2012-11-29lugCITY OF SOUTHLAKE TEXAS REGULAR ZONING BOARD OF ADJUSTMENT MEETING: November 29, 2012 Location: Southlake Council Chambers 1400 Main Street, Southlake, Texas Members Present: Chair Shawn McCaskill, Vice -Chair Phyllis Lambert, Board Members Paul Venesky, Nicole Smith, Daniel Kubiak and Dustin Andrews Members Absent: Board Member Lisa Amend Staff Present: Dennis Killough, Deputy Director of Planning & Development Services; Richard Schell, Planner II, and Misty Knaust, Board Secretary REGULAR SESSION: Agenda Item No. 1 — Call to Order: Chair McCaskill called the meeting to order at 6:31 p.m. Agenda Item No. 2 — Approval of the Minutes: Chair McCaskill opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on October 25, 2012. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on October 25, 2012. Motion: Kubiak Second: Lambert Ayes: Venesky, Kubiak, Smith, Lambert and McCaskill Nays: None Abstain: Andrews Vote: 5-0-1 Motion: Carried Agenda Item No. 3 — Administrative Comments: Richard Schell, Planner II, announced that currently no cases have been submitted for the December 13th meeting and that the next scheduled ZBA meeting is January 10, 2013. Aaenda Item No. 4 — ZBA-629. Special Exception Use Permit per Ordinance No. 480 Section 44.12(1) for a servants or family quarters. The request is being made by the applicant, Diana Taylor and Laura Cronin, for property located at 3160 Johnson Rd., Southlake, Texas, and described as Lot 10, J.J.Freshour No. 521 Addition, an addition to the City of Southlake, Tarrant County, Texas. The current zoning is SF -1A — Single Family Residential District. Richard Schell, Planner II, reported nineteen (42) notices were mailed out within two hundred (200) feet with six (6) responses received. The six (6) responses received: Roy Grant Hill (28), 709 Cimarron Trail, Southlake, TX; Submitted a Notification Response Form stating In Favor; Sandra and Tod Radfore (9), 3185 Johnson Road, Southlake, TX; Submitted a Notification Response Form stating In Favor; Tom and Debbie Robertson (35), 1607 N. Board Member Kubiak asked Planner Schell if the applicant owned the driveway or if it was in an easement. Planner Schell stated that it is a flag lot, so the driveway is owned by the property owner. Board Member Kubiak also questioned if there were any setback or size issues with addition. Planner Schell stated that the addition does not exceed the maximum 3% or 4,000 square foot maximum lot coverage regulation that is allowed in the zoning ordinance. Board Member Kubiak also asked if the handwritten comments on the plot plan and roof plan would be binding. Planner Schell confirmed that the comments would be binding since they are on the exhibits provided by the applicant. Applicant Laura Cronin, located at 3160 Johnson Road was sworn in. Ms. Cronin stated that the driveway is at least sixteen (16) feet wide and that the property was re -platted in 2000 and that they own eight (8) feet of the driveway on east side due to a common access easement. The applicant responded to Vice -Chair Lambert's question about the driveway by stating that the driveway was installed in 2001 and is now crushed asphalt and that no changes to the driveway are proposed. The applicant stated that she is requesting to add on to the existing structure because it is small, making it difficult to take care of any elderly members of the family that might need assistance. The addition will be a single story, will match the existing building and will meet all requirements of the zoning ordinance. Mrs. Cronin also stated that addition will comply with the drainage plan that was originally submitted for construction of the house. The drainage on the lot is from north to south, so the addition will not affect the drainage pattern.
