The Work Session was called to order at 6:30 p.m. in order for
Council members to discuss the agenda items for tonight's meeting.
Mayor Pro Tem Rick Wilhelm called the Regular City Council meeting
to order at 7:05 p.m., in the absence of Mayor Gary Fickes.
Agenda Item #i-B~ Executive Session
Mayor Pro Tem Rick Wilhelm hereby advised the audience that Council
would be going into executive session pursuant to Section 2 (e)
2(f) 2(g) 2(j) of the Open Meetings Act, to seek the advice of our
City Attorney with respect to pending and contemplated litigations,
to discuss the purchase, exchange, lease or sale of real property,
and to consider the appointment and evaluation of public officials
and regarding the deployment of specific occasions for
implementation of security personnel or devices. Council adjourned
into executive session at 7:05 p.m.
Council returned to Open Session at 7:50 p.m.

Mayor Pro Tem Rick Wilhelm informed the audience that Mayor Gary
Fickes returned late this afternoon from a trip to Toyoma, Japan,
and wlll..not be present tonight.
The Mayor Pro Tem recognized members of the 4th Southlake
Leadership Group who were in attendance for the Council
meeting.
Agenda Item #41 City Manager's Report
The City Manager, Curtis Hawk, announced the Southlake Historica~
Society met last week in the new (TNB) Building at Bicentennia.
Park. It was their largest group, where twenty (20) citizens
attended. He invited all interested people to attend, adding,
this group will offer a lot to our community.
Agenda Item #5~ Consent Aqenda
Mayor Pro Tem Wilhelm announced that item #5-B, will be removed
from consent agenda.
The consent agenda consisted of the following items:

Public Works: Bid for Mid-Size Pickup Truck.
Staff recommends North Loop Dodge be awarded
the bid at $10,652.00. In FY 1992-93 Budget,
$12,000 was budgeted for this vehicle.

Finance: Resolution No. 92-52, authorizing
participation in the Trust Company's local
Government Investment Pool, "TexPool". The
objective of "TexPool" is to provide safe
environmnet for the placement of
public funds in short-term, fully
collateralizes investments. The weighted
average maturity of the investments in the Pool will
not exceed.120 days. Accounts are highly liquid,
with daily availability. Becoming a participant of
"TexPool" will simplify the investment process.
Agenda Item #5-B, Authorizinq Depository Aqreement with TNB
Councilmember Barry Emerson stepped down for this agenda
item as he has a vested interest with Texas National
Bank.
The City Manager, Curtis Hawk, stated this agenda item authorizes
the Mayor Pro Tem to execute a Depository Agreement between the
City and Texas National Bank, therefore, giving the city a formal
agreement. In 1987 the City requested and received a proposal for
depository services from TNB. The City has been operating under
the terms of the proposal, although it was never formalized. The
agreement before Council will formalize the existing relationship
while specifically enumerating key provisions.
LouAnn Heath, Director of Finance, stated it is proposed that the
City enter into a formal agreement with Texas National Bank for
depository services for a two year period, beginning October 1,
1992, with an option to renew for an additional two year term upon
mutual written consent of both parties. The Bank Depository
Agreement has been reviewed by officials of Texas National Bank,
city Staff, and City Attorney's, and is an acceptable version for
all concerned. The Agreement defines services required to be
provided by the Bank plus enumerates sDecifics regarding collateral
and safekeeping as required by State Statue. The Agreement names
the Director of Finance as the Treasurer of the City, plus
incorporates the City's signature requirements for checks written
against the City's accounts.

