The Work Session was called to order at 6:30 p.m. in order for
Councilmembers present to discuss the agenda items in preparation
for tonight's meeting.
Mayor Gary Fickes called the Regular City Council Meeting to order
7:10 p.m.
Aqenda Item #1-B~ Executive Session
Mayor Fickes hereby advised the audience that Council would be
going into executive session pursuant to Section 2(e) 2(f) 2(g)
2(j) of the Open Meetings Act, to seek the advice of our City
Attorney with respect to pending and contemplated litigations, to
discuss the purchase, exchange, lease or sale of real property, and
to consider the appointment and evaluation of public officials and
regarding the deployment of specific occasions for implementation
of security personnel or devices. Council adjourned into executive
session at 7:10 p.m.

Aqenda Item #3, Mayor's Report
Mayor Gary Fickes read a proclamation proclaiming December 1, 1992
through January 1, 1993, as Tarrant County Holidays Ahead Campaign
Month, in an effort to promote local, the community-wide effort to
focus public attention on the problem of drunk and drugged driving,
one of the nation's most serious public health and safety problems.
Mayor Fickes announced that Keep Southlake Beautiful Kickoff Rally
will be held on Saturday, November 21, 1992 at Bicentennial Park at
noon. The Rally will offer free Trees, Bluebonnet Seeds, and Car
Litter Bags to those in attendance.
The Mayor announced the Grapevine Christmas Parade will be held on
December. 3, 1992, and .encouraged everyone to attend, adding,
Council will be participating.
On December 8, 1992 a Joint Work Session will be held with Carroll
School Board members and City Council members present.
Agenda Item #4, City Manager's Report
The City Manager reported on the curve in front of the Spivey
Residence on Randol Mill Road. Mr. Spivey reported a condition to
council several weeks ago, asking for help in that his fence has
been hit on numerous occasions by vehicles rounding the curve at
higher than acceptable speeds. Hawk stated they have stall not
received information from the state with information in regard to
other types of street surface that will have less skid on the
road. Curve signs from both directions will have flashing battery
lights, and buttons that will wake up a driver when crossing the
center line are possible solutions. Staff is going to try and
change some things that will slow drivers down at the
intersection~ Addition signage will be added in that area.

The consent agenda consisted of only one item, #5-A, award of bid
for plugging two (2) wells at City Hall.

Information on Consent Item
5-ao
Award of bid for Plugging Two Wells at City hall.
The wells are being plugged because the State will
not let the City operate the wells within 150' of
gasoline tanks and because one of the wells (Trinity)
has a high concentration of sodium. In FY 1992-93
Budget, $20,000 was budgeted in the water budget for
plugging of the wells. Director of Public Works Barnes
and City Engineer, Eddie Cheatham recommend Millican
Well Service be awarded the alternate low bid at $18,400.
Aqenda Item #6, Public Forum
Bill Spivey, 1520 Randol Mill Road, Southlake. Mr. Spivey stated
he is requesting the City purchase a guard rail to protect his
property. He asked for pavement to be cut with grooves on the
curve. He stated he would consent to paying a portion of the
guard rail, however, he pays taxes and stated he feels, should be
enough. Spivey stated it is time to fix the problem.
Mayor Gary Fickes asked the Director of Public Works to
check on the exact cost of a guard rail.
Peter Sporrer, 1214 Woodsey Court, $outhlake. Mr. Sporrer
addressed Council in regard to the prayer in the schools and at
city hall during Council meetings. He asked that the issue be
protected by ordinance, in order to protect against things like
what is happening with CISD.

Reserve Fire Personnel

The City Manager, Curtis Hawk, explained Ordinance No. 554-A,
amends a Section of Ordinance No. 554, the Police and Fire Reserve
Ordinance, by removing the requirement that members of the reserve
force be certified within twelve (12) months of appointment. The
ordinance still requires the City to provide training to comply
with the appropriate state agencies.

Karen Gandy, Zoning Administrator, stated Memo Industrial Planning,
Inc., has requested a variance to the Masonry Ordinance No. 557,
requiring that "all exterior walls fronting a public right-of-way
shall be constructed using a masonry material, covering at least
eighty percent (80%) of said walls, exclusive of all windows,
doors, roofs, glass construction materials, or sidewalk and walkway
covers" .

