1993-05-18 CITY OF SOUTHLAKE, TEXAS 667 NORTH CARROLL AVENUE, SOUTHLAKE REGULAR CITY COUNCIL MEETING MAY 18v 1993 MINUTES COUNCILMEMBERS PRESENT: Mayor Gary Fickes; Mayor Pro Tem Jerry Farrier; Deputy Mayor Pro Tem Barry Emerson. Members: Jori Michael Franks, Andy Wambsganss, Stephen Apple, and W. Ralph Evans. Councilmember Stephen Apple left the meeting after agenda item $4, due to illness. Councilmember Jon Michael Franks left the meeting during the recess. CITY STAFF PRESENT: Curtis Hawk, City Manager; Billy Campbell, Director of Public Safety; Bob Whitehead, Director of Public Works; LouAnn Heath, Director of Finance; Greg Last, Director of Community Development; Karen Gandy, Zoning Administrator; Jerry Williams, Deputy Director of Public Safety, Fire Services; Roger Stewart, Fire Marshal; Chris Terry, Assistant to the City Manager; Wayne K. Olson, City Attorney; and, Sandra L. LeGrand, city Secretary. INVOCATION: Mayor Pro Tem Jerry Farrier. WORK SESSION: The Work Session began at 6:30 p.m., where Councilmembers and Staff present were able to review agenda items for tonight's meeting. REGULAR CITY COUNCIL MEETING: The Regular City Council meeting was called to order at 7:00 p.m., by Mayor Gary Fickes. Aqenda Item ~I-B, Executive Session Mayor Gary Fickes advised the audience that Council would be going into executive session pursuant to Section 2(e) 2(f) 2(g) 2(j) of the Open Meetings Act, to seek the advice of our City Attorney with respect to pending and contemplated litigations, to discuss the purchase, exchange, lease or sale of real property, and to consider the appointment and evaluation of public officials and regarding the deployment of specific occasions for implementation of security personnel or devices. Council adjourned into executive session at 7:05 p.m. Council returned to Open Session at 8:10 p.m. &qenda Item ~1-C, Action Necessary/Executive Session No action was necessary as the result of the Executive Session. Regular City Council Meeting Minutes May 18, 1993 page two Agenda Item #2, &DDroval of the Minutes The Minutes of the Special City Council Meeting to Canvass the Election held on May 1, 1993, and the Minutes of the Regular City Council meeting also held on May 4, 1993, were approved as presented. Motion: Farrier Second: Emerson Ayes: Farrier, Emerson, Franks, Evans, Apple, Wambsganss, Fickes Nays: None Approved: 7-0 vote Aqenda Item ~3, MaYor's RePort Mayor Fickes announced that a public hearing will be held on June 9, 10:00 a.m. at the Keller Church of Christ for the purpose of discussing Keller's proposal for medians on FM 1709. The Mayor also noted on July 29, 1993, a delegation from Southlake will be going to Austin to meet with the Texas Highway Commission in regard to scheduling improvements on SH 114. On May 20, the Southlake Chamber of Commerce will be sponsoring a "Jigglin Gelatin Slide" in the parking 10t of LaCasa Restaurant. Mayor Fickes and other area mayor's will be going down the slide into a 500 gallon tub of "green jello". This event will be sponsored by the Tri-Cities Chapter of the National Multiple Sclerosis Society and the Southlake Chambers. Each slider is required to raise a minimum donation of $100 to take the plunge. Councilmember Stephen Apple announced this week, the Carroll Independent School District, Campus Decision Committee elected Director Billy Campbell, as a community representative. The election was held by secret ballot, and, being selected is a real honor. Apple added, he is very proud of Campbell, and he is an asset to the community. Aqenda Item ~4, city Manaqer's Report The City Manager, Curtis Hawk reminded the Council that department reports are in the packets. If there are questions, the directors are present and will respond. Counoilmember Apple left the meeting at this time, as he was feeling ill. Sanitary Sewer Easement Dedications, service Lake Crest. two instruments to Motion was made to approve item #5-A as a consent item. Motion: Emerson Second: Evans Ayes: Emerson, Evans, Franks, Farrier, Wambsganss, Fickes Nays: None Approved: 6-0 vote Additional Information on Consent Item 5-A. The purpose of the two off-site easements for the Lake Crest Addition, are to provide sanitary sewer service for this addition. One of the sanitary sewer easements traverses a portion of the existing Section II, Phase I, Timber Lake; the second is an extension of the first and crosses a future phase of Timber