The Work Session was called to order at 6:30 p.m. to discuss the agenda items scheduled for tonight's meeting. Mayor Gary Fickes called the Regular City Council meeting to order at 7:10 p.m. Agenda Item #l-B, Executive Session Mayor Fickes hereby advised the audience that Council would be going into executive session pursuant to Sections 2(e) 2(f) 2(g) 2(J) of the Open Meetings Act, to seek the advice of our City Attorney with respect to pending and contemplated litigations, to discuss the purchase, exchange, lease or sale of real property, and to consider the appointment and evaluation of public officials and regarding the deployment of specific occasions for implementation, of security personnel or devices. Council went into executive session at 7:10 p.m. Council returned to open session at 7:30 p.m. Agenda Item #3-B~ Open & Read Bids for Sale of C.O's. Agenda Item %2, Approval of the Minutes The Minutes of the Cit~ Council meeting held on May 5, 1992, were approved as presented, as well as the Minutes of the Special City Council Meeting to canvass the election, also held on May 5, 1992. Garland Wilson of the Southlake Department of Public Safety, proclaiming the week of May 11-16 as EMS Week. Proclamations were also presented, proclaming June 14, 1992 as "Flag Day", and proclaming Tarrant County Child Safety week from May 22 to 29. Mayor Fickes presented a plaque to former Councilmember Sally Hall and expressed appreciation to her for serving the citizens of Southlake from 1988 to 1992. He added, her dedication will truly be missed. The Mayor announced the FM 1709 Reconstruction -Curb and Gutter Project is one schedule, and the bid is to be let in July, 1992. Agenda Item %4~ City Manager's Report The City Manager, Curtis Hawk, stated the Department Reports are in the packet, if there should be questions, he and staff will be happy to respond to them. City Council Meeting Minutes May 19, 1992 page three Aqenda Item #5~ Consent A~enda The Consent Agenda consisted of the following items: 5-A Award of bid for gravity sewer line and force main at Bicentennial Park, contingent on developer of Crossroad Square Subdivision, submitting "Notice to Proceed" and a check in the amount of $6,656.40 to the City. 5-B Award of bid for repairs to front end loader. 5-C Baseball Summer Camp at Bicentennial Park. 5-D Resolution No. 9~-24, abandonment of drainage easement on Lot R5, Block 2 of Trail Creek Estates, Phase I, and authorizing staff to take appropriate actions to facilitate the abandonment. 5-E Interlocal Agreement with Tarrant County for Peytonville Road Reconstruction. 10-B Interlocal Agreement between the City of Southlake and City of Keller for water service on Davis Blvd. Motion was made to approve the items listed in as shown. Explanation of consent items: 5-A, Sewer at Bicentennial Park. Bid awarded to Brown Excavating at the low bid of $22,094.90 for the base bid ($15,438.50) and alternate bid of $6,656.40 paid by Crossroad Square. The base bid is for the 6" gravity sewer line from the TNB at the Park to proposed lift station in Crossroads Square. Alternate bid is for the 4" force main from the lift station to the gravity line in the Oak Hills Subdivision. In the 1991-92 Sewer Budget, $25,000 was budgeted to fund the installation of the park gravity sewer line. 5-B, Only one bid was received, from DFW Equipment Services, Inc. for $17,960, with a 90-day warranty on workmanship and six (6) months on parks. Budgeted amount for the repairs was $20,000. City Council Meeting Minutes May 19, 1992 page four Agenda Item #5~ Continued 5-C, Baseball Summer Camp, an instructional baseball camp at Bicentennial Park for children 7-10 and 11-14. Sam Booker of Southlake will serve as coordinator. A minimum number of 100 campers is required to hold the camp, with fees of $100.00 per person. Two, one week sessions June 1 and June 19. 75% of all registration fees collected will go to Mr. Booker. 5-E, Interlocal agreement with Tarrant County for Road Construction of Peytonville Road from F.M. 1709 to Raven Bend and approximately 700 feet south of F.M. 1709. Cost to reconstruct Peytonvllle from F.M. 1709 to Raven Bend .is estimated to be between $75,000 to $100,000 and will be paid by Arvida. Cost to reconstruct and widen Peytonvllle Avenue to 36 feet, approximately 700 feet south of F.M. 1709 is estimated at $15,000. 