1990-04-17 CITY OF SOUTHLAKE 667 N. Carroll Avenue REGULAR CITY COUNCIL MEETING April 17, 1990 7:30 p.m. COUNCILMEMBERS PRESENT: Mayor, Gary Fickes; Mayor Pro Tem Betty Springer. Members: Pamela Muller, Ralph Evans, Rick Wilhelm, and, Sally Hall. CITY STAFF PRESENT: Curtis E. Hawk, City Manager; Michael Barnes, Director of Public Works; Karen Gandy, Zoning Administrator; Police Chief Billy Campbell; Fire Chief R.P. Steele; City Engineer, Eddie Cheatham; City Attorney, Wayne Olson; and, Sandra L. LeGrand, City Secretary. INVOCATION: Councilmember Ralph Evans. A work session was held beginning at 6:30 p.m. for the purpose of discussing the items on the agenda for tonight's meeting. The Regular City Council meeting was called to order by Mayor Gary Fickes, at 7:30 p.m. Agenda Item 92, Approval of the Minutes The Minutes of the April 3, approved as amended. Motion: Springer Second: Evans Ayes: Springer, Evans, Muller, Nays: None Approved: 5-0 vote. 1990, City Council meeting were Wilhelm, Hall A~enda Item ~3, Mayor's Report Mayor Fickes reported that this morning, he and Councilmembers Sally Hall and Betty Springer, met with representatives from the City of Keller, and Tarrant County in regards to FM 1709. The Mayor of Keller and Mayor Fickes sent out letters to Tarrant County, and, the State Department of Highways, for an update meeting. The State Department of Highways was unable to attend, but the County was present and gave an update on the right-of-way acquisition. He stated, that meeting, along with the meeting which was held a couple of weeks ago, indications are that they are still on schedule to start the first phase of construction in March, 1992, on FM 1709, from FM 1938 to SH 114. Another meeting is scheduled for May 15, where Speaker Gib Lewis, has been invited, along with State Representatives; Carolyn Park and Bill Carter, as well as representatives from the State Highway Department. City Council Minutes April 17, 1990 page two A~enda Item #3 Continued Fickes noted that the main objective of the upcoming meeting is for Southlake and Keller to express that they want the right-of-way construction to stay on schedule. It appears that about seventy-five (75) tracts in Phase I, out of the one hundred, twenty-five (125) tracts, have been acquired. Thirty-five (35) tracts of land will go to condemnation, and, they are proceeding with condemnation at this time. The Mayor informed City Council and the audience that last Thursday, he and Councilmember Pamela Muller went to an Airport meeting. Councilmember Muller reported that the Cities of Grapevine, Euless, Irving and Southlake met on the new runway. The main concern from the Grapevine consultants is that the runway use plan does not have any enforcement provisions in the plan. The consultants will be providing suggestions on that in the near future. There was no discussion on the runway or the lawsuit between the airport and the cities of Grapevine, Euless and Irving, during the meeting. Mayor Fickes announced that absentee voting started on April 16, 1990, for the May 5, General Election , and will continue through May 1, in the Office of the City Secretary. Absentee Voting will also be held on Saturday, April 28, between the hours of 10:00 and 2:00 p.m. The Chamber of Commerce will be April 26, beginning at 7:00 p.m. auditorium. sponsoring a "Candidates Form" on in the Johnson Elementary School Mayor Fickes noted several resolutions which may appear on the next agenda: 1) urging Congress to reinstate full funding for the V-22 aircraft program into the Defense Budget for FY1990. 2) in support of the creation of the Tarrant County Crime Control and Prevention District. 3) endorsing State and Local Government Control of Stratospheric Ozone Depleting Compounds. 4) Proclamation: Nurse Appreciation Week Mayor Pro Tem Springer reported that on Thursday, April 19, the Chamber of Commerce and the Southlake Economic Development Council will meet with representatives of TU Electric, to finalize plans to shoot a video of the Southlake area, which will be used for the benefit of companies looking to relocate here; realtors who would like to have it available for their clients, and, anyway it can be utilized to showcase the City of Southlake. City Council Minutes April 17, 1990 page three Agenda Item ~ 3 Continued Mayor Fickes announced that agenda item #19 will be moved between items #9 and #10. He also announced that agenda item #9a, a public appearance by C.I.S.D. officials will not be discussed this evening, however, a joint work session has been set on April 24, beginning at 8:00 p.m. between the city and school. Agenda Item 94, Cit~ Manager's Report The City Manager, Curtis Hawk expressed that the Department Reports are in the packets, if there are questions, the Department Heads are available to answer them. Hawk stated that due to rains, ballfield lighting project. they are two weeks behind with the Agenda Items ~5,6,7,8 Consent A~enda It was determined that agenda item #6, would be removed from the Consent agenda, and voted upon separately. The items being considered in consent agenda include: Se Resolution 90-24, authorizing the Mayor to enter into a contract with Allen/Buie architects, Inc., for space utilization