Item 4LCITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT January 30, 2013 CASE NO: SV12-030 PROJECT: Sign Variance for Men's Wearhouse EXECUTIVE SUMMARY: REQUEST ACTION NEEDED ATTACHMENTS STAFF CONTACT: Case No. SV12-030 On behalf of Men's Wearhouse, Von Custom Sign is requesting a variance to the Sign Ordinance No. 704-F requirements for an attached sign on the south elevation that exceeds maximum letter height and the middle 75% of the single plane fagade; and an attached sign on the north elevation that exceeds maximum letter height. Men's Wearhouse will be located at 3030 E. Southlake Boulevard, unit #3 in Gateway Plaza Phase II. Von Custom Sign is requesting variances to the sign ordinance requirements for an attached sign on the south elevation that exceeds maximum letter height and the middle 75% of the single plane fagade; and an attached sign on the north elevation that exceeds maximum letter height. This portion of the development is not subject to the Gateway Plaza Phase I or Phase II Conditional Sign Permits. The previous tenant, Modia Home Theatre, gained variance approval for attached signs in the same locations. Southlake Boulevard. HISTORY: November 20, 2007 — City Council approved a variance request for Modia Home Theatre that allowed for maximum logo height for an attached sign on the south elevation facing Southlake Boulevard. The regulation allowed for 24'/2 inches; the proposed and approved logo height is 38 inches. June 19, 2012 — City Council approved a variance request for Modia Home Theatre that allowed an additional sign on the north elevation that exceeded maximum letter and logo height. The regulation allowed for 16 inch letters and 20 inch logo; the proposed and approved letter and logo heights were 20'/4 inches and 39 inches respectively. Case No. Attachment C SVII 2-030 Page 2 Sign Variance Application Demonstration Please demonstrate that the following conditions are applicable to the requested sign variance: 1. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. Table 4, section 7.2, number 4, restricts our effective sign area to the middle 75% of a single plane versus the entire facade. The projection of the storefront causes us to lose sign area thus reducing otherwise allowable letter height. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The previous tenant was allowed a larger sign and we are only asking for the same consideration. We did not design this storefront and are simply trying to work with current conditions. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. Our signage will compliment the overall look of the development and does not interfere or impede neighboring tenants and their ability to effectively advertise. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. This variance will allow Men's Wearhouse to appropriately advertise its brand according to its own high standards as well as compliment the look of the development while remaining in step with the spirit and purpose of the existing sign ordinance.