Lake. Aqenda Item ~6, Public Forum Peter Sporrer, 1214 Woodsey Court, Southlake. Mr. Sporrer provided Council with packages of "Green Jello" as a thank you for participating in a community fund raiser. Ann Essig, 315 Dove Creek Trail, Southlake. Ms. Essig came to the meeting as a reminder to Council of her drainage problems in Summerplace Addition, adding, the drainage easement is in need of being cleaned out. She asked for Council consideration. cindy Huff, 314 Dove Creek Trail, Southlake. Ms. Huff also came as a reminder of the drainage easement problems they have in the Summerplace Addition. She also, asked Council for consideration on this matter. Sally Hall, 1609 Mockingbird Lane, Southlake. Mrs. Hall presented to Council pieces of "Mockingbird Lane", which she indicated, is in need of repair. Mrs. Hall alleged she has asked the City for four (4) years to repair her road. She asked Council to consider this road when preparing the budget. A1 Sutton, 3269 Lake Drive, Southlake. Mr. Sutton spoke in regard to agenda item ~10-C, award of bid for street and drainage on North Carroll Avenue, from Dove Road to Burney Lane. He stated the City needs to stick to the conditions set forth in the "Bond Election". The City does not need to work on the drainage, but stay with the original plan (roads). Sutton stated he is a tax payer and does not want the road to be put in like the plans. He referenced Jellico Circle and the problems with that road. Mr. Sutton stated he has lived in Southlake for twenty-five (25) years. He was here prior to North Carroll being built. If a hydraulic study were done prior to bidding it would not require so much money. The tax money is not being spent as planned, according to Sutton. &qenda Item #7-A, Ordinance No. 583, 2nd readlnq, sammons Cable Franchise Aqreement Ordinance No. 583, 2nd reading, is a Franchise Agreement with Sammons Cable Company for Cable service in parts of Southlake. At the request of the City Attorney, this item is being tabled until June 1, 1993, City Council meeting, continuing the public hearing, at that time. Ordinance No. 480-K, 2nd reading, amending the Zoning Ordinance No. 480, as it relates to issuance of building permits on platted lots which do not front on a public or private street, which meets city standards. Greg Last, Director of community Development, stated staff has been asked to issue a building permit for a platted lot which does not front on a public or private street which meets city standards. The case currently before staff is in Spring Oaks Addition, North of Dove and East of Ridgecrest. The public hearing resulted with no comments from the audience. Greg Last, Director of Community Development introduced Ordinance Ordinance No. 585, Tree Preservation Ordinance, stating, after many months of research and review, the Planning and Zoning Commissioners and Staff are happy to forward the Tree Preservation Ordinance for Council consideration. A copy of the ordinance and other information provided, is hereby attached to the minutes. The recommendation was made to Council that the ordinance be tabled, as the City Attorney has not completed the review of the ordinance. Several Councilmembers commended Mr. Last on a job well done, with this ordinance. Motion was made to table action on Ordinance No. 585, time certain, June 1, 1993. Agenda Item ~9-A, Resolution No. 93-42, Aqreement in SuDnort Joint Utilization between the City and School; Guidelines 1st reading, of Assistant to the City Manager, Chris Terry, presented Resolution No. 93-42, which is an agreement established by the Joint Utilization Committee. The Committee will be charged with the responsibility of exploring opportunities and methodologies to enter into joint use projects between the City and the C.I.S.D. Board of Trustees. Terry went on to explain, the purpose of the agreement is to pursue sharing of facilities, maintenance, equipment, research, and other cost saving measures to the benefit of both the two entities. The Co-Chairs for the committee are Buddy Luce and Rick Wilhelm. Members include: Stephen Apple, Janet Murphy, Bethann Scratchard. An ex-officio member of the city and School are included. Wambsganss, Fickes Regular City Council Meeting Minutes May 18, 1993 page six Aqenda Item ~9-B, Resolutlon No. 93-36, Appointment to P&Z. Resolution No. 93-36, allows for the appointment of members to the Planning and Zoning commission. Mayor Fickes noted these appointments were discussed in executive session, and Council wishes to table this item until the next meeting, leaving the current board in place until the new appointments are made. Motion was made to table Resolution No. 93-36, time certain, June 1, 1993, appointments to the Planning and Zoning Commissions. Agenda Item #9-C, Resolution No. of Adjustments. 