Members; W. Ralph Evans, Sally Hall, Michael Richarme. (Jerry Farrier and Stephen Apple were present at the beginning of the meeting). Alien Taylor Jr., City Attorney; and, Sandra L. LeGrand, City Secretary. INVOCATION: Councilmember W. Ralph Evans. The Regular Council meeting was called to order at 7:07 p.m. by Mayor Gary Fickes. The Mayor thanked two gentlemen, Jerry Farrier, who started on this Council five years ago, and Stephen Apple who has been on the Council for three years. The Mayor stated they have given their all. He presented Mr. Apple with a plaque of appreciation for a job well done. Mr. Apple stated he is sorry he was not able to run for re-election, but he has a new job that keeps him out of the state most of the time. Jerry Farrier was then awarded a plaque and the Mayor thanked him for serving the citizens for five years and for serving as the Mayor Pro Tem. The Oath of Office was administered by the City Secretary to newly elected Councilmember Place 3, Pamela Muller and Councilmember Place 4, Sally Hall. Agenda Item 3-A. Executive Session Mayor Fickes advised the audience that Council would be going into executive session pursuant to Chapter 551 of the Texas Government Code, Sections 551.071,551.072, 551.074, 551.076 of the Open Meetings Act, to seek the advice of the City Attorney with respect to pending and contemplated litigations, to discuss the purchase, exchange, lease or sale of real property and to consider the appointment and evaluation of public officials, and regarding the deployment of specific occasions for implementation of security personnel or devises. The Minutes of the Regular City Council Meeting held on May 2, 1995 and the Special (Canvass) City Council Meeting held on May 8, 1995, were approved as presented. Mayor Fickes presented a Proclamation to Southlake Public Works Employees, Sandra Morey, Michael Patterson, Ernest Bramlett, and Angelia Stulken, in honor of National Public Works Week, May 17-24, 1995. Mayor Fickes noted some of the activities planned for the week, including: Public Works Picnic on May 20, between 1:00 p.m. and 4:00 p.m.; Ribbon Cutting on Kimball Avenue, at 10:00 a.m. on May 23, 1995; On May 24, Open House for Public Works at City Hall. Agenda Item #4-B. City Manaeer's Renort. Curtis Hawk, City Manager, informed the audience of the condition of Paula Ward, wife of Paul Ward, Chief Building Official for Southlake, stating, she went into a coma on March 30, 1995, with a brain aneurysm. A fund has been set up at Texas National Bank in Southlake for anyone who would like to contribute to the fund to help with medical expenses. Agenda Item #5. Consent A~,enda The consent agenda consisted of the following items: 5-A. Resolution No. 95-11, appointment of a Mayor Pro Tem and Deputy Mayor Pro Tem pursuant to City of Southlake Charter, Article 2.07. 5-B. Authorizing the Mayor to execute a renewal agreement with First Southwest Company as the City of Southlake Financial Advisor. 5-C. Appointment of Lugar as additional Canine to the Department of Public Safety, Police Services Division. Regular City Council Meeting Minutes May 16, 1995 page three Agenda Item//5. Continued Motion was made to approve the consent agenda consisting of items #5-A, gS-B, and #5-C. Motion: Richarme Second: Evans Ayes: Richarme, Evans, Wambsganss, Hail, Muller, Fickes Nays: None Approved: 6-0 vote Following approval of Resolution No. 95-11, Andy Wambsganss and Pamula Muller were administered the Oath of Office by the City Secretary as they were appointed to Mayor Pro Tern and Deputy Mayor Pro Tem respectively. ADDITIONAL INFORMATION ON CONSENT ITEMS 5-A. In the City Charter, Article 2.07, states the Mayor shall appoint, with the approvai of the City Council, a Mayor Pro Tem and Deputy Mayor Pro Tem who will serve as Mayor in case of the absence or disability of the Mayor. Mayor Fickes appointed Andy Wambsganss to serve as Mayor Pro Tem and Pamela Muller to serve as Deputy Mayor Pro Tern. Both shall serve one year-terms. Financial Advisory Agreement with First Southwest Company. LouAnn Heath, Director of Finance stated in 1989, Council approved a five year agreement with First Southwest Company for Financiai Advisory Services. During this time they have assisted the City with severai debt issuances, debt restructuring, refundings and ratings presentations. During the past five years, the City's bond rating has been increased from 'BBB' and 'Baa' from Standard and Poor's and Moody's Investor Services, respectively, to 'A' from both. They will coordinate and direct ail programs of financing, survey the City's financial resources to determine debt capacity, and advise of current bond market conditions. Police Reserve Sergeant Richard Anderson has acquired a german shepherd that had been in training for approximately eight months for narcotics work. The canine, Luger, is certified by the Texas Narcotics Dog Detector Association and the National Narcotics Dog Detector Association for marijuana, heroine, and methamphetamine. Placing Lugar in service will not impact general funds sinch Luger is owned and maintained by the Reserve Officer. This gives the City's officers, school officials, city officials, and any mutual aid agency that has a need for narcotics detection, the opportunity to use