10-B, Water Agreement with Keller. Under the terms of the agreement, Keller will pay for all cost associated with the installation of the 6" water line from Union Church Road to Bear Creek (Southlake's south city limit boundary), including a 6" meter and vault. The meter will be placed near Bear Creek. This is a temporary connection as Keller will bring a water line down Union Church Road and Bear Creek and connect to their water line. Agenda Item #6-A~ Public Forum John Wilder, 141 Harrell Drive, Southlake, Texas. Mr. Wilder expressed that he is a concerned citizen who is also a amateur radio operator. His concern is in regard to hfs need for permission to operate his radios and the need for a tower at this residence. He has talked with the Zoning Administrator, and was informed of the process and need for application, public hearings, etc. He would like for Council to review the ordinance and allow him to proceed without the lengthy process. Me indicated he has surveyed residents in his area, and no one objects to the tower being erected at this residence. Jim Martin, 894 Randol Mill Avenue, Southlake. Mr. Martin spoke in regard to drainage problems and a bar ditch on Randol Mill Avenue. He alleged the bar ditch has not been cleaned out in ten (10) years. Martin indicated he will dedicate a sixteen (16) feet easement, if the city will respond to his concerns. City Council Meeting Minutes May 19, 1992 page five Agenda Item #6~ Continued Mayor Fickes asked the Director of Public Works, Mike Barnes, to work with Mr. Martin in regard to his concerns. Aqenda Item #7-A, Ordinance No. 480-F, 2nd reading "Churches" Zoning Administrator, Karen Gandy explained on March 3, 1992, Council directed staff to seek the Planning and Zoning Commission's recommendation on a revision to Section 45.1 (2), "Specific Use Permits" to allow churches, synagogues, temples and other similar facilities for workshop, fellowship and education to make application for this permit in "ALL" zoning districts. The City Attorney, Wayn~ Olson recommended that the permit not place a specific time limitation if churches were to locate permanently under the S.U.P. approval process. Should the permit be issued with no time limitation, specific language needs to be added to Section 45 whereby the City Council could revoke the permit should the church use be incompatible with the existing zoning or development in that specific area. On May 5, 1992, the City Council approved the first reading of Ordinance No. 480-F, deleting the three (3) year time limitation of the specific use permit. The public hearing resulted with no comments from the audience. Motion was made presented. Team Bank was awarded the bid, with a effective interest rate of 6.30151%, indicating they wish to purchase insurance. Motion was made to present award to Team Bank as noted above. Ayes: Emerson, Farrier, Nays: 'None Approved: 7-0 vote O'Brien, Franks, Apple, Wilhelm, Fickes Agenda Item #7-D~ Ordinance No. 562t 2nd reading Traffic Control Devices The City Manager, Curtis Hawk, explained the need for Ordinance No. 562, stating it would be replacing Ordinance No. 118, which was enacted in 1958. The ordinance changes the responsibility for the installation of traffic control devices from the Police Chief to the Director of Public Works. The ordinance also includes the latest requirements as required by law for the installation and placement of traffic control devices. This ordinance does not specifically repeal existing Ordinance No. 118, which addresses traffic control devices, but the attorneys determined that there are some items in the existing ordinance that should not be repealed. There is a "cumulative clause" in the new ordinance that repeals conflicting provisions with previous ordinances. There were no comments during the public hearing. Motion was made to presented. Park ZA 92-12, is a request for Concept Plan approval for office/warehouse facilities on Block B, Lot 4R, North Davis Business Park, being 0.77 acres out of the T.J. Thompson Survey, Abstract No. 1502. Current zoning is "I-l" Light Industrial zoning district. Location: 2104 