Re: Ordinance Priorities for Fiscal (FY) 2013
During recent months, Council members have requested staff investigate the
development of a number of new ordinances or revisions to existing ordinances. Prior to
bringing an ordinance forward through the public process (SPIN, Planning Commission
(zoning related ordinance) and City Council), it is imperative that a majority of Council
members agree that an ordinance should be developed or modified for consideration.
During the work session at the Tuesday, February 5t" regular meeting and at the City
Council retreat on February 6t", staff will bring you a list of ordinances requested by
Council members for consideration. At these meetings, staff will provide Council a brief
overview of all the ordinances under consideration and will define the issues. Staff will
then ask Council to make a final decision on which ordinances to proceed with this fiscal
year.
Ordinances to be discussed at the Tuesday, February 5t" regular meeting work session
include:
1) Beekeeping — This ordinance would address the potential licensing and regulating
of bee keeping. This will include the keeping of hives, permitted bee species, location of
hives, prohibited conduct, inspections and penalties. Currently the animal control
ordinance prohibits the keeping of bees in such a manner as to deny the reasonable
use and enjoyment of adjacent property or endanger the personal health and welfare of
the inhabitants of the city. This would be an amendment to the animal control
regulations within the City Code.
2) Keeping of Livestock - This would be a modification to the existing ordinance
regulations to provide the definition of an enclosed area; removal or appropriate
disposal of droppings and proper care of the animals. This would require modifications
both to the zoning ordinance and animal control regulations in the City Code.
3) Animal Control Ordinance — This would be a major revision to the animal control
regulations of the City Code to ensure consistent regulations between Southlake, Keller
and Colleyville. The City of Southlake and Colleyville contract with the City of Keller for
Animal Control Services.
4) Building Color Ordinance —This ordinance would address building color standards
for non-residential buildings and prohibit the use of florescent paint, florescent colors
and the extensive use of bright colors. A SPIN meeting has been conducted on this
proposed ordinance.
5) Vulnerable Road User Ordinance — This new ordinance would establish standards
for a safe passing of vulnerable road users which typically are defined as pedestrians,
bicyclist and construction workers by motor vehicles when road conditions allow. The
City Council requested that the 2030 Mobility Committee study the ordinance and
provide a recommendation.
6) Lighting Ordinance — This revision would provide regulations for stadium lighting and
the updating of technical standards.
7) Noise Ordinance — This revision would add objective standards for addressing
continuous noise disturbances. The ordinance would address animal noise, amplifiers
in the public right-of-way, solid waste collection and ambient noise levels. The
ordinance would also address exemptions to the ordinance.
8) Public Art Ordinance — This ordinance would require developments over a certain
square footage or size be required to include a public art element within the scope of
the project.
9) Minor Zoning Ordinance Amendments — The zoning ordinance would be modified to
require a water usage impact analysis be conducted with a rezoning application. This
requirement will help the City assess the impact of a proposed use on the city's water
supply.
10) Texting Ordinance — This ordinance would prohibit drivers from texting, emailing,
instant messaging, and surfing the Internet while their vehicle is a part of traffic within
the city limits.
Ordinances discussed on February 6tn will be in executives session due to legal issues
associated with these ordinances. These ordinances include:
1) Regulation of certain retail uses;
2) Site Plan and Plat Expiration; and
3) Planning and Zoning Commission Supermajority Vote
4) Landscaping Ordinance
5) Masonry ordinance
6) Subdivision Ordinance
As Council is aware, ordinance changes require public notifications to all potential
impacted property owners. Due to the number of ordinances being considered,
notification costs associated with the ordinance changes could easily be well over
$15,000. Due to the substantial public notification costs associated with the adoption of
these ordinances, staff would like to do a single citywide notification versus multiple
notifications, resulting in a significant cost savings to the City.