Lugar as needed. Regular City Council Meeting Minutes May 16, 1995 page four Agenda item #6. Public Forum Gary Hargett, 1125 South White Chapel Blvd., Southlake. Mr. Hargett provided Council an update on the progress of the wail that has been built against his south property line on South White Chapel Blvd. He stated he visited with City Council on February 8, 1995 about this issue and stated he explained to the City engineering department before the wall was erected that it was a half measure, at best. After the go-ahead was given, the wall was installed. To date he has sink holes along the south side of his property on his side of the fence. The water is being damned up, and this is a violation of the Texas Water Code. He stated he has tried to do everything he could within the system, and to date the ground on the back side of the wail is still above the grade level, according to Hargett. He stated he wants to call attention of the City Council the fact that this complaint has gotton lost in the new business. He stated he does not want to go to court to start with; he doesn't want to go to litigation, but as long as the violator on the other side of the fence is not going to voluntarily do something on his own, it will take something outside his power to correct the problem. He asked the City Manager to consider looking at complaints so that old problems do not get lost in ail the new business. He commented he feels this is something the city will benefit by and he knows the citizens would appreciate it. Mayor Fickes stated he feels Mr. Hargett has done everything he can do as a citizen; he is informed, he has talked to the city about it, but the problem is still there. Councilmember Wambsganss stated he feels the city could use the mediation process, and act as a facilitator in this case, between the two property owners. Mr. Hargett stated the Developer's engineer got approval from the City "that the fence would work," now the City should say it doesn't work. He feels the City should step in and make the developer do it right. Ron Harper, City Engineer, commented the engineer for the Adams Addition sealed the plans stating it would work. He has been put on notice that it didn't work. Bob Whitehead stated the "Certificate of Occupancy" would not be issued unless it is fixed. Regular City Council Meeting Minutes May 16, 1995 page five A~enda Item #6-B. Public Aooearance: Dick Johnston. Recvcline Bin Covers. Dick Johnston, 139 Jellico Circle, Southlake. Mr. Johnston stated he was making this presentation on behalf of Keep Southlake Beautiful and here to state he has made a mistake with his recommendation of plastic "shower caps" for recycling bins. Johnston stated they tested sixty (60) caps and they did not work. Following the test they sent out a questionnaire and 50% responded. One third of the 50% who responded said, no way we should buy those, and 2/3 had reservations. Mr. Johnston, from personal experience, found that the cap did not hold up to driver handling. Mr. Johnston stated he is here now recommending that the City buy the "hard cap". He has followed up with Laidlaw and through Laidlaw, was put in contact with the manufacture representative of Rehrig Pacific Company in Dallas, who makes the hard plastic cap. They sell the caps in lots of 2,000 or more at $3.43 per cap. He feels the city need 3,000 to meet the present needs, at a cost of $10,290. KSB is recommending that this be purchased. KSB would like to place a sticker logo on each cap. Councilmember Richarme stated, if Laidlaw gets involved, we could let them help pay for them. He asked the City Manager to talk with Laidlaw concerning this. He feels the City should go ahead and get the hard plastic caps. Curtis Hawk, City Manager, stated this will be on an agenda for action. Councilmember Muller suggested these also be tested prior to the purchase. Mr. Johnston stated if the caps are purchased, KSB will distribute them. Agenda Item #8-A. and #8-B. ZA 95-30 Preliminary Plat for Timarron Addiltion. Villaee "H" ond ZA 95-31. ZA 95-30, Preliminary Plat for Timarron Addition, Village "H" being 91.17 acres situated in the Hollingsworth & Barnett Survey, Abstract No. 797, the M.W. Davenport Survey, Abstract No. 432 and the John N. Gibson Survey, Abstract No. 591. Owner: Timarron Land Corporation. Applicant: Carter & Burgess Inc. Preliminiarv Plat for Lonesome Dove Baptist Church ZA 95-40, Preliminary Plat for Lonesome Dove Baptist Church, being 10.537 acres of land situated in the N.E. Thompson Survey, Abstract No. 1563, Tract 2C. Current zoning is "CS" Community Service District. Owner/Applicant: Lonesome Dove Baptist Church. SPIN Neighborhood #3. Karen Gandy, Zoning Administrator, commented that twelve (12) notices were sent to property owners within the 200' notification area and two written responses have been received from: James and Bobbie Wooll, 1400 Emerald Circle, in favor; and Gregory Swain, 2407 Taylor Street, undecided. Ms. Gandy, stated the applicant has met all review comments of the first Plat Review Summary dated April 28, 1995 with the exception of those items addressed in the second Plat Review Summary dated May 12, 1995. Clarence Hart, Surveyor for the property was present to answer questions for Council. He stated he has taken