The Work Session was called to order at 6:30 p.m. to discuss items
on the agenda.
Mayor Fickes called the Regular City Council meeting to order at
7:00 p.m.
Aqenda Item MI-B, Executive Session.
Mayor Fickes advised the audience that Council would be going into
executive session pursuant to Section 2(e), 2(f), 2(g), and 2(j) of
the Open Meetings Act, to seek the advice of our City Attorney with
respect to pending and contemplated litigations, to discuss the
purchase, exchange, lease or sale of real property, and to consider
the appointment and evaluation of public officials and regarding
the deployment of specific occasions for implementation of security
personnel or devices.
Council adjourned into executive session at 7:03 p.m.

Aqenda Item #3. Mayor's Report
Monthly meeting of Metroport Cities Partnership will be at
Southlake City Hall, Thursday, December 17 at 4:00 p.m.
Mayor Fickes commended the Southlake Carroll Football team,
the coaches, and parents and students of CISD.
Councilmember Emerson announced that the students at Carroll
High School participated in a can goods drive for the
Grapevine Relief and Community Action group and as of
yesterday had collected approximately 2500 can goods.
Mayor Fickes announced that the Tarrant County 9-1-1 District
was looking at the possibility of funding the Poison Control
Center for Tarrant County. Mayor Fickes invited those who
were interested in providing input to contact him.

ZoninG Administrator, Karen Gandy, presented the rezoninG request
for 1.00 acre tract situated in the J.A. Freeman Survey, Abstract
No. 529, beinG legally described as a portion of Lot 2B, Gorbutt
Addition and a revised concept plan for the proposed Lots 2 and 3,
Block 1 of the Miron Addition. The current zoninG is "C-2" and "S-
P-2" with certain "B-2" uses; the requested zoninG is "S-P-2"
Generalized Site Plan District for a large animal veterinarian
clinic with "C-2" uses. Ms. Gandy stated that the owner Robert
Miron plans to sell Lot 2 to Dr. Bruton for a veterinarian clinic.
The "C-2" district permits only small animals and Dr. Bruton's
practice includes large animals as well. He proposes placinG all
animal enclosures inside and intends no outside storage.
Six (6) notices were sent to property owners within 200 feet, but
no written responses were received. However, Ms. Gandy commented
that Mr. Jdhn Napper, who r~presents Smock/Husseini Joint Venture,
was present and voiced his concerns at the previous meetinG
regardinG the cul-de-sac issue.
There were no comments from the audience durinG the Public HearinG.

letter of 11/25/1992 consistent with the motion made on 1st readinG
deletinG item #6 relating to common access.

Agenda Item #8A, Res. No. 92-57, ZA 92-39, Hollowa¥
ZoninG Administrator, Karen Gandy, presented the request for a
Specific Use Permit for two (2) portable buildings for temporary
educational and fellowship space. The location is 940 S. Carroll
Avenue, being legally described as approximately 2.00 acres
situated in the O.W. Knight Survey, Abstract No. 899, Tracts 6D and
6F. The request is per Section 45.1 (30) and Section 45.7 of
Ordinance No. 480 as amended.
Ms. Gandy stated that the owner/applicant, First Baptist Church of
Southlake/Pastor Falis Holloway, stated they anticipate needinG the
portable buildings for approximately 18 months. The
owner/applicant is also requestinG a waiver of the requirements for
a permanent foundation and masonry.
Seven (7) notices were sent to property owners within 200 feet, but
as of this date no responses have been received.

Ms. Gandy stated that the portable buildings will be located behind
the existing building, therefore, will be screened from the road.
Pastor, Falis Holloway, was present to answer questions for the
Council.
Councilmember Farrier suggested there be an option for extension of
the 18 months should construction of the new permanent facilities
be delayed.
There were no comments from the audience during the Public Hearing.
Motion was made to approve Resolution No. 92-57, for a Specific Use
Permit, subject to City staff's review letter of 12/11/1992, and
limited to 18 months with one right of extension for 6 months, and
granting waivers for: (1)· the masonry requirement because the
buildings will be located behind the existing building and not
visible from the street and it is of a temporary nature; and, (2)
the permanent foundation requirement because of the temporary
nature and the fact that a permanent foundation would interfere
with their future plans as shown on the site plan.

Zoning Administrator, Karen Gandy, presented the Final Plat for
Stonegate Manor Estate, being 22.27 acres situated in the R.D.
Price Survey, Abstract No. 1207, Tracts 2F, 2F6, 2F8, and 3B1A, and
more commonly known as 2930 Ridgecrest Drive. Ms. Gandy stated
that the current zoning is Agricultural with a Specific Use Permit
for equestrian uses. The owner is Plano Bank and Trust, and the
applicant is Ron Rodenberg and Bob Bronstad.

AGenda Item $8C, Ord. No. 480-I, 1st ReadinG, Recreational
Campsite/Campgrounds.
Zoning Administrator, Karen Gandy, presented proposed Ordinance
#480-I which revises Section 35.9 (c) to allow the use of
recreational equipment for the purpose of living or housekeeping in

a residential or agricultural area under certain conditions and
adding item #36 to Section 45.1 to allow recreational campsites or
campgrounds in the "AG" district by a Specific Use Permit. Ms.
Gandy stated that this amendment to the Zoning Ordinance will
Correct any inconsistencies between it and Camping Ordinance No.
577.
Mayor Fickes stated that he had concerns with limiting the number
of times to just twice a year for out-of-town guests to visit. He
suggested that it might be increased to four (4) times a year.
Councilmember Apple suggested that we allow up to six (6) times in
any calendar year with each visit being limited to two(2) weeks but
not to exceed 30 days in any 12-month period.
Councilmember Wilhelm was~ concerned that we might make the
ordinance so complicated that it would be difficult to enforce.
Councilmember Farrier commented that four weeks was not enough. Me
understands the need for the ordinance, but he would rather not see
it so restrictive.
City Attorney, E. Allen Taylor, and City Manager, Curtis Hawk,
explained the processes for citing a violation of an ordinance of
this type.
Motion was made to approve Ordinance #480-I subject to the wording
in Section 1, paragraph "c" being changed from "no more than twice"
to "no more than 6 times" with the remaining wording unchanged.