93-37, Appointments to the Board Resolution No. 93-37, was approved, naming Karen Reynolds and Joe Bentley to another term; naming Bill Towler, as a regular member for a new term; leaving the alternate #2 position vacant for this time. Motion was made to approve Resolution No. 93-37, as noted above. The appointments are to include three (3) citizens, and one (1) council representative. Motion was made to appoint Rick Wilhelm, David Baltimore as the members, with Barry Emerson Council Representative. Motion: Farrier Second: Evans Ayes: Farrier, Evans, Franks, Emerson, Wambsganss, Nays: None Approved: 6-0 vote Bethann Scratchard, and serving as Fickes Regular city Council Meeting Minutes May 18, 1993 page seven Aqenda Item ~9-E, Resolution No. 93-39, Appointment to Parks Board Resolution No. 93-39, allows for the appointment to the Parks and Recreation Board, filling the unexpired term of Carol Lee Hamilton, who resigned to file for a place on City Council for May 1, 1993 Election. Motion was made to approve Resolution No. 93-39, naming Carol Lee Hamilton to fill the unexpired term, to expire in January, 1995. Motion: Wambsganss Second: Emerson Ayes: Wambsganss, Emerson, Franks, Farrier, Evans, Fickes Nays: None Approved: 6-0 vote Agenda Item ~93-40, Resolution No. 93-40, Appointments to Teen Court Advisory committee Resolution No. 93-40 allows for the appointments of members to the Teen Court Advisory Committee. The Council is responsible for appointing one (1) Council Representative and two (2) citizens. Motion was made to approve Resolution No. 93-40, naming Sally Hall and Cathy Turner as members, with Andrew Wambsganss serving as Council Representative. Motion: Evans Second: Franks Ayes: Evans, Franks, Farrier, Fickes Nays: None Abstentions: Wambsganss and Emerson Approved: 4-0-2 Agenda Item ~10-A, Developer Aqreement for Myers Meadows, Phase I. Counoilmember Emerson stepped down for item #10-A. Director of Public Works, Bob Whitehead presented the Developer Agreement for Myers Meadows, Phase 2, stating the agreement contains the standard requirements for the provisions of water, sewer, streets and drainage. The standard maintenance bonds, inspection fees park fees, and perimeter street fees are included, however, there are a few conditions which are unique to this phase which resulted in revisions to our standard agreement. Fred Joyce, Developer was present to answer questions for Council, and discussed the amenities with Council adding, the development will have 21.1 acres of park land; a small children playground; ballfields for softball, soccer, or football; jogging Regular city Council Meeting Minutes May 18, 1993 page eight Aqenda Item #10-A, Continued trails; a cabana; rail fence with stone columns; tennis courts; and, they will hydramulch the area and add sprinkler systems. Joyce noted the tennis courts will be in Phase II, and only 1/2 of the Jogging Trails will be in Phase I. They are providing a place for a community pool. Councilmember Farrier expressed he feels these amenities have more than satisfied the intent of the Park fees at this time. Motion was made to approve the Developer Agreement for Phase I of Myer Meadows Addition, as discussed, with the following: A. Allowing developer to present bonds as they need them. Allowing developer twelve (12) lots to be released, instead of the usual 10% of the lots (9 lots in this case). Accepting Staff recommendation in that the Inspection Fees be paid prior to construction, in the amount of 3%. Review the wording in regard to developer's request that no work will begin on any street prior to complying with the requirements contained in the agreement. Revise the wording in regard to Erosion Control. The developer, not the contracto~will bear the expense. Sewer Impact Fee: not required by the Developer, but by the Contractor prior to building permit. Off-Site Drainage: share prior to the II. the Developer agrees to pay their beginning of construction for Phase H. Grant a 50% credit for Park Fees, for Phase I of Myers Meadow Subdivision, with