care of all items in the review letter except for item #2. Mr. Hart discussed item g2 with Greg Last and Karen Gandy. Motion was made to approve ZA 95-40, subject to the second Plat Review Summary dated May 12, 1995. Ordinance No. 634, 1st reading,. Driveway Ordinance. Tom Elgin, City Planner, presented the 5th draft of the Driveway Ordinance, No. 634, stating the primary purpose of the driveway ordinance is to regulate the size, type and spacing of driveways. Secondary intentions of the driveway ordinance are the establishment of minimum driveway construction specifications and related drainage criteria. This ordinance has been proposed for about 2-3 months, with input being given from the citizenry and the development community. Mr. Elgin also presented a Driveway/Access Control Ordinance Comparison, which is attached to the minutes of this meeting. Councilmember Richarme asked for an opinion from the City Attorney in terms of if we can enforce the depth of access lanes as noted in the ordinance. City Attorney, Allen Taylor, stated as long as the access lane is clearly premised around public health or safety requirements it can be enforced. The City Manager, Curtis Hawk, stated staff will bring this ordinance back to Council in the near future as first reading in order for the changes suggested tonight can be incorporated into the ordinance. Councilmember Richarme commented that Mr. Elgin has done a good job with this ordinance and he would like to move forward with 2nd reading at the next meeting. Councilmember Muller had questions regarding the "intent and purpose" section of the ordinance, asking is it necessary? In the past we have had problems with the "intent, and purpose." Councilmember Muller also asked questions in regard to the comparison with different cities. In some cases, Southlake is not as strict; why is this? Ordinance No. 579-A. 1st reading. Truck Route/House Moving, Ordinance No. 579-A, 1st reading, amending Ordinance No. 579, Truck Route/House Moving, was presented by the City Manager, Curtis Hawk, who stated the only change in the ordinance would be changing the designated truck route from Carroll Avenue to Kimball Avenue, with everything else being the same. Regular City Council Meeting Minutes May 16, 1995 page eight Agenda Item #8-E. Continued Councilmember Hall asked how this ordinance will be enforced? The City Manager replied, it is like speeding, you have to catch them. Motion was made to adopt Ordinance No. 579-A, 1st reading. Aeenda Item #10-A. Donation for Country Walk Park Site. Cole McDowell, developer of the Country Walk subdivision, asked that this item be tabled until June 20, 1995 City Council meeting. Motion was made to table action regarding the donation for Country Walk Park Site as requested by Cole McDowell. Discussion: Public Access on Private Prooertv Director of Public Safety, Billy Campbell, lead the discussion regarding a proposed ordinance regulating the public access on private property. He noted as the city becomes more populous it is important that Public Safety be proactive in the protection of its citizens while allowing the general public to participate in local commerce in the regular traversement of the City in a safe and convenient manner. This ordinance will allow any citizen to move about the city, business- to business, unobstructed by vehiclular or pedestrian traffic that does not pertain to the business in which they are trying to access. The parking lots and areas of a business are for the cutomers and not an area for gathering numbers of people in cars with no apparent intent of patronizing Regular City Council Meeting Minutes May 16, 1995 page nine A~,enda Item #11-A. Continued the establishments. Highlights of this ordinance are that it is non-mandatory to participate. It regulates non-customers on private property. Participation is indicated to the public by the installation of signs in a conspicuous place as per the ordinance and it sets guidelines for enforcement. This ordinance also gives the definition of parking and access and private business premises. The ordinance states that the owner or operator of a business may post signs in a conspicuous place with clear wording per the city ordinance. There is a violation section in the proposed ordinance. Councilmember Hall commented on the posting of signs being voluntary and necessary for the ordinance to be enforced. Councilmember Richarme stated if this ordinance goes forward, he would like to see a one year follow-up. The consensus of Council is for this to come back in the form of an ordinance. Agenda Item #Il-B, Discussion: Outdoor Burnine of Brush and Deadfall. The City Manager, Curtis Hawk, stated he asked the Director of Public Safety to put something together in late 1989 when the Texas Department of Health put a ban on outdoor burning. DPS was asked to revisit the permitting of outdoor burning to see if there is a need to entertain the reissuing of burning permits. The memorandum from Director Campbell, as well as a letter from the City Attorney regarding Outdoor Burning, is hereby attached to the minutes of this meeting. Director Campbell stated about eighteen (18) months ago Southlake stopped issuing burn permits. The Texas Natural Resources Conservation Commission (TNRCC) rules