Commissioner Fairchild asked where the figure of 4,000 square feet for the future bunk house and office space come from. Richard Schell stated the applicant made the request. Commissioner Fairchild explained that the existing bunk house and office space is 1,500 square feet. Renee Esses, 501 Magnolia Trail, Grapevine came forward. Ms. Esses is a wrangler at Marshall Creek Ranch and made a brief presentation with power point. Before starting the presentation, Ms. Esses addressed Commissioner Fairchild's question. The bunk house and office space is 2 -story. The presentation gave an overview of what the ranch provides and their plans regarding the request. Within the presentation Ms. Esses announced the formal agreement between Marshall Creek Ranch and the Town of Trophy Club regarding the use of the back gate. Chairman Hudson asked if they plan to add additional stalls in the future. Shandra Doran, the owner, 2228 Galloway Blvd., Trophy Club stated that the current facility will hold 32 horses. They have no plans to increase that. Commissioner Fairchild asked about the parking being all dirt and what happens when it rains. Ms. Esses stated that the horses can't go out when it rains, so we don't have customers at the time it rains. However, even when it rains it doesn't get muddy. Commissioner Fairchild asked if the agreement with the Core to provide access through the property before 7a.m. Ms. Esses stated no. Part of that agreement is to have the back gate closed when it rains so that no one can ride on it and tear it up. When the ranch is open the gate is open. Ms. Esses and Mrs. Doran stated everything flows down and out to the creek. Chairman Hudson opened and closed the public hearing. Commissioner Springer is concerned about the trees around the bunk house. The trees look mature. Commissioner Fairchild agreed but asked for clarification from Staff regarding the replacement of the trees. Dennis Killough stated that the Commission can include the preservation of the trees in their motion for recommendation to Council. Commissioner Smith asked if Staff had a copy of the agreement between Marshall Creek Ranch and the Town of Trophy Club. Ms. Esses and Mrs. Doran explained the agreement and is with the Town of Trophy Club regarding the equestrian park trails. The agreement had to go through the Army Core of Engineers as well. Chairman Hudson would like to see the trees preserved. Motion to approve ZAl2 -030 with requested variance; Driveway Ordinance 634 as amended requires a driveway stacking depth of 28 -ft. A variance to allow approximately 6 -ft. of stacking depth as currently exists is requested. Subject to Revised Staff Report dated January 17, 2013 and Site Plan Review Summary No. 4 dated January 11, 2013. Also, subject to the preservation of the trees surrounding the existing bunk house. Mrs. Smith stated yes. That once she has all appropriate approvals, the existing house will be removed. Chairman Hudson read aloud a last minute response form that came in. Barbara Paty, 1000 N White Chapel Blvd. is in favor of this request. Chairman Hudson opened and closed the public hearing. Mr. Simmons stated that a revised site plan has been given to Staff showing the addition of an enclosed maintenance service area to the connecting corridor. This will allow for golf cart parking as well as food service deliveries. Chairman Hudson opened and closed the public hearing. Deputy Director of Public Works, Gordon Mayer came forward and presented the Traffic Impact Analysis along with a presentation explaining the study and the improvements Planning and Zoning Commission Meeting Minutes - January 17, 2013 Page 5 of 9 that will be made to the road. Chairman Hudson asked if this was originally submitted. Mr. Mayer stated that this is what was originally submitted. The right in and right out was added to assist traffic. Executive Session: Chairman Hudson announced that Planning and Zoning Commission would be going into Executive Session pursuant to Texas Government Code, Section 551.071, consultation with the city attorney, 551.074 deliberation regarding personnel, and Section 551.072, deliberation regarding real property. Planning and Zoning Commission adjourned for Executive Session at 7:48 p.m. Executive Session began at 7:49 p.m. and concluded at 8:15 p.m. Reconvene: Chairman Hudson reconvened the meeting at 8:20 p.m. and same members and staff are present. Chairman Hudson stated that no action was necessary from Executive Session. Bobby Dollak with G & A Consultants LLC, 611 Dallas Dr. Suite 114, Roanoke came forward. Mr. Dollak gave a presentation. The presentation gave a timeline regarding the project and the description of the project. Chairman Hudson opened the public hearing and read aloud a comment card in support of the project but does not wish to speak; Peter Gentile, 304 Odessa Dr., Haslet. Michael Bustamante, 1501 Plantation Dr., Southlake came forward. Mr. Bustamante acknowledged Mr. Dollak