the fee due prior to final acceptance. Perimeter Fee for approximately 1,819.62 feet will be paid, in the amount of $17,231.25, as per ordinance. Motion: Farrier Second: Evans Ayes: Farrier, Evans, Franks, Wambsganss, Fickes Nays: None Approved: 5-0 vote Regular City Council Meeting Minutes May 18, 1993 page nine Council adjourned for recess at 10:00 p.m. Council returned to open session at 10:20 p.m. Councilmember Franks left the meeting at this time Counilmember Emerson returned to the Council table Aqenda Item ~10-B, Request for Variance for a Temnorarv Turn-Around Roger Stewart, Fire Marshal, introduced the material in regard to the request for a variance for a temporary turn-around made by Phil Jobe, Stone Lakes, Phase II. Mr. Jobe has contacted the Department of Public Safety on several occasions concerning the turnaround on Dartmouth Drive. After examining the alternatives given to Mr. Jobe he has requested to visit with the Council in that he feels none of the alternatives are compatible with his design. There ars several factors that Director Williams and the Department of Public Safety wish for Council to take into consideration. Mr. Stewart stated a provision for turn arounds are requested under the Uniform Fire Code, 1991 Edition, for roads over 1,500 feet. Mr. Jobs expressed concerns that in order to comply, trees will have to be taken out. He does not want to take out large trees for a temporary turn around. Motion was made to approve the temporary turn around provided the driveways of Lots 78 and 77 adjoin at the common property line, for use as a turn around. Motion: Farrier Second: Evans Ayes: Farrier, Evans, Wambsganss, Emerson, Fickes Nays: None Approved: 5-0 vote Agenda Item 10-C, Award of Bid for Street and DrainaGe Imnrovements on North Carroll Avenue, Dove Road to Burney Lane. Eddie Cheatham, city Engineer led the discussion in regard to award of bid for street and drainage improvements on North Carroll Avenue, from Dove Road to Burney Lane. On May 12, 1993, bids were opened and read aloud for the reconstruction project. Low Base Bid was submitted by Sunmount Corporation in the amount of $200,913.75. This bid amount includes the cost of drainage improvements, which was not included in the Street Construction Committee's Task Force estimate of $125,000. The base bid called for a 22 feet wide roadway, no shoulder and necessary drainage improvements. This was the recommendation from the Task Force. The alternative bid specs included a 24 foot roadway, 4 foot stabilized shoulders, and ditches and culverts designed to contain the 100 year flood. Regular City Council Meeting May 18, 1993 page ten Hinutes Aqenda Item #10-C, continued According to Cheatham, staff feels that proper drainage of a street is a key factor in maintaining a street and therefore recommends that the drainage facilities and the ditches be constructed along with the street paving of Carroll Avenue. Scotty Sutton, 3269 Lake Drive, Southlake. Mr. Sutton questioned Mr. Cheatham regarding the need for drainage improvements to be included at this time, stating he feels as a tax payer it will be to expensive at this time. Sutton also questioned the specifications, and feels they should comply with the Bond Committee's recommendation. A1 Sutton, 3269 Lake Drive, Southlake. Mr. A1 Sutton requested Council not approve the award of bid at this time, as it is not cost effective to put in the type street as in the specifications. Council requested Director of Public Works, Bob Whitehead review the specifications, so that he may become more familiar with the project, as he will be the one responsible for the maintenance. Whitehead indicated he could review the plans and report to city Council within the next two (2) weeks. Eddie Cheatham commented on the failures in the construction of Jellico Circle, stating, he feels rains were a major factor in the failure of the road construction. A1 Sutton questioned how many miles of roads were proposed in the Bond Election. He does not feel there is a drainage problem on North Carroll Avenue. He feels we should not "fix it" if it is not "broken". Mayor Fickes and Councilmember Emerson stated they feel Bob Whitehead deserves the right to review the specifications for the roads, not because they feel something has been done improperly in the bids. Whitehead stated, he will review the specifications, but not Mr. Cheatham's qualifications. Councilmember