David Carpenter, MEMO Industrial Planning, Inc., was present to
answer questions for Council. Mr. Carpenter presented pictures of
the proposed structure, and stated the structure will be located
approximately 500 feet from the street, and that the building will
only be high enough to get tractors in it, at 16 foot at the center
and 14 foot at the eaves.
Mayor Fickes stated when considering a variance, he likes
.to see an elevation prior to granting a variance.

look better than outside storage which is currently

The Final Plat of Timarron, Phase 2, being a total of 58.594 acres
and being developed in two sections. Section 1. is 16.812 acres
situated in the Hiram Grandberry Survey, Abstract No. 581 and the
O.W. Knight Survey, Abstract No. 899 and also being a replat of
Lots 1R and 2R of The Glory Place Addition. Section 2 is 41.782
acres situated in the Hall Medlin Survey, Abstract No. 1037, and

Karen Gandy, Zoning Administrator noted Section 1 will be marketed
as The Highlands and will have thirty-two (32) residential lots and
one (1) common green; Section 2 will be marketed as Bent Creek and
will have fifty-five (55) residential lots and three (3) common
greens.
On November 5, 1992, the Planning and Zoning Commission recommended
approval with a 7-0 vote, subject to the Plat Review Summary dated
November 5, 1992, and recommending the following changes: Delete
item %10, "Lot 1, Block 1, and Lot 51, Block 2 are reverse frontage
lots. The ordinance requires a side setback equal to the adjacent
front setback." On item #18, "Lot lines should not have
deflections," changing "should" to "will". Item# 20, "Although
there ar9 several lots which do not exactly meet the requirements
for radial or perpendicular lot lines, staff feels the lotting
generally meets the intentions of this requirement with the
exception of Lots 1 and 4, Block 5, and Lot 22, Block 7". On item
#23, "Lot 26, Block 7 is a reverse frontage lot. The ordinance
requires a side setback equal to the adjacent front setback."
The Summary Review Letter dated November 12, 1992 is in the packets.
Susan Evans, Timarron Land Corporation, stated they agree with the
letter dated November 12, 1992, with exception to item #3, Section
1, and item #4, Section 2.
Rod Johnson, 4720 North White Chapel Blvd., noted the Park Board
wanted to deny granting credit for park fees for this phase. He
stated they feel Southlake cannot afford to give this credit as it
will amount to approximately $21,000. When the Board asked
Timarron to allow the City the use of some of their property for a
short time they declined the city use. The Park Board feels we
need to stop issuing these credits, the City cannot afford it.
Mayor Fickes replied, the City gives credits

Agenda Item #8-Dt Ordinance No. 577t 1st reading Overnight
Camping
The City Manager, Curtis Hawk stated he feels Staff has addressed
the changes City Council previously requested in regard to the
Overnight Camping Ordinance No. 577.
The Zoning Administrator commented that this ordinance defines
"camping" and "recreational vehicles" and makes it unlawful for any
person to camp on any public or private property unless the
property is properly designated as a recreational campsite o:
campground. It also makes it unlawful for any person to occupy a
recreational vehicle for living quarters or office space except as
permitted in the Comprehensive Zoning Ordinance.
An amendment to the zoning ordinance will be necessary to eliminate
the language currently prohibiting the use of any recreational
vehicle for "living, sleeping or housekeeping proposes when parked
or stored on a residential or agricultural lot, nor in any location
not approved for such use." Attention should be given to the
specific language in the camping ordinance to prevent any conflict
with the camping privileges at Bicentennial Park proposed in the
Park Use Policy.
A draft of the zoning ordinance will go to the Planning and Zoning
Commission as an amendment to Ordinance No. 480, on December 3,
1992.