Agenda Item #6, Public Forum
Bill Spivey, 1520 Randol Mill Road, Southlake. Mr. Spivey stated
he lives on a 90 degree right hand curve on Randol Mill Road. He
stated there has been about ninety (90) accidents there in the last
twenty (20) years. Mr. Spivey asked City Council to look at the
situation and help him come up with a solution that will poss£bl~-
avoid more accidents. Spivey added, about 90% of the accident~
occur when the pavement is wet, and the accidents are always north
bound.
Mayor Pro Tem Wilhelm asked Michael Barnes, Director
of Public Works what type safety devices are currently
located in that area.
Councilmember Farrier stated obviously, road surface
is an issue.
Aqenda Item #7-A~ Ordinance No. 537~ 2nd reading, Smokinq
Ordinance No. 537, 2nd reading was discussed. City Manager, Curtis
Hawk stated the attorneys have made the changes as requested,
including: 1) smoking will be prohibited in public spectator
outdoor arenas, stadiums, etc., except in areas specifically
designated for smoking; 2) any restaurant with outdoor dining
areas that seat 50 or more shall provide nonsmoking areas.
The public hearing resulted with no comments from the audience.
Councilmember Barry Emerson again suggested a "sample
policy" for nonsmoking in businesses be provided to
businesses with their notification of this ordinance and
the provisions herein.

The City Manager stated he will also send a copy of the ordinance
and policy to the Chamber of commerce.
Councilmember Stephen Apple stated he will take the Ordinance to
the C.I.S.D. School Board meeting and ask them to pass a supporting
resolution.

1992," was discussed.
LouAnn Heath, Director of Finance, stated the City will be issuing
$1.3 Million in Certificates of Obligation for water and sewer line
improvements according to the recommendation made in the 1992-93
Budget.

According to the Finance Director, LouAnn Heath, the City's first
$1.5 Million increment of the voter authorized $4.5 Million General
Obligation Bonds was awarded on October 6, 1992. These bonds will
be used for the improvements of streets as designated by the City
Council and recommended by the Road Improvements Task Force.

Swimminq Pool Code-Local Amendments
Uniform
Ordinance No. 574, 2nd reading, Uniform Swimming Pool Code, 1991
Edition, including Local Amendments in regard to fencing, was
discussed.
The City Manager, Curtis Hawk, explained that several changes have
been made to the ordinance since 1st reading, as the result of the
comments made by City Council. The Code deals with electrical,
plumbing, etc. and other life safety issues for swimming pools,
spas, and hot tubs, however, fencing requirements pertain only to
swimming pools.
Public Hearing:
Dennis McGrath, 2403 North Carroll Avenue, $outhlake. Mr. McGrath
requested a change in wording to Section 6.02, however, the
Building Official, Lee Roberts requested the wording in Section
6.02 remain as it is.

Greg Last, Director of Community Development, noted six (6) notices
were sent to property owners within 200', and two favorable
responses have been received, from Betty Overstreet and E.J. Nash.
On October 8, 1992, the Planning and Zoning Commission recommended
approval with a 7-0 vote, subject to the Plat Review Summary Dated
October 1, 1992. Mr. Last stated a second Plat Review Summary
dated October 15, 1992, has been submitted.

Agenda Item #8-B~ Ordinance No. 573~ 1st readinq. Administrative
Code 1991
Ordinance No. 573, 1st reading, adopting the 1991 Edition of the
Administrative Code, was discussed. According to the Director of
Public Works, Michael Barnes, the City is currently under the 1988
Uniform Administrative Code. In order to bring the City into
compliance with the most up to date codes, the staff is requesting
that the 1991 Administrative Code be adopted. Barnes added, there
are approximately twelve (12) changes in the code, most of which
are either redefining or rewording, with no substantial changes
that would change the way a contractor does business.
Building Official, Lee Roberts was present to answer questions for
Council.

Agenda Item #10-A~ Final Payment and Change
Reconstruction of Post Oak Trail and Cypress Creek
The Director of Public Works, Mike Barnes, informed Council that
this project includes the reconstruction of Post Oak Trail and
Cypress Creek, and, drainage and curb and gutter facilities along
South Peytonville Avenue next to the new high school. The original
contract amount was for $151,723.14 with the final contract amount
being $163,057.78, a difference of $11,334.58.
Barnes detailed the cost of the overrun for Council, including:
additional asphalt, curb and gutter, and, additional valley gutters.
Councilmember Farrier expressed he is extremely pleased
with the contractor and the workmanship of the project.