must be upheld by the City. We must be careful not to violate these rules. Mayor Fickes asked Campbell to look at a concept of having burning every few weekends. Campbell stated he can do that, but there are budget restraints. A discussion was held regarding the TNRCC guidelines. Campbell stated, by meeting the requirements, will narrow who will be asking for the service. Curtis Hawk stated by talking tonight, he feels staff has an idea what Council would like to see in an ordinance. Regular City Council Meeting Minutes May 16, 1995 page ten Agenda Item #11-C. Discussion: Community Develonment Block Grant Proiects. Greg Last, Director of Community Development, stated as Council will recall during previous discussions regarding the Community Development Block Grant projects, Southlake has recently received confirmation that Sutton Place and Oak Lane have been approved as qualified target areas under the CDBG grant program. Staff is bringing this item forward for Council direction at this time due to the need to acquire needed right-of-way or easements prior to submittal of the 1996 CDBG application, typically in January. We need to proceed with the required research and exhibit preparation as early as possible so that we will have an eligible CDB G project this upcoming year. A copy of the memorandum from Greg Last, dated May 12, 1995, concerning the CDBG is attached to the minutes of this meeting. Curtis Hawk, City Manager, stated the big picture issues are that CDBG funds can not be used on improvements on "private" streets. The only eligible areas for the funds in Southlake are Sutton Place and Oak Lane areas, both of which have private streets. We are currently eligible to receive CDBG allocations of approximately $130,000 per year. We will not have a project eligible for funding in the next CDBG year 1996, unless we acquire the street right-of-way as "public." Upon Council direction, staff will need to proceed as soon as possible with community meetings and legal description preparation in order to meet the January 1996 CDBG project submittal deadline. Agenda item//Il-D, Discussion: Noise Ordinance No. 435. Curtis Hawk, City Manager, stated we have had problems with Ordinance No. 435 on noise for several years and have been unable to adequately address the problems. We have a new problem which has surfaced which we would like to address. Section l(g) prohibits the operation of heavy equipment within 1500 lineal feet of any occupied dwelling after 6:00 p.m. This includes the Shady Oaks school site and other CISD and COS projects. It makes sense to extend this to a later hour in order to allow for timely completion of the projects. Delays ultimately cost every taxpayer. Staff was forced to issue several citations to the school contractors following citizen complaints, but we do not want to be responsible for slowing down the work. Mayor Fickes stated when tickets are given to subcontractors it is a concern to the contractor, as the job needs to be open on time. City Manager Hawk stated, the 48 hours is a problem to him. Hawk, City Manager FROM: Billy Campbell, Director of Public Safety SUBJECT: Allowing for Outdoor Burning of Brush and Deadfall Fire Service was asked to revisit the permitting of outdoor burning and the following are regulations we feel need to be met if the city wishes to entertain the reissuing of burning permits. Most of these regulations were taken from the text of the Texas Natural Resources Conservation Commission (TNRCC). Also attached is the letter from the City Attorneys giving their opinion as to whether the city can regulate burning within the corporate limits. 1. Burning must be conducted between the hours of 9:00 a.m. and 5:00 p.m. 2. Wind speeds must not be greater than 20 miles per hour and not less than 6 miles per hour. 3. Wind must not be gusty or inclement weather predicted for the area. The site must be inspected by Fire Services prior to permit being issued and be acceptable to Fire Service equipment. 4. Service of off duty firefighters must be secured to stand by the equipment during burning. The person doing the burning will be responsible for the cost of two fire fighters at a standard off duty rate of pay with an adult attendant representing the property owner present at all times. 5. Only natural products may be burned. No garbage, rubbish or other materials such as roofing materials or treated lumber. 6. Burning areas must be free of trees, grass and other combustible for an area of 100 feet. 7. Burning areas must be at least 300 feet from any structure or adjacent properties. Smoke must not adversely affect any adjacent or property. Any person with a valid trench burn or land clearing permit from the TNRCC is exempt for Sections 4 & 5. These do not include camp fires and warming fires or any other type fires that are permitted in any other ordinance for the City of Southlake. I read these regulations to permit eight (8) specific types of outdoor burning. One type of outdoor burning which is specifically permitted is "rural area on -site burning of trees, brush, grass and other dried plant growth when no practical alternative to burning exists for right -of -way maintenance, land clearing operations and for... forest, crop and range management purposes...." (30 