Agenda Item #8-E~ Ordinance No. §71~ 1st readinq. Lone Star Gas
Co. Franchise Aqreement
The City Manager Curtis Hawk stated the City Staff and City
Attorneys, and Lone Star Staff and Attorneys, have been discussing
the proposed new franchise agreement for a number of months.
Included in the packet are the final comments from city attorneys.
These have been reviewed by Lone Star Gas and have stated verbally
that they are ready to bring the agreement to City Council. The
agreement is for another twenty (20) years. An item of debate in
Section 10, on page 8e-2 includes: "provided, however, City shall
not grant more favorable conditions, including franchise fee, to
any other gas utility franchise than are herein granted to
company. The City Attorney stated she does not think we should
include this provision because, by doing so we are binding the
governmental powers of future Councils.
Vernie Henderson, Lone Star Gas Company was present and stated Lone
Star Gas Company suggests Section 10 on page 8e-2 remain. He
added, this statement clause is in all franchise agreements.
Councllmember Wilhelm suggests in Section 2, line 2, Council
deletes "city streets" and change to "public right-of-ways".
Councllmember Apple suggests as a clean up change, "appropriate
time" be changed to "30 days" He stated he would like to see Lone
Star Gas give a "level of spirit" and put it is writing. Mr. Apple
stated he wants the policy statement because this is a 20 year
contract and he wants stronger language.
Councilmember Wilhelm stated he feels comfortable with "promptly".
Mayor Fickes stated in the past Lone Star has had some problems,
however, they have upgraded their system.
Vernie Henderson stated they are regulated by Texas Railroad
Commission, and they will regulate the company.
Aubrey Smith, South White Chapel Blvd. Mr. Smith stated he has been
dealing with Lone Star Gas since 1946, if he has a problem, they
are right there. You can't beat Lone Star Gas Company.

Aqenda Item #7-At Ordinance No. 480-78~ 2nd readinq~ Zoninq
Ordinance No. 480-78, 2nd.reading, (ZA 92-41) is a rezoning request
for 5.45 acres situated in the L.H. Chivers Survey, Abstract No.
300, Tract 3A4, from "AG," Agricultural, to "C-2," Local Retail
Commercial. Owner: David Hardy.
Karen Gandy Zoning Administrator noted the 1st reading of the
Ordinance was approved by Council on November 3, 1992. During
Council's discussions, it was established that the existing
building would be upgraded to meet commercial code. The Council ·
noted the issues of upgrading the parking lot to an all weathe~
surface and requiring the applicant to meet the masonry ordinance
due to the change in use from residential to commercial.
The proposed occupant of the building came before Council in the
absence of David Hardy, owner, and stated she and a partner have
leased the building from David Hardy on an "as is" basis, and that
they must bring the building up to city codes and ordinances and
stating they were not told about paving the parking area. They
are only "temporary", and have no intention of purchasing the
property. Their lease is one (1) year with a one (1) year option.
Their lease is subject to zoning, however, they have invested a lot
of time and money, according to the occupant of the building.
Mayor Fickes stated during the 1st reading, the owner was informed
the building must be brought to up city codes and ordinances, and
that the parking area was discussed in terms of a "dust free
surface".
The applicant stated the estimate of $1,500 was given as a cost to
upgrade the parking area.

Councilmember Wilhelm stated after talking with the City Manager in
regard to the parking area, the parking area needs to be dust
free.
Dust Free Surfaces were discussed.
Councilmember Rick Wilhelm suggested approving a C-2 Zoning, giving
a "Temporary Occupancy" permit for a period of 90 days, in order to
allow them time to comply with "dust free surface", for the parking
area.
The City Attorney, E. Allen Taylor, stated the ordinance designates
the Building Official has the final say as to what constitutes a
dust free.surface.
Public Hearing:
Peter Sporrer, 1214 Woodsey Court, Southlake. Mr. Sporrer stated
the city has companies that have enlarged their business and he
does not see any "dust free", only gravel. This should be uniform
for all businesses.
Mayor Flckes stated the Building Official needs to be very clear,
what constitutes "dust free".
Motion was made to approve Ordinance No. 480-78, and direct city
officials to issue a temporary Certificate Of Occupancy as along as
all City Codes are met, in order for them to comply with dust
free surface, the temporary certificate is for no more than 90