study at city hall. Resolution 90-26, authorizing the Director of Public Works to proceed with advertisements for construction of the S-6 sewer line. Resolution 90-27, approving the Land Use Assumptions to be used to develop a Capital Improvements Plan pursuant to which water and wastewater impact fees may be imposed. Motion was made to approve the items listed above as a agenda. Motion: Hall Second: Wilhelm Ayes: Hall, wilhelm, Muller, Springer, Evans Nays: None Approved: 5-0 vote. consent City Council Minutes April 17, 1990 page four Agenda Item #6, Resolution 90-25, authorizing contract For Water Rate Study The City Manager, Curtis Hawk, noted the purpose of the rate study is to enable the Staff to look at the rate structure, allowing the city to keep the water fund integrity in tact. He feels that the items in the RFP's have been addressed. Hawk stated that Councilmember Wilhelm has some comments in regards to the contract. Councilmember Wilhelm stated he gave the Director of Public Works a copy of his comments and he suggested that the City Council pass the resolution giving Michael Barnes the authority to attempt to negotiate the additional points, if he can. Motion was made to approve Resolution 90-25, giving the Director of Public Works the authority to attempt to negotiate the additional points in the contract for the rate study. Motion: Wilhelm Second: Evans Ayes: Wilhelm, Evans, Hall, Muller, Springer Nays: None Approved: 5-0 vote Mayor Fickes asked for a list of the additional items that are to be negotiated into the contract, so that he can review the completed contract before it is executed. Agenda Item #9b Public Forum No comments were received during the public forum. Agenda Item #19, Discussion: Continental Park Sewer Connection Fee Policy The City Manager introduced the agenda item, stating that Continental Park is the neighborhood that has been given the most attention, due to the location in regard to Big Bear Creek. He stated there are several ways which the sewer can be paid for, including: 1) 2) for the city to pay all the sewer costs. figure up some way where the benefited sewer users can pay for it: a. up front money from property owners. b. property owners borrow money on their own. c. City borrow the money and the property owners pay the city back. Hawk noted that there are two ways that the city can borrow the money: 1) issue Certificates of Obligation, and, 2) issue Tax Anticipation Notes. City Council Minutes April 17, 1990 page five Agenda Item 919, Continued Public Comments: Dennis Hinsken, 1204 Ridgewood Circle- He wants to go home tonight with good news, his family has suffered too long with sewer problems. He feels the city should pay half the bill. He cannot see where his tax dollars are going at this point. "Whatever it takes, lets do it." He stated he would go for the cheapest way. Troy Dill, 1202 Ridgewood Circle- He has lived there for fourteen years, and he has been living with the sewer problems for that long. He feels the city can borrow the money cheaper than the property owner can. He fees the city should assess them and it will help the property owner on their income tax. Charles Curry, 1203 Ridgewood Circle- Three years ago, the residents in Continental Park Estates all stated they wanted sewer. He referenced the survey which Art Sorenson prepared and gave to the City Manager about one month ago. He asked why hasn't city staff done something about it? He stated he and Sorenson had gone out and told the neighbors about this item being on the agenda tonight. If they had not gone out, no one would have known that it was on the agenda. Can the city work with the newspapers on printing a draft of the agenda as they come out? Art Sorenson, 1201 Oakhurst Court- He spoke in defense of the Mayor, City Manager and Director of Public Works, stating the city does have a problem in getting facts out to the people. He added when he and Curry went out to talk to residents, six surveys were passed out and all were returned. They feel they have a health hazard in Continental Park Estates. They worry about hypetitis, also, damage to their homes is a concern. He feels a combination of funding options should be offered to the property owners. Charles McRae, 1206 Timber Court- He moved to Southlake four and one-half years ago, and he comes to city hall annually about the sewer problems. He appreciates the efforts that have been made in working with City of Colleyville. He is in favor of anything the City Council can do. He does not have $4,000. to tie onto the sewer and he is currently 100 feet from a sewer line. He stated he will try and get his own funding, but he wants to know the options that the city will be offering. He feels tie-on should be mandatory. He hopes this can be worked out fast-- he is desperate at this house, it is THAT bad. He feels strongly that if Chimney Hill gets sewer first, it will add insult to injury. City Engineer, Eddie Cheatham, that the $4,000. is only for the including hook-up to the house. reminded the Council and Audience line in front of the property, not City Council Minutes April 17, 1990 page six A~enda Item #19, Continued Joe Boyle, 1206 Scenic Drive- He feels that sewers are a community and city project, and