Farrier asked the City Attorney to review the requirements of the Environmental Protection Agency. Mr. Last discussed with Council, selected areas of the map. Mayor Fickes suggested a work session be held with Council and P&Z, in order for Greg Last to have more time to review the information with Council. A work session has been set for May 25, 1993, at 7:30 p.m. in the Council Chambers of City Hall. Motion was made to table action of the Land use Plan Map, continue the public hearing during the June 1, 1993 meeting. Hawk, City Manager FROM: Greg Last, Community Development Director SUBJECT: ORDINANCE NO. 585 - TREE PRESERVATION Draft Number Six, Dated 5/18/93 N o MOM After many months of research and review, the Planning and Zoning Commissioners and Staff are pleased to forward the Tree Preservation Ordinance for your review. Following is a summary of the key provisions of the ordinance: 1. The "Protected Tree" size is 8" diameter. This protects the o r majority of mature trees. or 2. Not all trees 8" or larger are protected, only those on the or Quality Tree list or Marginal Tree list. (See definitions.) 3. The City must also meet the requirements but is not required to obtain a permit. 4. Franchise utility companies must obtain a permit prior to removing or pruning trees in existing public R.O.W. or 5. All areas within R.O.W. and easements as shown on a Final Plat of a development are exempted from the requirements. This means that trees may be removed as necessary to put in the streets, drainage and utilities. orm 6. Residential homeowners are exempted from this ordinance. 7. Builders may remove trees as necessary to build house, driveway, sidewalks, etc. No other trees can be removed without permit approval. 8. A variety of exceptions (Section 3.6) have been provided for or practical reasons. 9. The ordinance is set up to be administered by a "Landscape Administrator" which is defined in the Landscape Ordinance as o r "The City Manager or his designee ". It would be my recommendation to train the building inspections staff to *m enforce this ordinance with myself as problem solver. 10. Section 6.2 defines several prohibited activities within the critical root zone (CRZ) of a protected tree. .. OM 1r NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: TREE PRESERVATION ORDINANCE 1.0 PURPOSE AND INTENT The purpose of this ordinance is to encourage the preservation of mature trees and natural areas, to preserve protected trees during construction and to control the removal of protected trees when necessary. It is the intent of this ordinance to achieve the following: - Prohibit the indiscriminate clearing of property. - Protect and increase the value of residential and commercial ' properties within the City. 0 - Maintain and enhance a positive image for the attraction of new business enterprises to the City. rr - Protect healthy quality trees and promote the natural or . ecological environmental and aesthetic qualities of the City. 2.0 DEFINITIONS • 2.1 GENERAL RULES: For the purpose of this ordinance, the following rules shall be applied in constructing, interpreting or otherwise defining the terms and provisions hereof: a. Words used in the present tense shall include the future, words used in the singular number shall a. include the plural number and words used in the plural shall include the singular. b. The word "shall" is mandatory and the word "may" is permissive. 2.2 DEFINITIONS: For the purpose of this ordinance, certain words or terms applicable hereto are defined as hereinafter provided. Words and terms used in this ordinance, but not defined in this ordinance shall have the meanings ascribed thereto in the Zoning Ordinance, Landscape Ordinance or other ordinances of the City. •pp. Words and terms defined in two ordinances shall be read in harmony unless there exists an irreconcilable conflict in which case the definition contained in this ordinance shall control. or BUILDABLE AREA: That portion of a building site exclusive of the required yard areas on which a structure or building improvements may be erected and including the actual structure, driveway, parking lot, pool and other construction as shown on a site plan. BUILDING PAD: The actual foundation area of a building and a reasonable area around the foundation necessary for construction and grade transitions. 