Agenda Item #9-A~ Resolution No. 92-50 Appointment of Alternate
Judqe
Resolution No. 92-50, appointing an Alternate Judge of Municipal
Court, was discussed. Mayor Fickes state, Judge Brad Bradley ask
that the Alternate Judge be an attorney with experience in this
area. David Florance has served as Judge of the Municipal Court in
Grapevine for the past ten (10) years, and recently they have also
become a Court of Record so he has experience with that.
The Duties of the Alternate Judge is to serve as judge in the
absence of the Judge, and to arraign prisoners, also in the absence
of the judge. Fees for arraignments are $50 per arraignment and
$250. per court session. The term of office, as per Resolution No.
92-50 is a two (2) term.

Mayor Fickes stated Carman Blankenship has served
in that position for the past several years, however,
it is the understanding of Council that she plans to move
from the City in the near future.

that time.
Aqenda Item #10-C~ Park Use Policy Revisions
City Staff has reviewed the recommended changes to the current Park
Use Policy that have been made by the Parks and Recreation Board.
The focus of the revisions is to address a proposed fee structure
to cover the new Community Building at Bicentennial Park. Som~
terminology has been added to address the responsibilities of the
Parks and Recreation Coordinator position that will be on staff
beginning in January.
Specific changes involve the assessment of charges to groups that
may wish to use the Community Building. This fee change from
$10.00 to $15.00 for the Community Building. Other additions
include the rental offer of TV/VCR use for $5.00 and tennis racket
rental for $2.50 per hour per person. New sections addressing
building scheduling also appear in the policy.
The Parks and Recreation Board felt that the slight fee increase
for the new building was Justified in view of increased Janitorial
services that will be required to maintain the Community Building.
In Section I A.1. of the policy, "No group or individual may
reserve the Lodge and Community Building for regular meetings
from 4:30 p.m. on Friday to 12:00 midnight Sunday. These hours are
reserved on a first-come basis only, and reservations cannot be
made more than six (6) days in advance. No group or individual may
use the facility for more than three (3) consecutive weekends, not
to exceed twelve (12) weekends in a fiscal year." was discussed at
length.
Janet Murphy, Chairman of the Park and Recreation Board was present.
and reviewed the proposed policy changes. She explained the reason
for amending the policy in regard to Section I A.1. Also, the
building that was at the park will be known as "the Lodge" and the
new building will be known as "the Community Building".

A discussion was held as to whether or not a church could reserve
the buildings for Sunday morning services. Mayor Fickes stated he
understands the reason behind Section I A-l, however, he feels in
unusual circumstances, this section should be waived in order to
help a local church when they are faced with a disaster, such as a
fire.
Councilmember Apple requested all ordinances should contain
verbiage in regard to compliance with our Smoking Ordinance.

amendments:
1) add the "Smoking" clause to the policy.
.2) the last section of paragraph I A-1 be amended to
give variance authority to the Park and Recreation
Board, in regard to time schedules.

Benton
The City Manager, Curtis Hawk, stated this agreement will enable
the City to provide for drainage improvements along Shady Oaks.
The actual improvements will be funded by the developer, according
to the drainage ordinance.

Agenda Item %10-B~ Interlocal Agreement with Keller and KISD for
Sewer For Florence Elementary
The City Manager led the discussion in regard to and Interlocal
Agreement between the City of Keller, Keller ISD and City of
Southlake for Sanitary Sewer to Florence Elementary School. Hawk
stated this agreement will solve an immediate problem with Florence
Elementary School.

The agreement in Section VI will allow other Southlake customers to
connect to the line, and be billed for each connection on a monthly
basis based upon the system of charges that the City of Keller
levies upon its own system for the provision of comparable service
excluding prorata charges and impact fees. Staff will bill
customers Southlake's rate. The line will be sized to allow
Clmarron Acres and Vista Trails to connect.
In Section 4, page 3 of agreement, a sentence has been added, "it
is understood by and between the parties that the City of Southlake
shall retain the right to authorize such connections, as it deems
appropriate within the corporate limits of the City of Southlake."
Michael .Barnes, Director of Public Works stated KISD has had
problems in the past with their package treatment plant at Florence
Elementary meeting the Texas Water Commission's discharge
requirements.