Greenbriar Drive at Greenwood Drive. Owner/Applicant is Don Butler. Karen Gandy, Zoning Administrator made a presentation stating thirteen (13) notices were sent to property owners within 200' and received one (1) response in favor from Mercantile Bank of Fort Worth who stated this will be a definite asset to the area and is well planned. On May 7, 1992, the Planning and Zoning Commission recommended approval by a '6-0 vote, subject to the Plan Review Summary dated May 1, 1992. Mrs. Gandy noted a second Plan Review Summary is provided, dated May 15, 1992. Mayor Pro Tem Wilhelm had questions in regard to sewer system. Mrs. Gandy noted they plan to use a septic field, as there is not sewer in the area at this time. The system will be installed under the requirements of the Tarrant County Health Department. Mr. Don Butler was present to answer questions for Council. The public hearing resulted with no comments. Motion was made to approve the Concept Plan for office/warehouse facilities, subject to the Plan Review Summary dated May 15, 1992. Current zoning is "SF-1A" Single Family-lA Residential. Location: West side of the 1500 block of Sunshine Lane. Owner/applicant is Joel and Virginia Darden. Fourteen (14) notices were sent to property owners within 200' with no replies received. The Revised Summary Review letter dated May 15, 1992 was presented to Council. The public hearing resulted with no comments from the audience. Joel and Virginia Darden were present to answer questions for Council. Mr. Darden stated he feels the property will never be subdivided again, when questioned about the configuration of the lots. Motion: O'Brien Second: Farrier Ayes: O'Brien, Farrier, Franks, Apple, Emerson, Wilhelm, Nays: None Approved: 7-0 vote Summary Ftckes Council adjourned to recess at 8:15 p.m. Council returned to open session at 8:30 p.m. Agenda Item #480-01B, 1st reading (ZA 92-03) Zontng~ Timarron Ordinance No. 480-01B is a zoning request and revised concept plan approval for Timarron Planned Unit Development, amending Ordinance No. 480-01A, adding a 10.932 acre tract in the hall Medltn Survey, Abstract No. 1038, Tract 2F and a 1.008 acre tract of land in the John N. Gibson Survey, Abstract No. 591, Tract lB1. Current zoning is "AG" Agricultural, with a request for R-P.U.D. Residential Planned Unit Development. Owner: Timarron Land Corporation, Inc. Karen Gandy, Zoning Administrator noted that Parcel "A" is located on the east side of South White Chapel Blvd., between Continental Blvd. and Big Bear Creek. Parcel "B" is located at 1221 East Continental Blvd. The zoning requested would increase the acreage of the project from 902.80 acres to 914.74 acres. This "R-P.U.D." adjoins 184 acres to the South of Big Bear Creek in Colleyville which Timarron Land Corporation, Inc. also owns. This revised concept plan is proposed to meet the 2.18 du/ac density requirement and would allow 1994 residential lots. City Council Meeting Minutes May 19, 1992 page nine Aqenda Item #8-C~ Continued Mrs. Gandy stated sixty-seven (67) notices were sent to property owners within 200' and to date she has received five responses. Two (2) in favor; two (2) opposed and, one (1) undecided. On March 19, 1992, the Planning and Zoning Commission recommended approval by a 4-0 vote, subject to the March 13, 1992, Plan Review Summary, including all items. The Commission recommended that the "spine road" (north-south roadway from F.M. 1709) remain as shown on the plan but that the school site at South Carroll Avenue, and East Continental Blvd. be removed from the plan. City Council tabled this action on April 7, 1992 and May 5, 1992. Susan Evans, President of Timarron Land Corp. was present to explain the five changes listed below: 1) Tract A (Pollard Tract) is being added to the R-P.U.D. 2) Tract B (Currently shown as Open Space Corridor) is being changed to C-3 uses for Golf Club House. 3) Tract C (Currently shown as C-2 uses) is being changed to residential uses. Tract D (Currently shown as Open Space Corridor and Floodway Open Space) is being changed to Golf Course. 