REGULAR ZONING BOARD OF ADJUSTMENT MEETING: January 24, 2013

REGULAR SESSION:
Agenda Item No. 1 — Call to Order: Chair McCaskill called the meeting to order at 6:33 p.m.
Agenda Item No. 2 — Approval of the Minutes: Chair McCaskill opened the discussion of the
minutes of the Zoning Board of Adjustment meeting held on January 10, 2012.
A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on
January 10, 2012, as corrected.

Agenda Item No. 3 — Administrative Comments: Richard Schell, Planner II, announced that
the next scheduled ZBA meeting is February 14, 2013 and that there is one (1) submittal for the
meeting. Planner Schell also announced that Board Member Nicole Smith resigned due to the
fact that she moved to Grapevine and that Board Member Lisa Amend will also be resigning
because she is moving to Grapevine and that this will be her last meeting. Planner Schell and
the Board thanked both members for their service.
Agenda Item No. 4 — ZBA-631, Variance to Minimum Lot Size: Variance to Ordinance No.
480, Section 11.5(f) requiring a minimum lot size of 43,560 square feet on property described as
Tract 5B04B1, Samuel Freeman Survey, Abstract No. 525, City of Southlake, Tarrant County,
Texas, and located at 616 Shady Ln., Southlake, Texas. The current zoning is "SF -1A" Single
Family Residential District.
Richard Schell, Planner II, presented the case to the Board, stating that the variance request is
to allow a minimum lot size of approximately 37,548 square feet or approximately 0.862 acres.

Planner Schell reported that fourteen (14) notices were mailed out within two hundred (200) feet
with one (1) response received; Oates, Cindy Ziglar (14), 712 Shady Lane, Southlake TX;
Submitted a Notification Response Form stating In Favor.
Vice -Chair Phyllis Lambert asked Planner Schell the right-of-way that the applicant is requesting
and for Planner Schell to show where that is located on the map. Planner Schell stated that the
right -of way for Shady Lane is fifty feet and that the applicant is required to dedicate twenty-five
feet of right-of-way measured from the centerline of Shady Lane as is shown on the plat. Vice -
Chair Lambert asked for verification that the issue is not the size of residence the applicant
wants to construct, but that the issue is the size of the lot. Planner Schell confirmed that Vice -
Chair Lambert's statement was correct and that any structures built will have to meet the
requirements of the SF -1A zoning district.
Applicant Hunter Haas, located at 601 North Park Boulevard, #1608 Grapevine, Texas 76051,
was sworn in. Mr. Haas stated that he is just trying to build a house and that he assumed he
could build there since the property was already zoned. Mr. Haas also stated that he wants to
keep the zoning the way it is and that the neighbors like it the way it is currently. Mr. Haas then
stated that he is ready to get the house built and to get it over with.
The applicant offered to show the house plans to the Board. Vice -Chair Lambert stated that the
issue of the house to be built is not before the Board and that the issue is the lot size.
A motion was made to approve ZBA-631.