working to make considerations for the surrounding property owners. However, Mr. Bustamante would like to see the lot size increased more and additional green space. The other issue, Dove Rd. and Peytonville Ave. are very overcrowded. The entrance and exit onto Dove Rd. doesn't look viable. Commissioner Fairchild asked Mr. Bustamante where he lived in conjunction with this development. Mr. Bustamante stated that he lived on Plantation Dr. just south of Dove and Peytonville. Susan Kedron, 901 Main St, 75202. Ms. Kedron is here representing the O'Neil Family and is requesting the Commission to table this item. The O'Neill Family and the developers are very close to an agreement. Ralph Sells, 825 W Dove Rd., Southlake. Mr. Sells stated that his house is directly across from the Dove entrance. Based on the median location, my driveway would be blocked. Regarding the density, Mr. Sells would prefer to have 1 acre lots and only 20 homes. Chairman Hudson read aloud a comment card in opposition of the project but does not wish to speak; BeAnn Arthur, 1402 Thetford Court, Southlake. Brett Martin, 2250 N Peytonville Ave., Southlake. Currently the way the roundabout is Planning and Zoning Commission Meeting Minutes — January 17, 2013 Page 6 of 9 presented, Mr. Lewis who resides at 2280 N Peytonville Ave would not be able to turn left out of his driveway. This will also affect the Avary's driveway also. They reside at 1075 W Dove Rd. All the points that Mr. Sells spoke on we agree on. Chairman Hudson asked if Sam School Rd. and Peytonville Ave. aligned up would be better with a possible stop sign. Mr. Martin agreed with Chairman Hudson. Mehrdad Moayedi, President and CEO of Centurion American Homes, 1221 N -IH 35 E, Suite 200, Carrollton came forward. Mr. Moayedi stated that he is doing whatever it takes to accommodate the city and the surrounding property owners and will continue to do so in order to develop this property. Dove Rd. has a lot of traffic but it is not a zoning issue. Dove Rd. needs to be improved, not just for current residents but for future residents that will reside within this development. Regarding lot sizes, there are other neighborhoods with the same lot sizes and house sizes. Chairman Hudson asked Mr. Dollak to address the median and roundabout issues that affect Mr. Lewis, Mr. Martin and Mr. Avary. Mr. Dollak stated that the median can be shortened and is willing to work with Staff to accommodate access in and out of those driveways on Dove Rd. Commissioner Smith asked if it was their anticipation that people will come out of this subdivision to make a right and then u turn at the median in order to get to SH 114. Mr. Dollak stated yes. Commissioner Smith stated this will back up and block access to the subdivision. The median will need to be shortened. Commissioner Fairchild asked if the traffic study was done before the most recent changes. Mr. Dollak stated that the last traffic study was done after the last change at the first of the year as a request. It was not required by Staff until the median was introduced. The traffic study that Staff had, already supported the incoming neighborhood. Commissioner Fairchild asked if the traffic study included the 95 homes and the additional 12 lots to the north. Mr. Dollak stated all the houses are included. Mehrdad Moayedi came forward and included that all medians and openings would be landscaped. Also the houses near the roundabouts would be only single story homes. Jennifer Sells, 825 W Dove Rd., came forward. At one neighborhood meeting it was mentioned that the subdivision entrance would actually be blocked at Dove Rd. and the Planning and Zoning Commission Meeting Minutes — January 17, 2013 Page 7 of 9 main entrance would be located off another street. That was the better plan not just for the neighborhood but for the existing traffic. Mr. Moayedi stated that if that is what the City would like, it can still be done. Peter Gentile, 304 Odessa Dr., Haslet came forward on behalf of Ms. Crawford who lives on Crawford Court. Ms. Crawford is in support of this development and is currently in negotiations with the developer regarding an acre of land. Chairman Hudson closed the public hearing. Commissioner Fairchild stated that he would like a copy of the traffic study and is uncomfortable making a decision without it. Commissioner Springer and Commission Smith agree. Commissioner Fairchild believes that the developer has done a great job with communicating with the existing residents and making appropriate changes. However, the entrance on Dove Rd., the median and the traffic is still a huge concern. Commissioner Forman added that the roundabout line up doesn't make since in regards to the property driveways that it affects. That needs to be addressed. Commissioner Smith added that the density is an issue as well along with the traffic. Chairman Hudson asked the applicant to come forward. Mr. Dollak requested to table this item.
