Subject: Authorize staff to execute developer agreements with Hines -
GTIS Carillon, LLC for Carillon Development Phases.
Action
Requested: Authorize staff to execute developer agreements with Hines -GTIS
Carillon, LLC for Carillon Development Phases.
Background
Information: An Economic Development Program Agreement (i.e., 380
Agreement) was approved by the City Council on August 17, 2010
for the entire Carillon Development. This agreement set the
performance standards the Carillon Development must meet.
Included in this agreement are the park and open space dedication
requirements, Kirkwood Boulevard extension requirements, and the
widening of White Chapel Boulevard.
Currently all the Developer's Agreements for the various phases of
Carillon require City Council approval since there are not any park
fees as the dedications have been established in the 380
Agreement. The reimbursement and City participation of Kirkwood
Boulevard and White Chapel Boulevard have also been defined in
the 380 Agreement. To date there are five (5) phases with a
separate residential developer agreement for each phase that has
been brought to City Council for approval. All of these phases
conform to the 380 Agreement. Authorizing staff to execute future
conforming residential and commercial developer agreements will
expedite the process.
Staff is seeking the authorization to execute the Developer
Agreements as long as the terms of the 380 Agreement are
adhered to. Any future requests by Hines -GTIS that may deviate
from the terms of the 380 Agreement will be brought forward for
City Council consideration.
Financial
Considerations: This ability would streamline the development process of the
Carillon development phases.
Strategic Link: The Carillon Phase development links to the city's strategy map
relative to the focus areas of Quality Development. The specific
corporate objectives that are met by the construction of the
development are: Invest to provide and maintain high quality public
assets. The authorization for staff to execute the developer
agreements would improve performance of delivery and operational
processes.

Legal Review: These are the City's standard residential and commercial developer
agreements (RDA and CDA) originally drafted by the City Attorney.
Alternatives: The City Council may authorize staff to execute the residential and
commercial developer's agreements or deny it.