0 I 0 oft CRITICAL ROOT ZONE: The area of undisturbed natural soil m. around a tree defined by a concentric circle with a radius equal to the distance from the trunk to the outermost portion of the dripline. DRIP LINE: A vertical line run through the outermost portion of the canopy of a tree and extending to the ground. a ,,,,, LIMITS OF CONSTRUCTION: A delineation on the graphic exhibit which shows the boundary of the area within which all construction activity will occur. MUNICIPAL /PUBLIC DOMAIN PROPERTY: Examples of this would include City Hall, public parks, Corps of Engineers property, State of Texas R.O.W., library, fire stations, water tower sites or similar properties. PROTECTIVE FENCING: Snow fencing, chain link fence, arbed wire fence, orange vinyl construction fencing or other similar ma fencing with a four foot (4') approximate height. TREE: Any self - supporting woody perennial plant which will attain a trunk diameter of three (3) inches or more when measured at a point four and one -half feet (4.5') above ground level and normally an overall height of at least twenty (20) +rr feet at maturity, usually with one (1) main stem or trunk and many branches. TREE, QUALITY: A tree which the City has determined typically has significant positive characteristics worthy of preservation. (See Appendix) TREE, SPECIMEN: A tree which has a diameter of 8" (Approx. 25" circumference) or greater at breast height, four and one -half feet (4.5') above the ground. The diameter of a multi -trunk tree shall be determined by adding the total diameter of the largest trunk to 1/2 the diameter of each additional trunk. (Appendix 'E'.) Franchise and Other Utility Companies: All utility company projects shall be subject to the requirements for tree preservation and replacement specified herein. 1. Permit requirements: A tree - removal permit must be obtained prior to the removal of a protected tree. This permit must be accompanied by a site plan or construction plan meeting the graphic exhibit requirements specified herein. It is anticipated that the franchise would include typical pruning, boring or other requirements to be met by Hom their contractor in order to do the required MN work in the City. 3.4 NEW DEVELOPMENTS: All developments which have not submitted final construction plans as of the effective date of this ordinance shall be subject to the ,,. requirements for tree preservation and replacement specified herein. Residential Subdivisions: All area within public R.O.W., utility easements or drainage easements as shown on an approved Final Plat and areas designated as cut /fill on the master drainage construction plan approved by the Landscape Administrator shall be exempted from the ++M" requirements specified herein. Deferrals: The Landscape Administrator may defer the approval of a tree removal permit to the Planning and Zoning Commission for any reason. All decisions made by the Commission shall be final. b. Appeals: Any decision made by the Landscape Administrator may be appealed to the Planning and Zoning Commission. All decisions made by the Commission shall be final. 4.2 SUBMITTAL REQUIREMENTS: The Landscape Administrator shall establish administrative procedures necessary to facilitate the implementation and enforcement of this ordinance. MIN a. Tree - Removal Permit: A request for a tree - removal permit must be submitted and approved prior to the removal of any protected tree in the City. (See Appendix 'B' for example permit.) b. Fees: All tree - removal permits shall be accompanied ism by a check made payable to the City of Southlake in the amount specified by City Council. two c. A sufficient number of trees shall be planted to equal, in caliper, the diameter of the tree removed. Said replacement trees shall be a minimum of 3" caliper (at 1' above ground) and 7 feet in height when planted. At the On time of review, the agent responsible for replacement, the time of replacement and the location of the new trees will be determined by the Landscape Administrator. The replacement trees shall be located on the subject site whenever possible, however if the applicant does not feel +wr this is feasible, the Landscape Administrator has the authority to allow the planting to take place on another property. Franchise utility companies shall be exempt from this requirement. 6.0 TREE PROTECTION A major purpose of this ordinance is to protect all quality trees which are not necessarily removed to allow approved - construction to occur. The following procedures are required in the situations noted, however unique circumstances may be accommodated by the Landscape Administrator. 