5) Tract E (Walton tract) is being added to the "R-P.U.D." Public Hearinq: Dennis McGrath, 2403 North Carroll Avenue, Southlake. Mr. McGrath stated what City Council saw tonight in the presentation is not what was approved by the Planning and Zoning Commission. Ayes: O'Brien, Apple, Emerson, Franks, Fickes Nays: Wilhelm and Farrier Approved: 5-2 vote City Council Meeting Minutes May 19, 1992 page ten Aqenda Item 8-C~ Continued Councilmember Wilhelm stated for the record, he thinks that overall, what Council is doing is allowing the developers to build on about 50 acres for club house, school use, commercial use, and to earn income and in addition, get credit as a density factor for the 2.18 units per acre. To him it goes beyond the intent of the ordinance, and he believes the intent of the ordinance would be to exclude that acreage that is not zoned for retail or open space uses. The City has however already zoned 902 acres for that and the city needs to stay with that. He is opposed to increasing the overall acreage against which the 2.18 units per acre can apply to the 914 acres. Agenda Item # 8-D~ ZA 92-04~ Development Site Plan for Timarron The Development Site Plan for Timarron, Phase III, "R-P.U.D." Residential Planned Unit Development, being 300.82 acres out of the Hall Medlin Survey, Abstract No. 1037, the Hollingsworth and Barrett Survey, Abstract No. 797, the O.W. Knight Survey, Abstract No. 899, and the M. Davenport Survey, Abstract No. 432. Owner: Timarron Land Development, Inc. Karen Gandy, Zoning Administrator, made a presentation in regard to the Development Site Plan for Tlmarron, Phase III, stating Phase III will consist of 314 unites on 139.09 acres, or 2.25 units per acre. She noted she received four letters from citizens within 200' of the property being considered. Two letters in favor and two letters opposing. Sixteen citizens responded from around the community. Susan Evans, President, Timarron was present, stating they have 1,100 acres in Southlake and Colleyville. Byron Nelson, Rt. 9, Box 5, Roanoke. Mr. Nelson presented an overview of the golf courses he has built, with the first being in Brookhaven in Dallas. He stated money has never been the reason he has built golf courses. Baxter Spann, 1001 Barry Ashford Road, Houston. Mr. Spann is the golf course architect, working with Mr. Nelson. He noted the golf course will have from 180-200 acres in the course. City Council Meeting Minutes May 19, 1992 page eleven Aqenda Item #8-D, Continued Public Hearinq Joyce Dawson, 501 San Juan, Southlake. Mrs. Dawson stated she is in favor of Timarron. Density is an issue, however, Southlake is growing and this is a quality development. The thirty-three (33) lots are not seen from Continental Blvd. Robert Downard, 1255 Randol Mill Avenue, Southlake. Mr. Downard is aware of the controversy of the small lots in Timarron. He spoke in favor of the development, as Southlake needs the tax base. He expressed reservations with the golf course, and prefers to see a linear park from Grapevine to Keller, along Big Bear Creek. He cannot deny anyone coming 6o Southlake. Dan Light, SouthRidge Lakes, Southlake. Mr. Light noted he is a home builder, and is in favor of Tlmarron, and stated, whatever it takes to make economics work to bring a quality development to Southlake, we need. Peter Sporrer, 1214 Woodsey Court, Southlake. Mr. Sporrer is pleased to hear Timarron is trying to save the trees in their development. Conner Lam, 1280 Post Oak Trail, Southlake. Mr. Lam lives on two (2) acres with substandard streets. We have a developer here (in Timarron) with a proven tract record. They do all the work and spend all the money. He hopes that one of these days the people will get over the "lot size issue". All the City Councilmembers need to do is be sure water lines are proper, streets are proper and he hopes they break ground next week on this development. Pauline Petes, 920 North Peytonville Avenue, Southlake. She is pleased about the pesticides. One thing no one has noted is the wild life that will be misplaced with this large development. The animals are starving, and this bothers her a lot. Councilmember Rick Wilhelm commented in regard to the 150 acre golf course, and keeping it green. Susan Evans stated they will use wells to irrigate the golf course. The wells will be both shallow and deep, with the water being held in the lakes. In regard