to assess the residents a cost to put it in is not right. He is in favor of sewer, but not in favor of paying a lot of money. A major portion should be paid for by the city. Pam Crenshaw, 1201 Scenic Drive- She has one acre and is flooded, now that Chimney Hill is in. She stated she does not understand, as in Continental Park Estates, the property owners have already paid for the sewer, when they purchased their land. She fees the money should have been set aside, for the time sewer would be installed. Councilmember Muller explained that the city did plan when Continental Park Estates was developed. time did not want sewer. not have a sewer The city at that Mayor Fickes and other Councilmembers attempted to explain to Mrs. Crenshaw, the facts surrounding the development of property in regards to installation of sewer lines at the time development is being done, as opposed to development which took place several years ago. John Berry, 1209 Oakwood Trail- He is in favor of the sewer system being put in. He would like for the city to come up with some options for financing the system. James Hollstein, 1201 Oakwood Trail- He fees the new developments should pay for the sewer. He has lived here for years and has paid taxes, and he cannot afford to pay for the sewer system. He just wants to be able to afford to continue to live in Southlake. He also has problems, whereas, Chimney Hill water runs onto his property so bad, he feels it is just not right. When he attending the meeting before, the City assured him they would do something in regards to the water problem on his property. Jerald Brown, 1206 Ridgewood Circle- He has come to the city with his problem in regards to the large hole in front of his house on the street. He talked to Mayor Fickes, asking for relief, at this time he has not had any relief. He stated, he was told by city staff, when the sewer comes in, then the new street would be built. City Council Minutes April 17, 1990 page seven Agenda Item #19, Continued Allan Clark, 1208 Scenic- He feels that funding the sewer residents for one year is not fair, he cannot afford it. for the Rick Stacy, 1000 W. Southlake Blvd.- He asked Council if possibly the estimates are too high. He feels the city should already know the answers to the questions being asked tonight in regards to funding the sewer system. Billy Jon Curb, 1640 W. Continental Blvd.- He also has complaints about the drainage onto his property from Chimney Hill Estates. He asked how have other communities made the transition to sewer systems. What was successful and what was not successful for them? He suggested that City Council do their homework, bring sound suggestions to the people and he feels they will buy it. Debbie Farrier, 1336 Glen Cove- She has been told that it will be at least five (5) years before sewer is available in Cross Timber Hills Estates, by then the cost will escalate out of proportion. Bill Spivey, Rt 5, Box 162, Roanoke- There is already a health hazard in Continental Park Estates. Why can't the City Manager deem it a health hazard and have the sixteen homes that have sewer on their street, tie on today to solve the hazard for them, also, lowering the water level for the remainder of the homes. Bill Gray, 1205 Scenic Drive- He stated that 12 to 16 houses will not reduce the problem for the rest of the residents of that area. Council adjourned for recess at 9:25 p.m. Council returned at 9:38 p.m. Mayor Fickes announced that on Wednesday, April 18, at 5:00 p.m., He will be meeting with Charles Curry, Art Sorenson and Curtis Hawk, in regards to a questioneer which may be sent to the property owners in Continental Park Estates, in reference to the sewer connection fee policy. Agenda Item #10, Ordinance No. 498, 2nd reading. Annexation Tract 1 Karen Gandy, Zoning Administrator, made a presentation in regards to the 24.55 acre tract of land, known as Tract 1, being annexed into the city under Tract 1. The property owner is Bill Massey. No comments were received during the public hearing. Annexatin~ Tract A presentation was made by Karen Gandy, Zoning Administrator, who stated that the property in Tract 2 is currently owned by Fina Oil and Chemical Company. She stated that the owners have requested in writing, that the property be brought into the city with the same Industrial-2 Zoning as their other parcels of property. The public hearing resulted with no comments. Motion was made to approve the annexing Tract 2 into the City. Hall A~enda Item ~12, Ordinance No. 480-11, 2nd reading. Conoco Inc. Zoning request for a 33.626 acre tract of land out of the Harrison Decker Survey, Abstract NO. 438, Tracts lB1, 1B1C, and 1B1B was discussed. Karen Gandy, Zoning Administrator, stated that Conoco Inc./CITGO Petroleum Corporation, if the zoning is approved, will still need to go before the Board of Adjustments for a special exception for fuel terminal, in order to be in compliance with the zoning ordinance. She added that this item has been tabled for several weeks in order for more research to be completed in regard to the safety issues involved and noise associated with the flare._ City Council Minutes April 17, 1990 page nine Agenda Item ~12, Continued Jim Rau, Conoco- stated they will be