6.1 Construction Plan Requirements: All construction plans shall include the requirements noted in Appendix 'C'. rm am 6.2 Prohibited Activities: The following activities shall be prohibited within the limits of the critical root zone of any protected tree subject to the requirements of this ordinance. a. Material Storage: No materials intended for use in construction or waste materials accumulated due to hr excavation or demolition shall be placed within the limits of the critical root zone of any protected tree. b. Equipment Cleaning /Liquid Disposal: No equipment shall be cleaned or other liquids deposited or allowed to flow overland within the limits of the critical root zone of a protected tree. This would include paint, oil, solvents, asphalt, concrete, mortar or similar materials. err c. Tree Attachments: No signs, wires or other attachments, other than those of a protective nature shall be attached to any protected tree. it d. Vehicular Traffic: No vehicular and /or construction 401 equipment traffic or parking shall take place within the limits of the critical root zone of any protected tree other than on an existing street pavement. Intent is to allow single incident access within the CRZ for purposes of clearing underbrush, establishing the building pad and associated lot grading. Also intend to allow vehicular traffic necessary for routine utility maintenance or emergency restoration of utility service. "" e. Grade Changes: No grade changes in excess of 4" (cut or fill) shall be allowed within the limits of the critical root zone of any protected tree unless ,.. adequate construction methods are approved by the Landscape Administrator. two f. Impervious Paving: No paving with asphalt, concrete or other impervious materials in a manner which may �rw reasonably be expected to kill a tree shall be placed within the limits of the critical root zone of a protected tree except as otherwise allowed in this ordinance. 6.3 Preserved Tree: A protected tree shall be considered to be preserved only if a minimum of 75 of the critical root 1. zone is maintained at undisturbed natural grade and no more than 25% of the canopy is removed due to building encroachment. ow taw 8/1 ori 6.4 Prior to Construction: At the discretion of the Landscape Administrator, the following alternative procedures shall ,aim be followed on all types of construction projects (i.e. residential subdivisions, commercial, multi - family, industrial developments, residential builders and municipal /public). ttmt to a. Tree Flagging: All protected trees on the subject property within forty feet (40') of a construction area or surface improvements such as driveway, walks, etc. shall be flagged with bright fluorescent orange its vinyl tape wrapped around the main trunk at a height of 4' or more such that the tape is very visible to workers operating construction equipment. This shall not include the flagging of all protected trees adjacent to R.O.W. within approved residential subdivisions during the construction of the roadway. 11 b. Open Space Flagging: All trees or groups of trees within areas intended to be saved as open space shall be enclosed with fluorescent orange tape along all areas of possible access or intrusion by construction equipment. Tape shall be supported at a maximum of 25' intervals by wrapping trees or other approved methods. Single incident access for the purposes of clearing underbrush is allowed. c. Protective Fencing: In those situations where a protected tree is so close to the construction area that construction equipment will infringe on the root system, a protective fencing may be required between the tree and the construction activity. d. Bark Protection: In situations where a protected tree remains in the immediate area of intended construction, the tree shall be protected by enclosing .