to the golf course, their will be corridors around the "holes" with 300 to 350 feet away from the homes. Councilmember Wilhelm stated he has concerns with the lot sizes north of Continental Blvd. and the over all density to the east and west. He asked staff to continue any streets to the west. Steve Yetes, Timarron, stated on multi-lot sales to builders, they will be sure the same house will not be built on the same street. City Council Meeting Minutes May 19, 1992 page twelve Aqenda Item #8-D, Continued Mayor Flckes expressed concerns with the side yard in Product "C", starting he feels they need 15 feet. Councilmember Farrier stated he has a problem with that, and feels 15 feet is too close. Steve Howard, Timarron, stated they have not looked at the side yard issue in Product "C", since they increased the lot size to 10,500 square feet in that section. Councilmember Jerry Farrier stated from a safety standpoint and the illusion of crowded, he does have a problem. He stated, we are mortgaging the size of lots in all phases, because of the golf course, and he cannot suppbrt the concept. Susan Evans stated as overall 25% does not give them the flexibility they need for the street scape they want. Motion was made to approve the Development Site Plan for Timarron, Phase III, with the changes they have suggested with Product C, and with the recommendation of the Planning and Zoning Commission on all four Product Types, with the summary review letter dated May 1, 1992. Southwestern Bell Franchise Aqreement Curtis Hawk, City Manager, stated the franchise agreement between Southwestern Bell and the City expired in January, 1992. Last year a steering committee representing the Texas Municipal League member cities was formed to study the proposal due to the large number of cities faced with expiring telephone franchises, and the position taken by Southwestern Bell. Hawk noted a number of changes have been made to the ordinance since the 1st reading, however, there are two areas where no agreement has been reached. In the areas of indemnity and venue. City Council Meeting Minutes May 19, 1992 page thirteen Agenda Item #7-B~ Continued Gary Terry, Regional Manager, Southwestern Bell, addressed the issue of venue, stating they wish to have Dallas County remain, as that is where their office is located and they represent so many areas. They recommend the paragraph be deleted. Councilmembers Franks and Apple expressed, Southlake is the "customers", therefore, they insist the venue be in Tarrant County. City Attorney, E. Allen Taylor Jr., stated, if the venue paragraph is deleted, it will leave Southlake open to expensive litigation, should it become necessary. The City Attorney's Office is taking the posit~on that the paragraph needs to remain in the document. Gary Terry stated in Section 10, Indemnity, they have a problem with the paragraph where the word "solely" was left out. Mr. Terry suggested the two attorneys get together and try to work out the two areas in question. Mayor Gary Flckes stated, the city is "your" Southwestern Bell customers and Council feels strongly on these two issues. Motion was made to table this item, continuing the public hearing at the June 2, 1992, City Council meeting. Owner: Mullis 92-14)t Resolution No. 92-18, Specific Use Permit for the installation and use of a television satellite dish per the requirements of Ordinance No. 480, Section 45.1 (35) Chapel Downs. Current zoning is "SF-20A" Single Family-20A. Owner/applicant is G. Richard Mullis. Karen Gandy, Zoning Administrator noted eleven notices were sent to property owners within 200' and to date she received, two responses. One in favor at 106 Churchill and one opposed at 102 Belmont Place. She added, Planning and Zoning Commission recommended approval. Gandy feels the owners have made attempts to position the satellite dish so that it will be less obvious from the road. Mr. Mullis did agree to work with his neighbors. Public Hearing resulted with no comments from the audience. Search W~rrants Administrative Director of Public Safety, Billy Campbell, stated during the last Council meeting there were some questions concerning wording on the execution of a search warrant. The police already have legislative authority