Agenda Item #11-A~ Discussion: Ord. 572~ 1991 Fire Codes
This discussion item was led by Director of Public Safety, Billy
Campbell and Deputy Director of Fire Services, Jerry Williams.
Director Williams presented information in regard to lowering of
sprinkler square footage requirements, and, an ordinance adopting
the 1991 Edition of the Uniform Fire Code to include fifteen (15)

amendments. A copy of the proposed amendments are included with
the minutes
Williams stated the main reason for lowering the sprinkler square
footage requirements is to lower the required fire flow for a
commercial building when there is a fire. A fire doubles in size
every minute from the time it starts until water is applied. An
automatic sprinkler will extinguish most fires before they reach
the stage to cause a person not to be able to exit a building.
The City Manager stated he will bring this item back for 1st
reading during the November 3, 1992, City Council meeting.
Agenda item #11-BI Dis~ussion: Ordinance No. 577, Speed Limits in
Construction Zones on State Highways
Curtis Hawk, City Manager, presented a letter from the Texas
Department of Transportation, which stated it is sometimes
necessary for the department to reduce regulatory speed limits
within construction zones on the State maintained highway systems
in Southlake.
Director of Public Safety, Billy Campbell, stated this request is
not uncommon for the State Highway Department to set the speed
limits on State Highways during construction periods.
Councilmember Apple stated he would like for a time limit to be
placed on any site within the city.
Councilmember Emerson suggested a call be made to J.R. Stone in
regard to this issue.
Aqenda Item #11-Ci Discussion: Proposed Sewer Service to Pad Site
in park Place Subdivision
Director of Public Works, Mike Barnes informed Council that David
Watson, Manager of the property at Park Place, has requested that
the City of Southlake provide sewer for the proposed site, located
in Park Place Addition, in front, to the west of the Albertson's
Food Market. Barnes stated there are two ways to provide sewer to
this property. The best and most economical solution, according to
Barnes, is to connect to Grapevine sewer system and amending the
interlocal agreement between Southlake and Grapevine.

Mr. Barnes also noted, if that solution is not possible, the
remaining alternative would be to install a gravity sewer from the
pad site to a lift station location approximately 1,500 feet to the
west and run a force main from there to the existing lift station
on East Southlake Blvd. Cheatham and Associates has estimated the
cost of the gravity line, lift station and force main to cost
approximately $150,000. This lift station and force main would be
sized to serve the Oak Knoll area south of the lift station.
Since Mr. Watson has asked the City to provide sewer for the
proposed pad site, the City needs to decide which way it will be
provided. Mr. Barnes stated, it is his understanding that as soon
as the City guarantees sewer, the developer plans to start drawing
plans for.their building.
The City Manager, Curtis Hawk, stated he feels the City should make
a formal request of the City of Grapevine, for an amendment to the
Interlocal Agreement. It was the consensus of Council that this is
the way to go.

SUBJECT: Bank Depository Agreement
The City Council is scheduled to discuss the bank depository
agreement with Texas National Bank at the City Council meeting this
evening. I would like to offer some additional information that
may answer questions that may be asked at the meeting.
The agreement is a confirmation of the arrangement under which both
parties have been operating since 1987. The services provided by
Texas National Bank will continue to be performed as they have
been. I have attached to this memorandum a copy of Chapter 105 of
the Local Government Code which directs the selection of a
municipal depository. This agreement is in compliance with that
code.
The agreement contains additional provisions that more clearly
define the duties of the City and the bank.
1. The agreement adds language that incorporates State statute
regarding pledged collateral and safekeeping for the City's
accounts.
2. The check signing authority for all checks drawn upon City
accounts in included as part of the agreement.
3. The term of the agreement is detailed.
4. The City retains the authority to invest funds with other
institutions.
5. There is a termination clause included upon default of the Bank.
6. Fees for services are made a part of the agreement.