�. the entire circumference of the tree with 2" x 4" lumber encircled with wire or other means that do not to damage the tree. The intent here is to protect the bark of the tree against incidental contact by large construction equipment. wrr 6.5 Permanent Construction Methods: 4 a. Boring: Boring of utilities under protected trees may be required in certain circumstances. When required the length of the bore shall be the width of the critical root zone at a minimum and shall be a minimum depth of 48 ". In particular this requirement would typically pertain to franchise utility installations. b. Grade Change: In situations where the grade change within the critical root zone of a protected tree exceeds four inches (4 "), the procedures noted in the City standard detail sheet shall be required. to ier c. Trenching: All trenching where possible shall be designed to avoid trenching across the critical root ,�. zone of any protected tree. This shall not inhibit the placement of necessary underground services such as electric, phone, gas, etc. 1. Root Pruning: It is recommended that all roots 2" • or larger in diameter which are exposed as a result of trenching or other excavation shall be cut off square with a sharp medium tooth saw and covered with pruning compound within 2 hours of initial exposure. 7.0 TREE PRUNING RESTRICTIONS 7.1 General: No protected tree shall be pruned in a manner which significantly disfigures the tree or in a manner which would reasonably lead to the death of the tree. 7.2 Permit Requirements: All franchise utility companies shall be required to maintain at the City a set of pruning specifications (updated annually) to be followed by all pruning contractors working for the company within the '" City. Prior to beginning any pruning not requested by the owner of the tree, the contractor shall submit to the City a pruning permit for approval. As allowed in section 3.6 -c, utility companies may prune trees as necessary to re- to establish disrupted electric service without obtaining a permit. 7.3 Allowed Pruning: The Landscape Administrator may approve pruning of a protected tree in cases where a protected tree must be pruned to remove branches broken during the course of construction, or where protected trees must be +r strategically pruned to allow construction of a structure. When allowed, all pruning shall be in accordance with ipm approved Arboricultural techniques and the recommendations of Appendix 'G'. 410,, 7.4 Required Pruning: The owners of all trees adjacent to public R.O.W. shall be required to maintain a minimum . clearance of ten feet (10') above the traveled pavement or curb of a public street. The City shall also have the right to prune trees overhanging within Public R.O.W. as necessary to preserve the public safety. ••. 8.0 TREE PLANTING RESTRICTIONS as 8.1 Overhead Lines: Any required replacement trees shall not be planted within an area such that the mature canopy of the "* tree will interfere with overhead utility lines. all 8.2 Underground Utilities: Any required replacement trees shall not be planted within an area such that the mature root zone of the tree will interfere with underground public utility lines. No trees shall be planted within ten feet (10') of a fire hydrant. 9.0 ENFORCEMENT air ,,.. 9.1 Developers Agreement: No developer's agreement shall be approved which does not state that all construction activities shall meet the requirements of the tree preservation ordinance. tio 9.2 Building Permit: No building permit shall be issued unless the applicant signs an application or permit request which �•• states that all construction activities shall meet the requirements of the tree preservation ordinance. The Building Official shall make available to the applicant a copy of the tree preservation ordinance or a condensed summary of the relevant aspects pertaining to the type of 6111 permit requested. 9.3 Acceptance of Improvements: No acceptance of public improvements shall be authorized until all violations have fir been paid to the City or otherwise relieved through the Municipal Court. 9.4 Certificate of Occupancy: No Certificate of Occupancy (C.O.) shall be issued until all violations have been paid to the City or otherwise relieved through the Municipal err Court. 10.0 VIOLATIONS ism Any person, firm, corporation, agent or employee thereof who violates any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction hereof shall be fined not to exceed Five Hundred Dollars and No Cents ($500.00) for each incident. Each protected tree shall be considered a separate incident and shall be subject to the maximum penalty of $500.00 per tree. ,,,.. 11.0 SEVERABILITY It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of "ft this ordinance are severable, and if any phrase, clause, a0 sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, ow sentence, paragraph or section.