to obtain search warrants. This ordinance addresses non-police responsibilities in regard to the Construction Code, Housing Code and etc. Ordinance No. 561 is a tool to assist in the enforcement of existing City Codes. Councllmember Stephen Apple stated he had questions in regard to Section 7 and Section 14, he supports the entire ordinance and understands what the ordinance will do. He would like the verbiage in Section 4, item 2, repeated in Section 7 and Section 14, to make it more clear. The City Attorney suggested he add more verbiage to Section 7 and Section 14, as recommended by Councilmember Apple. Councilmember O'Brien asked the record to reflect that he has a lot of reservations with this ordinance. He feels the intent of the ordinance is good, but he feels it will create a lot of problems in the future. Motion was made to approve the 1st reading of Ordinance No. 561, Administrative Search Warrants, with the suggested changes to be made to Section 7 and Section 14. Motion: Farrier Second: Apple Ayes: Farrier, Apple, Franks, Nays: None Approved: 7-0 vote 92-23 was approved naming Councilmember Jon Michael Teen Court Advisory Committee representing City Sally Hall and Cathy Turner as members for a one (1) O'Brien, Wilhelm, Emerson, Fickes Agenda Item #10-At Proposed Road Projects and High School Drainage The City Manager, Curtis Hawk explained $101,000. is the amount in the FY 91-92 Road Reconstruction Budget. There are three subdivision streets and a drainage project that the Council needs to consider to reconstruct and install. The three (3) streets are Post Oak trail, Cypress Creek and Jellico Circle. According to the Director of Public Works, Michael Barnes, these streets have failed to the point that reconstruction is the best economical solution. To reconstruct these three streets with 6" of lime or cement stabilization and 2" of asphalt will cost approximately $106,000 to $115,000. From a visual inspection of the type of subgrade on all three streets, it appears that the above section would be adequate for Jellico Circle. Post Oak and Cypress Creek will probably need an additional 6" of base material to stabilize the road surface. Michael Barnes stated the drainage project to be considered is a ditch located between the proposed new road and the high school parking lot. Because of the existing topography, the ditch needs to be concrete lined or have underground pipe facilities installed to keep from duplicating the situation that exists on Carroll Road by the middle and elementary school. City Council Meeting Minutes May 19, 1992 page seventeen Aqenda Item #10-A~ Continued Councilmember Jerry Farrier stated for the record, his position in regard to street reconstruction in subdivisions, adding, our major street expenditures have been on arterial streets with changing from that fact as the result of the bond money. We are not going to be treating, with budgeted funds, streets that will be serving a very minor segment of the overall population. He is not saying these people are not deserving of the streets, but he is not sure that this situation is any different from the sewers in Continental Park, that involves city participation. He does not want this to imply that the city is wholeheartedly endorsing that they are going to put this street in for these people without any involvement on their part. It does concern him to take the budgeted funds that we have and ~pend it all on one subdivision or two. Farrier stated there may not be support for his position, but he wants it stated. Mayor Fickes asked the Director of Public Works to come up with other priority streets. The City Manager stated this will be a retreat item. Also, he will look into what is involved in a street assessment program. Agenda Item #11~ Other Items for Discussion Mayor Fickes informed the City Council of the funding crisis at the Roanoke Animal Shelter. That facility is used by people in Southlake, and other cities around us. He feels that facility is the best bet for the City of Southlake for animal control, versus other options. He does not know why Fort Worth Humane Society is cutting the shelter off. A group is going to Fort Worth in an attempt to persuade them to help keep the shelter open.