T.A.C. §111.103(b)(5)). Burning which is conducted under this provision must occur outside the corporate limits of the city except when it is necessary to eliminate a naturally occurring fire hazard as determined by the local fire department. It is my opinion that deadfall could be classified as a naturally occurring fire hazard. If burning occurs under this provision, it must be conducted under certain guidelines set forth in section 111.105 of the regulations. These guidelines include a 300 foot distance restriction from adjacent properties, limited hours of burning between 9:00 a.m. and 5:00 p.m., and a wind speed no greater than twenty -three miles per hour and blowing in a direction away from areas which might be affected by the smoke. f: \files \muni \slake \letters \hawk.008 AGENDA ITEM # 11 -B Mr. Curtis Hawk February 23, 1995 Page 2 The TNRCC regulations are adopted pursuant to Chapter 382 of the Texas Health and Safety Code (the Texas Clean Air Act). Section 382.018 of the Act provides that the board, by rule, may control and prohibit outdoor burning of waste and combustible material. Section 382.113 authorizes a municipality to enact and enforce an ordinance to control and abate air pollution as long as the ordinance is consistent with Chapter 382 and the board's rules and orders. A municipality may not make unlawful a condition or act approved or authorized under Chapter 382 or the board's rules or orders. Finally, any person who violates the TNRCC's rules or orders as described above would be subject to all kinds of terrible penalties, including civil penalties up to $25,000.00, administrative penalties and criminal penalties. The Executive Director may. also specify procedures or methods to control or abate emissions from outdoor burning authorized pursuant to this rule by requiring that trenches be dug to align with .prevailing winds, specifying time for•burning, and other related fac- tors. Authorizations to burn may revoked by the Executive Director a: any time if the burning is causing nuisance conditions, is not conducted in accordance with he specified conditions, violates any provision of an applicable permit, or causes a violation cf any air gsality standard. Hawk, City Manager FROM: Greg Last, Community Development Director SUBJECT: Professional services contracts with Cheatham and Associates for the preparation of legal descriptions and exhibits for Community Development Block Grant projects in Oak Lane Addition and Sutton Place. As you may recall during previous CDBG discussions, we have recently received confirmation that Sutton Place and Oak Lane have been approved as qualified target areas under the CDBG grant program. We are bringing this item forward for Council direction at this time due to the need to acquire needed R.O.W. or easements prior to submittal of the 1996 CDBG application, typically in January. We need to proceed with the required research and exhibit preparation as early as possible so that we will have an eligible CDBG project this upcoming year. Following you will find an approximate schedule for proceeding with the necessary research and R.O.W. acquisition prior to submitting the 1996 application. TIMING OF IMPROVEMENTS: The construction of water, sewer, streets and drainage improvements for both additions will be a multi -year implementation due to the limitations in annual funding provided by the program. The engineering staff feels that it is likely that the S2A sewer line will be in place and in service prior to the N -1 (McMahan) sewer line and this would make it more feasible to construct improvements in Sutton Place first. In effect, we would be leveraging a small amount to gain a greater benefit. As shown in the previous chart, R.O.W. and easement preparation would come from FY 1995 -96 funds. This would be funded by the Utility Fund. The chart also shows that there may be City participation required above and beyond the CDBG allocation to do a certain portion of the project. Some additional phasing or staged construction might be pursued which would lower or reduce the City participation amount. Any costs of acquiring the needed easements would also be a cost to the City; outside the CDBG funding. Public works staff will incorporate these costs into future budgets for your consideration. Please keep in mind that all of these stages and costs for the program improvements are rough estimates at this time. We will be back before Council to receive direction many times regarding these projects as well as discussing the costs during the budget review sessions. PROCESSING: Staff will need to coordinate some neighborhood meetings as soon as possible to discuss the CDBG opportunities for improvements with the citizens in the targeted areas. We intend to describe the program and the timing of the improvements. OTHER ISSUES: There are some ancillary issues which we are aware of but have not resolved at this time. The City of Keller is currently providing water service to the residents in Sutton Place. There may need to be some type of buy -out for Keller to transfer these accounts. Oak Lane is being served by a private water system (CCN Number 11566) owned by a Mr. McKee. We are unsure at this time what his position will be with regard to the proposed CDBG improvements.