Agenda Item #ii-A, Discussion: Speed Limit on S. White Chapel
Curtis Hawk explained this item was brought before Council in March
1992. City Council felt at the time the speed limits should remain
the same, but suggested Staff take a look after the speed limits
were reduced between Continental Blvd. and Bear Creek. The Mayor
and Staff have been experiencing problems due to the "S" curve, and
complaints have been received. Hawk stated he thought it is
appropriate to discuss the situation again and get Council
direction.
Mayor Fickes stated he has received a number of calls in regard to
the "S" curve and the danger in that are.
Aubrey Smith, 361 S. White Chapel Blvd. Mr. Smith stated the
traffic is bad on South White Chapel Blvd., the stripes on the
roadway have faded away. The double "S" curve is dangerous and is
right in front of his house. He would appreciate any consideration
City Council might give.

patrolling and enforcement.

The City Attorney, E. Allen Taylor, stated in order to set a
specific speed limit, it must have a study.
Mayor Fickes asked Mike Barnes to stripe the road and see
if that helps, if it doesn't, maybe the City needs
to lower the speed limit.
Director Campbell stated the Police Department will increase their
presence in that area.
Aqenda Item #10-D~ Priority List for Tarrant County Participation
for 1993 Street Construction
The City Manager stated omce again, we have received a letter from
County Commissioner Bob Hampton, requesting Southlake's priorities
on reconstruction project with County assistance. We need to
formally submit Council priority list.
Mike Barnes, Director of Public Works stated in the Budget Year
1992-93, $143,000 was budgeted to reconstruct and seal coat city
streets using County crews. Of the $143,000, $93,000 was budgeted
for reconstruction of streets and $50,000 was budgeted for seal
coating. The streets proposed for reconstruction were Johnson Road
and Continental, from South Carroll Road to South Kimball or about
10,000 linear feet of streets. The streets to be seal coated are
all the streets in Cross Timber Hills Subdivision or about 21,000
linear feet of streets.
Councilmember Jerry Farrier expressed concerns with what happened
in Southlake on Peytonville Avenue, using County crews, with regard
to trees.
After discussion, motion was made to approve submitting East
Continental Blvd., from White Chapel to Kimball Avenue and all of
Johnson Road as the priorities for FY 92-93.

Aqenda Item #10-E~ Street Selection for $1.5 Million Street Bond
Program
The Director of Public Works, Michael Barnes stated in July, staff
met with the "Southlake Citizens for Better Roads" committee to
discuss the selection of roads to be included in the first phase of
$4.5 Million dollar bond program. These include:
1. North Carroll- from SHll4 to Dove
2. N. Carroll- from FM 1709 to SHll4
3. Peytonville-from FM 1709 to Continental
4. N. Carroll- from Dove to Burney
5. Realign the intersections of Dove and
White Chapel and Carroll and FM 1709,
. and R.O.W. acquisition along Peytonville

Councilmember Farrier commented if the city finds intersections
that do not line up, we need to get the right-of-way before costs
go up, not necessarily making the improvements at that time.
Councilmember Wilhelm asked for costs for bike lanes, stating this
should be looked into while the opportunity is there. He would
like to see bike routes through the City if it is feasible.
Cheatham and Associates have proposed to do the drainage along the
creek.
Motion was made to approve the selection of roads for first phase
of the $4.5 Million Bond Program, eliminating Dove and White Chapel
for construction but not for engineering for right- of- way.

David Hardy, 519 Walton Pass, Irving, Texas. Mr. Hardy stated
the two people who wanted to lease the property came to the city
to inquire as to what they would have to do in order to use the
existing building for a gift shop. He stated, they were told they
needed to bring the building up to code and to rezone the
property. He stated, he is leasing the property "as is." He feels
they did what the Staff told them to do.

with, they will not have a certificate of occupancy.
Mr. Hardy stated he will "bail them out" in regard to the dust free
surface. He was upset that he was not given accurate information
and direction by city staff.
Councllmember Emerson stated he feels that is why Council approved
the 90 day temporary certificate of occupancy.