AGenda Item #10A, Parks and Library Task Force Recommendation.
Larry Goldstein, Chairman of the Parks and Library Task Force,
presented the Task Force's recommendation that the City Council
consider placing a proposed increase in sales tax of one-half of
one percent on the City's general election ballot in May 1993.
Mr. Goldstein expressed that the Task Force believes the location
of the City of Southlake along with the current direction of higher
density residential zoning assures the predictions of population
growth will continue, and along with that growth comes a natural
demand for increased recreational and cultural facilities.
Mr. Goldstein stated that a committee will be formed to visit with
the citizens of Southlake to inform them of the proposed increase

in the sales tax--what it will be used for and what monetary impact
it will have on them if they shop in Southlake.
Dick Johnston, 139 Jellico Circle, a member of the Task Force, was
present to state his support of the project. He commented that he
would like to serve on the committee that will oversee the
implementation of the project.
Joe Moore, 1911 E. Mighland, commented that if Southlake had the
lowest sales tax in the area it might be an incentive for business
to locate here.
Rod Johnson, N. White Chapel, commented that if that were the case
the retail businesses would already be here.
Councilmember Wilhelm commented that as a City we need to look more
at the fees we charge to develop here--fees which come right off
the bottom line for development cost; sales tax is just a pass
through.

Agenda Item #10B. Drainage Easement/AGreement. Michael Benton.
This item was pulled from the agenda at City staff's recommendation
because the easement/agreement is not ready for Council action.
Agenda Item $10C. Agreement with David Hardy, StanhoDe Addition.
A proposed agreement between Mr. David Hardy and the City of
Southlake pertaining to condemnation of a drainage easement to
serve the proposed Stanhope Addition.
Mayor Fickes briefed the Council and the audience on the events
leading up to this point. Mayor Fickes commented that Council
encouraged the two parties to meet and try to work out a suitable
solution regarding the drainage issue.
A discussion was held on acquiring a letter of credit and whether
it would meet the City's needs. City Attorney, E. Allen Taylor,
stated that the letter would be subject to approval by the city
attorney.

Joe Moore, 1911 E. Highland, stated that the amount of money he is
requesting from Mr. Hardy for the land necessary for a drainage
easement will not change.
Motion was made to approve the Agreement between Mr. David Hardy
and the City of Southlake subject to approval of Item 10D on
condemnation proceedings.

Resolution No. 92-55 proposes authorizing the City Attorney to
proceed with condemnation of a drainage easement across Mr. Joe
Moore's property necessary to serve the proposed Stanhope Addition.

David Hardy, 300 Red River Way, Irving, Texas. Mr. Hardy informed
the Council that he would pay Mr. Moore the price he requested if
he would take half the money now and half in one year and allow the
City to add that verbiage to the Developer's Agreement.
Aqenda Item $10E.
Banc Addition.
Developer's Aqreement, First American SavinGs
Public Works Director, Mike Barnes, presented the Developer's
Agreement for First American Savings Banc Addition. He stated that
the owners are requesting that Council waive the pay for
performance bond because the utilities are a small part of the
project. Staff has no problem with the request because a
Certificate of Occupancy will not be issued until the improvements
are completed and accepted by the City.
Councilmember Wilhelm commented that there were several areas in
the agreement that did not relate to a commercial project. Mr.
Barnes stated that staff and the attorneys are working on revising
the standard agreement by creating two different agreements one
that would be used for residential projects and one that would be
used for commercial projects.

Aqenda Item #llA. Request by DFW.
City Manager, Curtis Hawk, discussed the request by the DFW
International Airport Board asking the City to consider a
Resolution of support for the DFW initiative to amend the Texas
Municipal Airport Act. Mr.' Hawk commented that the TML as a rule
has taken a position against any attempt by the legislature to
undermine the home rule authority of communities, however, the DFW
Board says this is not their intent. Mr. Hawk further stated that
the cities of Irving, Grapevine, and Euless take issue with the
position of the DFW Board, and they feel that by amending the
Municipal Airport Act will interfere with the home rule power of
cities.
Mayor Fickes requested that staff place the resolution on the
agenda for action.

Attached are the Uniform Fire Code Amendments for 1991 as
requested by Fire Services Director Williams and Fire
Marshal Roger Stewart, and the corresponding local amendments for
the UBC. Director Williams has meet with Councilmember O'Brien
and Wilhelm to discuss the revisions.
The ordinance adopting and amending the codes, Ordinance No 572,
is being prepared by the attorneys.

Sec. 10.105 Identification of all fire protection equipment,
hydrants, fire zones and the identification of
safety equipment.
Sec. 10.204 Qualifies fire apparatus, access roads, surface

extinguishing systems and equipment, and provides
for an exception.
Sec. 10.507 Pertains to group and division occupancies
(and Section concerning sprinkler systems and their