building a billboard out of a 15' sheet of metal using steel pipe instead of wood polls. It will be approximately 35' high from the ground to the top of the steel sheet, with very simple construction. He noted that the concerns of the area property owners have been addressed, and they feel this method of construction will be fair. Councilmember Sally Hall commented she has met with all the fuel terminals in the area. They have formulated fire plans and have located, with the help of these companies, suppliers in case an accident occurs on the premises, in the way of foam, how it will be shipped to the site, and how the fire will be addressed. Also, all firefighters will be sent to school. The companies involved are paying for those education hours. They have an evacuation plan as well as modification being made to the terminals, where concrete driveways will be constructed, capable of holding large fire equipment. Mayor Pro Tem Springer stated she feels all of City Council should thank Mrs. Hall for all the work she has done on this project. Public Hearing Ed Brown, 1231 Timberline Court, stated, he feels they should show him something, rather than tell him something. He asked what if the shroud doesn't work? Public hearing closed. Freshour Survey, Abstract No. 521, being the northern portion of Tract 3J. Current zoning is Agricultural, request is for the Single Family-1 Zoning District. Karen Gandy, Zoning Administrator, made a presentation, stating that Council approved the first reading of the ordinance on April 3, 1990. Motion was made to approve the 2nd reading of Ordinance No. as presented, changing the zoning to Single Family-1 District for the Brewer property. Joint Venture Zoning and Concept Plan SouthView Zoning Administrator, Karen Gandy, presented Ordinance NO. 480-17, a request for zoning change and concept plan for a 32.706 acre tract of land out of the W.W. Hall Survey, Abstract No. 695, being the western portion of Tract 5 and 5A. Current zoning is Single Family-1 Residential, with a request for SF 20-0A Residential. She added that seventeen letters were sent to property owners within 200', receiving one response from Mr. Yates on Bentwood. On March 29, the Planning and Zoning Commission recommended approval and on April 3, the City Council approved the first reading on the ordinance. John Levitt, Levitt Engineers, was present to answer questions for the Council. The public hearing resulted with no comments. Ayes: Muller, Evans, Nays: None Approved: 5-0 vote. Springer, Wilhelm, Hall City Council Meeting April 17, 1990 page eleven A~enda Item ~15, Ordinance No. 480-18, 1st reading. Zonin~ Bass Development Company Ordinance No. 480-18, 1st reading, is an ordinance requesting zoning change and concept plan for a 19.995 acre tract of land out of the Littleberry G. Hall Survey, Abstract No. 686, Tracts 3F and 3G. The zoning administrator, made a presentation stating she sent ten letters to property owners within 200' and received four replies: Rick Stacy and R.J. Stacy opposing the request, naming drainage and land use not being compatible as the reasons. Joe Gregory is opposed as it will add drainage problems to his property. David Howell is in favor of the request. On March 29, the Planning and Zoning Commission approved the tabling of this item. On April 5, the Planning and Zoning Commission voted to deny the request with a 4-2 vote. The vote to deny is due to incompatibility with land use plan. Pat Adkins, Tipton Engineering was present representing Bass Development Company and First National Bank of Grapevine. Adkins gave a brief history of Bass Development Company, stating they are a single family developer with custom housing. This is their first project in $outhlake. He commented that there are very stringent ordinances in Southlake and they are committed to following the ordinances. Adkins stated that they plan for 34 single family homes of 3,000 square feet, with a price range of $250,00 and up. They are trying to be consistant with the area development. Mayor Pro Tem Springer commented that she would like to see them rework the lots on the east and come back with an alternate plan. Bruce Prine, Bass Development Company stated they feel they are compatible to the area. Public Hearin~ Roy Stacy, 320 North Shady Oaks Drive. Mr. Stacy stated he has lived here for nineteen years. He bought the property for their home site and they still live on it. He asked the City Council to consider the fact that the master plan calls for one acre lots, and, drainage is a problem. When his stock pond over flows, it leaves and goes to Rick's property and then onto Joe Gregory's property. He asked that this property be zoned to one acre lots. City Council Minutes April 17, 1990 page twelve Agenda Item #15, Continued Joe Gregory, 1100 W. Southlake Blvd., stated when he purchased his property four years ago, he never dreamed small lots would go in on this property. Until Arvida went in, he never had his road wash out. This drainage is a problem for him and also the folks in Ginger Creek Estates. His road has washed out three times since Arvida has developed. The holding ponds that were planned to control drainage are not working. He asked Council to please consider their