. During Mrsl LeGrand's commehts to the Mayor and Council, she denied all of the accusations listed above stating, she was not aware of problems between the City Manager and herself and that City Council listened to only one side of the facts in gathering their information. She denied having problems adjusting but suggested that perhaps the City Manager was the one with the problems in adjusting to the City Charter. She expressed disappointment that City Council members would ~ake such action without even having talked to her about any of the stated problems. She stated she was never given a proper job description, nor had she ever had the opportunity to meet with City Council to work out every day matters. She asked for fairness. The following citizens spoke as witnesses in behalf of Mrs. LeGrand, all supporting the retention of Mrs. LeGrand as the City Secretary. The petition requesting the annexation of the property was presented to the City Council on January 19, 1988. After discussion, Motion 88-15 with the first public h~aring being held on March 7:30 p.m. and the second public hearing to be held on March 7:30 p.m. at a special City Council meeting. Motion: Rick Stacy Second: Jim Wooll Ayes: Rick Stacy, Jim Wooll, Charles Curry, David McMahan and Betty Springer Nays: None Approved: 5-0 was made and approval given to Resolution 1 at 8 at City Council Meeting Minutes February 16, 1988 Page 5 Item ~10, Ordinance #415~ Masonry Requirements Ordinance #415, 2nd reading on Masonry Requirements, was discussed. A suggestion was made that a work session be held on the issue. Public Hearing: Joe Bentley, Woodland Heights He appreciates problems being addressed by this ordinance. He feels 1,000 feet is an appropriate distance from residences, for metal buildings. Also, that the metal buildings be restricted to I-2 zoning. Dennis Men~er, Woodland Heights - He agrees that 1,000 feet is a good rule from residential areas. They are in favor of the old masonry ordinance. Ann Barnes, Highland - She is against the proposed change to the masonry ordinance. She wants only 100% masonry except in industrial areas. She presented petitions. Kim Clancy, Mission Hills - She is against this ordinance. Aloha Payne, Whispering - We need to protect our schools. not want metal buildings around residences or schools. She does Barbara Dofelmier, Cross Timber Hills - Presented a petition regarding the subject. Her addition is now having problems with metal buildings on the western boundary due to the annexation. Sonny James, Kimball - We must protect the residential areas D.E. Roberts - Protect the residential areas. Lawrence Kossoh - sent letter opposing change to masonry ordinance. Public hearing was closed. Motion was made to table the ordinance until the next City Council Meeting, March 1. '\ Motion: Jim Wooll Second: Betty Springer Ayes: Jim Wooll, Betty Springer, David McMahan, Charles Curry and Rick Stacy Nays: None Approved (to table): 5-0 Item #9~ Enforcin9 City Ordinances A discussion was held concerning the establishment of a enforcement of city ordinances in newly annexed areas. policy on City Council Meeting Minutes February 16, 1988 Page 6 Mayor Westerholm explained the reason for needing to establish a policy on enforcement. Public Works Director, Bill LeGrand explained several problems that exist because of situations that were in effect in the newly annexed areas. Portable signs are a big problem, businesses next to residences, junk cars before land was annexed in the city are just a few examples. Tim Farmer, next to Strand Excavating - stated that noise is a big problem for them. They have been in the city for 22 years. Strand was annexed into the city in October 1987. They feel Strand should now comply to city ordinances. John Boyle, City Attorney, stated any citizen can file a complaint if they have a problem. Tim Farmer questioned why they had to file a complaint when a Southlake police officer was there and heard the noise. Kathy Farmer was present and expressed concern over the way the Police Chief has handled the problem. Councilmembers asked that the city staff come up with a recommendation and present to Council for a possible solution. Item #7, Resolution 88-14, Street Priority List Resolution 88-14, establishing a priority list improvements for Tarrant County, was considered. for street Motion was made to approve Resolution 88-14 subject to Highland being the first priority. Motion was made to renew the terms of Goldstein, Stacy and Roberts for three year terms and fill the two vacancies at a later date. ' February 15, 1988 Mayor John Westerholm Southlake City Hall 667 North Carroll Ave. Southlake, TX. 76092 Dear Mr. Westerholm: Almost two years ago, my family and I moved to the -city df Southlake. We did so because we loved the open spaces, the educational system, and the home we selected. We knew and accepted the pending problems with the airport. However, we were not ready to accept the problems that our own city council was causing because of the lack of guidelines regarding zoning in our city. Therefore, I would urge each of you to begin a careful study and adoption of a Master Plan, upon which all future zoning would adhere to. It is not fair that some zoning has been decided solely for the gains of a few individuals. The rights and lifestyle of all of the citizens of Southlake must take precident over these few. It is also important that all hearings must be brought to the attention of all citizens, well in advance of the dates of such hearings. The issues, including land tracts, should be spelled out in a language that everyone can understand. There must be no secrecy in these matters! It is because of the above issue that I am writing. Unfortunately, I will be out of town on the night of Feb. 16, and cannot make your meeting to discuss Ordinance #415. I am deeply opposed to this ordinance, as are all of my neighbors. I do not want any metal buildings anywhere near our home. I will help in any fight to prevent metal buildings near our residential areas all over Southlake. Hence, I support the proposal stating that any building, regardless of zoning or use, if located within 1000 ft. of a residential neighborhood, must be constructed of acceptable masonry material. Therefore, the most effective protection homeowners can be given that unsightly buildings will not be located near their property, is to require any commercial structure built within 1, 000 feet of a residential neighborhood, be of acceptable masonry construction . Revenue and expenditure projections are compared to actual with the use of charts produced by software outside the City, available on a one time basis . In the interest of time and money, the budget comparison reports are computer generated material . To the best of my knowledge, all year to date figures are correct. A negative figure will appear in the Current Expenditure column when a general ledger adjustment has been made , which is greater than the current expenditure. For example , a clerk' s wage in the Administration Department should have been allocated so that a portion of it is applied to the City Secretary/Mayor/Council Department. The allocation was made for the first time this month; therefore, it was made for four months . Another good example is account number 314. 00 in the Police Department. A negative figure appears here because there were no current expenditures , and a check was voided, originally issued in a prior period. An example in the Water Fund Revenue Report is account 320 . 00 Garbage Tax. The negative activity here represents an adjusting entry that reclassed the figure to a liability account .