problems in regards to this request. Rick Stacy, 1000 W. Southlake Blvd. Stacy noted that even without the drainage problems, this request does not meet the land use plan. Meryl Stacy, 320 North Shady Oaks Drive, added that these gentlemen are representing a piece of property for development, and she represents her home. She asked Council to please not put that many homes that close to them, they did not move out here to have the homes so close together. Jerry Farrier, 1336 Glen Cove, stated that he does not live in the area in regards to this zoning request, but his concern is that if Council makes these types of zoning decisions based on the questions that have been raised tonight, at this stage, he feels very little development will ever take place. He sympathizes with property owners who do not want to see roof tops, but that becomes a mute issue. As a city we have chosen to open up to developers, we have set the standards, we have allowed development to take place. If the people who live around land to be developed have a better concept about drainage than the engineers who the city pays tax money to, that is the issue the Council needs to look at. Farrier feels that this issue is not any less compatible than the case the Council approved earlier in the meeting. Public Hearing Closed Councilmember Sally Hall stated the new zoning ordinance which City Council spent the last nine months to develop, and, went to great lengths to develop 26 zoning districts, each district, was a transition into the next. Each district has a certain height, a certain look. They were very concerned about what goes next to what. She finds this to be identical, whether residential development or business development, there needs to be transitions from one residential lot size to the next lot size. City Council Minutes April 17, 1990 page thirteen Agenda Item #15, Continued Hall asked the developers to prepare a compromise to this concept plan, keeping in mind the agricultural property on the east and west. She feels 30,000 square foot lots will be the minimum on the east and west. Councilmember Muller agrees with Mrs. Hall on the drainage. She wishes that the zoning and the land use plan would be taken into consideration. She is concerned with these things. Mayor Pro Tem Springer stated she knows what the land use plan says, however, during the process it was determined that the land use plan is not cast in stone. We do have SF-20 zoning to the north and Timber Lakes to the south. She has always felt there was room for compromise on the plan. She would like to see a compromise with this plan and buffering. Councilmember Wilhelm stated he feels the lots on the east and west should be at least 30,000 square feet. Councilmember Evans stated he feels the lots should be one acre. Mayor Fickes stated he would like to see more imagination with the concept plan. He feels the land is two small for half acre lots. At the request of the applicant, motion was made to continue the public hearing and 1st reading on Ordinance NO. 480-18, time certain, May 15, 1990. Street Lights Director of Public Works, Mike Barnes, noted that the ordinance as presented tonight has not had any changes since it was approved on 1st reading. Hawk reviewed the process that was originally approved where TRA would construct the S-6 Sewer line. This ordinance amends the contract and the city would sell the sewer bonds through TRA, but it is the cities project. We will construct the line, advertise, etc. The reason for this change is due to time-frame. The public hearing resulted with no comments. Motion was made to approve Ordinance No. 504, 2nd reading, authorizing and directing the execution of the TRA, Big Bear Creek wastewater interceptor extension installment sale amendatory contract. Ayes: Muller, Evans, Nays: None Approved: 5-0 vote Springer, Hall, Wilhelm A~enda Item #18, Resolution 90-28, establishing Park Fees for FY90 Michael Barnes, Director of Public Works, explained that each year, in accordance with the ordinance, the city will need to establish a cost per acre for raw land in tracts of 50 acres or more. Virginia Clow, Southlake Realty Company submitted a response, stating, as of this date, $25,000.00 per acre is the result of an analysis of six recent sales totaling 1,468 acres of land. A copy of the letter from Mrs. Clow is incorporated into the minutes. We used approximately 150 tons of cold mix for potholes. We blade -layed over rough sections of E. Southlake Blvd., E. Continental Blvd., and S. Kimball using approximately 200 tons of cold mix. Several major repairs di were started on Raintree and E. Continental where base has failed due to excess water in the ground. These streets will continue to need work performed on them until we get y into the drying season. We built brackets to mount ballpark lights on poles, buried conduit in the park for new lighting, repaired ballfield fences and performed other tasks as required to get the park ready for baseball season. Crack sealing continues and is currently delayed due to the crack sealer machine breaking down and excess water in cracks. I called the State Comptroller's office for assurance that the allocation was valid. The following reasons were provided: 4 1.
